Book excerpt: This excellent book is a translation of a very small portion of Dr. Gierke’s “ Deutsches Genossenschaftsrecht, " being the section entitled “ Die Publizistischen Lehren des Mittelalters. ” Its ten chapters treat of the following questions : The evolution of political theory under the diverse influences of ancient philosophy and law, medieval theology, local custom; Macrocosm and microcosm, i.e., the relation of the whole of society to its parts and vice versa from the medieval viewpoint; unity in Church and State, wherein are discussed the warring positions of parties in both, evolved by the length of the contest between the papacy and the empire; the idea of organization, i.e., of society as an organism; the idea of monarchy, its derivation from God, its consequent relations with the plenitudo potestatis of the papacy; the idea of popular sovereignty, its conflicts and combinations with the ruler's sovereignty, first in the temporal sphere, second, analogous developments of the idea as applied to the government of the Church, somewhat painfully brought out by the conciliar movement; the idea of representation; the idea of personality, i.e., of justice or legal personality applied to the Church and State or to minor corporations; the relation of the state to the law, natural and positive; the beginnings of the modern state, i.e., those elements in medieval doctrine that led up to the modern idea of the state. One half of the book is devoted to notes that elucidate the text of the cited authorities, a long list of which, both ancient and modern, is given. The mere enumeration of the titles of the chapters and the fact that the translation has been undertaken by so eminent a legal historian as Mr. Maitland are a warrant that the work is important, even for those who are not disposed to accept Dr. Gierke's views on faith. English - speaking readers in general must find it interesting, accustomed as they are to look on medieval thought as mere idle speculation of the logicians; as if political theories did not then, as now, agitate men's minds and lay the foundations for much of those political blessings that we now enjoy, or think we do. To a close observer of the development of government in the Catholic Church some portions will be, not merely interesting, but absorbing. They may even be instructive, though at the sacrifice of some preconceptions.

When studying any period, we are always looking for the promise of what the next is to bring. So, in medieval history, we have been searching so diligently for the origins of modern culture, that at times it would seem as though what we call the Middle Ages had been little more than the prelude to the Renaissance. But in history, as in nature, birth and death are equally balanced. The decay of overripe forms of civilisation is as suggestive a spectacle as the growth of new ones. And it occasionally happens that a period in which one had, hitherto, been mainly looking for the coming to birth of new things, suddenly reveals itself as an epoch of fading and decay. The present work deals with the history of the fourteenth and fifteenth centuries regarded as a period of termination, as the close of the Middle Ages. Such a view of them presented itself to the author of this volume, whilst endeavouring to arrive at a genuine understanding of the art of the brothers van Eyck and their contemporaries, that is to say, to grasp its meaning by seeing it in connexion with the entire life of their times. Now the common feature of the various manifestations of civilisation of that epoch proved to be inherent rather in that which links them to the past than in the germs which they contain of the future. The significance, not of the artists alone, but also of theologians, poets, chroniclers, princes, and statesmen, could be best appreciated by considering them, not as the harbingers of a coming culture, but as perfecting and concluding the old.

