Available in PDF, EPUB and Kindle. Book excerpt: The book is concerned with the harmonisation of maritime safety legal systems in Europe. It describes maritime safety legal systems in selected European countries as well as maritime safety issues from the perspective of the International Maritime Organisation, European Union, and European Free Trade Association. Distinguished scholars from Europe's leading maritime law academic centres present national perspectives of maritime safety systems, questioning whether the adopted national solutions guarantee the compatibility with IMO and EU legal regime, as well as assessing the global and EU system. Moreover, the book seeks to provide some answers as to whether the IMO goals on maritime safety are adequate in light of current safety challenges and how to achieve higher level of enforcement of internationally-recognised maritime safety standards. It will be of great assistance to those readers who need to familiarize themselves with current problems inherent in maritime safety, whether that be lawyers, scholars, professional mariners, or national institutions. Purchasers can usually download a free scanned copy of the original book (without typos) from the publisher. Not indexed. Not illustrated. 1806 edition. Excerpt: ... CHAPTER IV. OF THE RIGHTS OF BELLIGERENTS ON THE SEA, AND THEIR CONSEQUENCES. Rapture is the seizure of a vessel belonging to a real or supposed enemy, with the effects on board, either by a belligerent, or by some other person, to whom his government has given the power, with an intention to divest the owner of the property and to appropriate it to him self. (205) 2. In detaining, or seizing a vessel, there may be two objects in view; either to take and keep posses ' sion of the vessel and cargo, which is, properly speaking, a capture; or to seize the effects of an enemy, or goods contraband of war, on board a neutral and friendly ship, which is no more than a mere detention, without any design to injure the subjects of neutral and friendly powers. (205) See the definition of capture given by d'Habreu, in his work, Tratado sobre las Presas, cap. 1, 3, p. 2, &c. which Valin, in his TraitS des Prises, chap. 1, 9, considers inaccurate, though his own definition is not more exact. ART. I. Of Captures. Captures are just or unjust . 3. A capture may be just or unjust. It is unjust, when made by a pirate, a friend, or a neutral, contrary to the principles of the primitive or conventional law of nations. It is just, when it is made by an open enemy, and according to the laws of war. It is not the declaration of war alone, or the law between belligerent nations, that constitutes the justice of a capture.: the capture of a neutral and friendly vessel is also lawful, when laden with goods destined for a port besieged, or blockaded, or the access to which is publicly interdicted even to neutrals, in case of a prohibited and contraband trade, for the prohibition previously understood, gives the right to sieze and confiscate...

Book excerpt: Excerpt from The Maritime Law of Europe, Vol. 1 of 2 Remote from the great theatre of political and military ambition, the United States are happily exempt from that direct pressure which might compel them to take part in the wars of Europe and they are impelled by interest and policy, to observe a perfect neutrality be tween the belligerent nations of that continent. To maintain this fortunate and advantageous position, for a long period of time, will be at tended with no little difficulty, and may re quire consummate prudence and' address. The surest gurde, in this embarrassingr situation, is a clear and accurate acquaintance with the principles by which the intercourse between belligerents and neutrals is to be regulated. Whatever relates, therefore, to the maritime law of Europe, or which can throw light on the obscure and dubious path of neutral con duct, cannot fail of being interesting to the people of America. Available in PDF, EPUB and Kindle. Book excerpt: Waterborne transport is of crucial importance within the European Union. Almost 90% of the EU external freight trade and 40% of the intra EU-exchanges are carried by sea. With respect to its significant coastline, the environmental aspects of shipping transport services have to be considered carefully within the EU. Each year, the European ports have to cope with more than 400 million passengers. Thus, the shipping sector is also an important employer. This commentary on EU shipping law provides a comprehensive article-by-article analysis of the relevant regulations and directives of the shipping sector. It systematically covers the main issues, which include access, regulatory, environment, health/safety, consumer protection, carriage of goods/passengers, means of transport, competition, state aid, infrastructure, labor, and litigation. Available in PDF, EPUB and Kindle. Book excerpt: This book offers a comprehensive international law analysis of the European Uniona (TM)s maritime safety legislation. This is a relatively novel field of activity of the EU, but its development has been very rapid. Since 1993, over 40 acts of EU law have been adopted, dealing with a variety of subjects, such as port State control, classification societies, vessel traffic management, ship construction, environmental protection and pollution sanctions. This legislation is analysed from the point of international law, notably the law of the sea and the international maritime conventions. Regional legislation in a field that is traditionally regulated primarily by means of international conventions is bound to create tensions with the related international conventions and with well-established principles of international law. This study assesses how the EU has acted as a flag State, port State and coastal State and measures the trends in this development against the international legal framework. More detailed legal analyses are offered for specific aspects of EU legislation that are considered to be particularly interesting from an international law point of view. The relationship between EU law and international law within the internal EU legal system is also analysed from the specific perspective of maritime safety law.

Book excerpt: This is a comparative analysis of maritime law and its administration in five northern European towns. It has often been assumed that there was a common maritime law in northern Europe, shared between skippers and merchants who conducted their business along the North Sea and Baltic littoral. This study examines this assumption by studying the dissemination of law compilations across this region, and by comparing the contents of these and the judgments passed by urban courts in cases of shipwreck, jettison and ship collision. Medieval maritime law has never before been the subject of a major study in the English language. The practice of maritime law has, up until now, largely been ignored. This book is the first to offer a comparison of maritime laws and court proceedings. It is also unique in that it provides a truly comparative history, covering a large geographical area stretching from Aberdeen on the North Sea coast to Reval (present-day Tallinn) in the innermost regions of the Baltic.
