Book excerpt: Excerpt from The Trader's Guide to the Law Affecting the Sale of Goods The law relating to the Sale of Goods has been codified by the Sale of Goods Act, 1893, and according to its learned draughtsman (mr. M. D. Chalmers), the object of this statute is to lay down rules when the parties have either formed no intention, or failed to express it. Moreover, the Act seeks to set out in one consistent whole the entire mass of law relating to its subject matter; that is to say, it endeavours to combine common law (judicial decisions) and statute law. But though the law has been codified by this enactment, yet the common law, as laid down by the judges, loses none of its force. The primary object which the draughtsman had in view in framing the Sale of Goods Act, 1893, was to substantially reproduce, in statutory shape. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Sale of Goods Act, 1893: With Notes The Sale of Goods Act, 1893, is a. Further advance in the same direction. Its object as stated in the memorandum accompanying the original draft of the bill was to reproduce as exactly as possible the statutory and common law rules relating to the sale of goods. With the exception of the Statute of Frauds, the legislative enactments relating to the sale of goods are not of much general importance, in most cases dealing only with a few isolated points. Accordingly in such cases only as they deal solely with the law of sale, have they been reproduced in the present Act, such other provisions as deal only incidentally with the law of sale or affect only certain specified classes of goods being covered by saving clauses. Following the same principle, the Act does not attempt to reproduce the effect Of cases which, though arising out of sales, merely deal with the principles common to the whole law of simple contract, as for example the law relating to exchanges of goods. As originally drafted, the Act did not profess to touch the Scotch law of sale, but in the course of its passage through the House of Commons it was found possible by means of saving clauses to make it a complete code of the law relating to the sale of goods in all parts of the United Kingdom, while allowing the Scotch law to retain all its distinctive peculiarities intact. Book excerpt: Excerpt from Handbook of the Law of Sale of Goods The Sale of Goods Act, 1893, by which the law relating to the sale of goods was codified in the United Kingdom, has now been adopted, with slight modifications, in all the provinces of Canada except Quebec, the process of adoption having been completed by the enactment in Ontario of the Sale of Goods Act, 1920. Prior to the adoption of the stat ute there existed, especially in Ontario, a considerable body of case law. This case law is of course now authoritative only so far as it is consistent with the statute; but for the most part they are' in accord with each other, and the de cisions furnish useful illustrations of the statute. The arrangement of the statute is followed in the main, but in some respects the scheme of the book has necessitated some change in the order of the statutory provisions. The design of the book is to make the statute more readily avail able and more useful in Canada, and references are given to a relatively large number of recent English and Canadian cases. The alphabetical index is supplemented by an unus ually full table of contents, and the comparative table of section numbers will, it is hoped, enable a reader readily to compare the statute in force in one province with that in force in any other province or in the United Kingdom. Book excerpt: Excerpt from The General Principles of the American Law of the Sale of Goods, in the Form of Rules With Comments and Illustrations: Containing Also the English "Sale of Goods Act" The form of this work is similar to the one published by me in 1889 entitled Principles of Contract. That work was an attempt to state methodically, in concise language, the fundamental principles of contract. The statements are in the form of rules (in the nature of a code), followed by such comments and illustrations as seemed suitable to bring out clearly the import of each proposition; and each proposition is supported by the authority of adjudged cases, selected with a View to force of reasoning and pertinency of illustration. Book excerpt: Excerpt from The Sale of Goods Act, 1893: Including the Factors Acts, 1889 and 1890 As regards this edition, I have not attempted to expound or criticise the mass of cases which illustrate or are modified by the Act. Such a work could hardly be undertaken with any prospect of success until the Act has been for some time in operation. I have only sought to indicate the sources of the various provisions in the Act, and to elucidate the general principles of the law of sale by citations from eminent judges. Our common law is rich in the exposition of principles, and these expositions lose none of their value now that the law is codified. A rule can never be appreciated apart from the reasons on which it is founded. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from The Elements of the Law of Sale of Personal Property The following presentation of the elements of the law of sales of personal property has been prepared by the author in connection with instruction upon the subject as given to law school students. It is an attempt to present in a compact yet elementary way all the leading topics of this most important subdivision of the law of contracts, and the need of the student has been the controlling thought. While no pretensions to an extensive treatise are made, nevertheless, all the essential questions connected with the subject have been referred to, and all that one requires for a general knowledge of the elements of the subject has, it is believed, been called to his attention herein. The author has not hesitated to express his own opinions in the discussion of various theories connected with this branch of the law. It is hoped, however, that the endeavor to maintain a clearness in statement has been reasonably successful. The topic of "Remedies" has been treated somewhat more fully than in other works of this character, and a synopsis of the more important principles relating to damages, in connection therewith, has been introduced, which will prove, it is also hoped, a welcome aid. In the Appendix there is given, among other things, the text of the recent (1893) English Sale of Goods Act, which is, in itself, a most valuable outline of the law of sales, since the act is, substantially, a codification of the principles of the common law upon the subject. The American statutes which are reprinted, when considered in connection with the sketch of their history and of their strict construction by the courts, undisturbed by the legis lature as that construction has remained, show that the mercantile community has not been as sensitive in this country as in Great Britain, to the pinch of the common-law rules on this subject.
