The marechal de Villars engaged him, on the 24th of July, in the memorable battle of Denain, the success of which had so much influence on the progress of the negociations. On the 3rd of July, the king of Spain had read to his council a solemn declaration announcing his resolution to facilitate the conclusion of the proposed peace, by the renunciation which was required of him. He would do it, he said, in order that the Spanish monarchy might be assured to his descendants. On the 8th of July he signed a decree, of which the preamble is thus conceived: --"The assurance that the crowns of Spain and France should never be placed on one and the same head has been one of the principal and most powerful motives of the war xchich has afflicted Europe to the present day: it has been also as the preliminary in the views which have been entertained for peace, and especially in the propositions which have been recently made in England. It is upon that that the foundation of this work has been placed, and it has been judged requisite to establish the certainty that at no time, nor by any incident and event that may be, shall the two monarchies be united in one and the same person; and it is upon this point and upon others that the congress now holding at Utrecht has been agreed to, to treat of the other articles of peace, and regulate them; during which negociations the unforeseen deaths of the Dauphins having happened, England took the opportunity of carrying her views so far as the prevention and annulment of the effects of any other accident that might again happen "That crown has, therefore, proposed that I should renounce, in my name and in...

Book excerpt: Excerpt from On the Rise and Growth of the Law of Nations: As Established by General Usage and by Treaties, From the Earliest Time to the Treaty of Utrecht I have attempted in the following pages to trace the progress of the Law of Nations from ancient down to modern times. As my object has been to describe generally the actual practice and usages of nations in their transactions with each other at different periods of history, I have not deemed it necessary to refer to the works of the many eminent writers who, in the course of the last three centuries, have sought to illustrate this extensive branch of jurisprudence and to lay down certain rules for the guidance of independent States as well in peace as in war. To enter upon this wide field would be entirely beyond the scope of this work. My present object is simply to deal, not with opinions but with results; and in these I venture to think there is much to interest the general reader as well as the professional student.
