Available in PDF, EPUB and Kindle. Book excerpt: Much has been written about the USA Patriot Act, and the controversy that surrounds this far-reaching legislation has also generated a great deal of confusion and uncertainty about its impact and importance in the war on terrorism. As Professor Kam C. Wong notes in this important contribution to the literature: "There is little scholarly research on the legislation, implementation and impact of the Act". Undoubtedly, few Americans are actually aware of most of the details in the Act, or its implications in a free society. The events of September 11, 2001 in attacks on the World Trade Centre and the Pentagon prompted a unique response by Congress in passing a series of wide reaching laws, expanding the powers of law enforcement and the judiciary. Of particular concern to many are the requirements of public and private organisations to provide information in connection with homeland security that is considered intrusive and in violation of privacy rights. Ultimately, it will be many years before the actual impact of the Patriot Act can be assessed. In this new and important book, Professor Wong provides a critical analysis of the legislation and its capacity for abuse.

Book excerpt: The USA Patriot Act One is of the most controversial and possibly one of the most misunderstood laws Congress has ever enacted. For many Americans, it is synonymous with an egregious and unjustifiable suspension of the Bill of Rights. Others, troubled but more cautious, identify the Patriot Act with the grant of unprecedented powers that put civil liberties at some risk. Many who reject these concerns nonetheless accept their underlying assumption —that the Patriot Act does indeed give the federal government a package of powerful new search and surveillance tools. In Rethinking the Patriot Act, Stephen J. Schulhofer explains the act's most important provisions and reviews the best information currently available to gauge their usefulness and their effects in practice. Contrary to conventional wisdom, Schulhofer argues that much of the Patriot Act was essential, and some of it, if not essential, was reasonably defensible. In fact, the act includes provisions —seldom noticed —that add new protections for certain civil liberties, extend new benefits to certain immigrant groups, and provide new remedies for violations of individual rights. Nonetheless, Schulhofer concludes, many of the act's new powers are far too broad, and even where the case for broad powers is strong, they were typically conferred with little effort to assure transparency and accountability.

Available in PDF, EPUB and Kindle. Book excerpt: The USA Patriot Act: A Reference Handbook is an in-depth examination of the difficult wartime task of balancing civil liberties against national security. Within weeks of the September 11 terrorist attacks, overwhelming majorities in both houses of Congress passed the USA Patriot Act. The act immediately aroused bitter controversy. Some claim it impermissibly infringes on constitutional rights; others argue it is a necessary tool to ensure the security of the American homeland. Distinguished scholar and prolific author Howard Ball provides the background necessary for a reasoned, historical examination of both positions. He details the threats to America in the last 60 years, emphasizing terrorist acts; examines the temporary surrender of civil rights during past American wars; and uses that history to analyze the USA Patriot Act, both as it exists and as arguments rage over whether to strengthen or weaken the law.

Book excerpt: The issue of post-9/11 government surveillance has pervaded the news media for several years, and the debate spawned by this controversy has left several important questions unanswered: what are the Constitutional and statutory underpinnings of U.S. surveillance law? How exactly has the Patriot Act change that statutory law? How exactly does the government's use of the Patriot Act run counter to Constitutional rights? Has the Bush Administration roamed beyond even the wide parameters provided by that Act? Can the FBI be reined-in at this point? In The Patriot Act: The Decline of Legitimacy in the Age of Terrorism, Professor Tim Casey speaks from his dual experience as a criminal lawyer and professor of law to address these vital questions. By explaining both the history of surveillance law and the ways in which the three branches of government are currently implementing that law, Casey elucidates a subject far too complex to be adequately summarized in a newspaper or magazine article. By writing about this challenging issue with an accessibility unusual in legal scholarship, Casey has produced a book equally useful to educated citizens wishing to know their rights and to criminal lawyers seeking to navigate a quickly changing and somewhat obscure realm of regulations, statutes, and case law. In anticipation of a new Executive Branch administration in Washington, Casey offers an eloquent argument for why the current practices of the DOJ and FBI should be reformed and replaced with constitutionally sound policy. To be successful, such change will require a concerted effort between Congressional committees, law enforcement agencies, courts, and politically active citizens. In this brief but comprehensive new book, Tim Casey provides the legal template for realizing that change.