He does not pretend to have written anything new, but to have attempted to put what he has to say in as readable a form as possible. Everything in the way of the history and habits of fish has been studiously avoided, and technicalities have been used as sparingly as possible. The writing of this book has afforded him pleasure in his leisure moments, and that pleasure would be much increased if he knew that the perusal of it would create any bond of sympathy between himself and the angling community in general. This section is interleaved with blank shects for the readers notes. The Author need hardly say that any suggestions addressed to the case of the publishers, will meet with consideration in a future edition. We do not pretend to write or enlarge upon a new subject. Much has been said and written-and well said and written too on the art of fishing but loch-fishing has been rather looked upon as a second-rate performance, and to dispel this idea is one of the objects for which this present treatise has been written. Far be it from us to say anything against fishing, lawfully practised in any form but many pent up in our large towns will bear us out when me say that, on the whole, a days loch-fishing is the most convenient. One great matter is, that the loch-fisher is depend- ent on nothing but enough wind to curl the water, -and on a large loch it is very seldom that a dead calm prevails all day, -and can make his arrangements for a day, weeks beforehand whereas the stream- fisher is dependent for a good take on the state of the water and however pleasant and easy it may be for one living near the banks of a good trout stream or river, it is quite another matter to arrange for a days river-fishing, if one is looking forward to a holiday at a date some weeks ahead. Providence may favour the expectant angler with a good day, and the water in order but experience has taught most of us that the good days are in the minority, and that, as is the case with our rapid running streams, -such as many of our northern streams are, -the water is either too large or too small, unless, as previously remarked, you live near at hand, and can catch it at its best. A common belief in regard to loch-fishing is, that the tyro and the experienced angler have nearly the same chance in fishing, -the one from the stern and the other from the bow of the same boat. Of all the absurd beliefs as to loch-fishing, this is one of the most absurd. Try it. Give the tyro either end of the boat he likes give him a cast of ally flies he may fancy, or even a cast similar to those which a crack may be using and if he catches one for every three the other has, he may consider himself very lucky. Of course there are lochs where the fish are not abundant, and a beginner may come across as many as an older fisher but we speak of lochs where there are fish to be caught, and where each has a fair chance. Again, it is said that the boatman has as much to do with catching trout in a loch as the angler. Well, we dont deny that. In an untried loch it is necessary to have the guidance of a good boatman but the same argument holds good as to stream-fishing...

Book excerpt: Ever since A.D. 962 the German monarchy had been combined The Empire and the German monarchy.with the Roman Empire, and the union proved harmful to both offices. The universal authority of the Emperor could hardly fail to become shadowy and unreal, but it was rendered more distasteful to non-German princes and peoples by the immediate association of the Empire with a distinct kingdom, with which they might have causes of quarrel. And as the Empire became more and more localised, so the German kingship became steadily weaker. The shadowy character of the higher dignity tended to produce the same impression as to the more real and practical office. The princes who held their lands of the German king aimed more and more at the independence of the external kings and rulers, who, in feudal theory, held of the Emperor. The imperial claims brought the Empire into collision with the Papacy, and the German monarchy suffered from the blows which the Emperor's power received in the great Contest of Investitures. Moreover, the Empire carried with it the crown of Italy; and the constant waste of money and men in the vain attempt to establish a real dominion in the southern peninsula, not only weakened individual German rulers, but also led to constant absences from Germany which gave occasion to their northern vassals to acquire independence. Above all the Empire was, by tradition and by the very conception of the office, elective. Thus the German kings were deprived of all the advantages which normal hereditary succession gave to the rulers of England and France. Not only did disputed elections give rise to civil war with all its evils, but the constant change from one family to another rendered impossible any consistent policy of strengthening the central power. When at last the Hapsburgs obtained quasi-hereditary possession of the imperial dignity, disunion had made such progress that it was too late to apply a remedy.

Both the Book of the Watchers and the Astronomical Book were long known from their Ethiopic versions, which are preserved as part of Mashafa Henok Nabiy ('Book of Enoch the Prophet')--an Enochic compendium known in the West as 1 Enoch. Since the discovery of Aramaic fragments among the Dead Sea Scrolls, these books have attracted renewed attention as important sources for ancient Judaism. Among the results has been the recognition of the surprisingly long and varied tradition surrounding Enoch. Within 1 Enoch alone, for instance, we find evidence for intensive literary creativity. This volume provides a comprehensive set of core references for easy and accessible consultation. It shows that the rich afterlives of Enochic texts and traditions can be studied more thoroughly by scholars of Second Temple Judaism and early Christianity as well as by scholars of late antique and medieval religions. Specialists in the Second Temple period-the era in which Enochic literature first appears-will be able to trace (or discount) the survival of Enochic motifs and mythemes within Jewish literary circles from late antiquity into the Middle Ages, thereby shedding light on the trajectories of Jewish apocalypticism and its possible intersections with Jewish mysticism. Students of Near Eastern esotericism and Hellenistic philosophies will have further data for exploring the origins of 'gnosticism' and its possible impact upon sectarian currents in Judaism, Christianity, and Islam. In the process, we hope to provide historians of religion with a new tool for assessing the intertextual relationships between different religious corpora and for understanding the intertwined histories of the major religious communities of the ancient and medieval Near East.
