Book excerpt: Once seen as aspirational and relatively innocuous, 'sustainability' or 'sustainable development' provisions are now changing the face of international trade agreements. The Sustainability Revolution in International Trade Agreements gathers fundamental, first-hand analyses of these novel commitments across dozens of agreements, considering their legal, political, and economic aspects. Drawing on perspectives from different parts of the world and engaging experts in the law and practice of sustainability provisions, this volume offers a comprehensive assessment of the latest developments and innovations in international trade agreements. It also evaluates the development challenges that sustainability requirements pose for countries with limited resources and capacity, for whom lower labour and environmental regulatory costs have been a competitive asset. The present volume explores the intersectional aspects of sustainability - such as gender equality, biodiversity, animal welfare, and Indigenous rights - in addition to the more traditional dimensions of sustainability, namely economic development, environmental conservation, and improvement of labour standards. There is little doubt that a sustainability revolution in global production patterns is needed. Considering the details of its operation - how it can come into being, who will bear the increased production costs, and how decisions on difficult trade-offs will be made - reveals the immense challenges involved in developing a new international law for sustainable trade. Read together, the chapters in this volume outline the contours this emerging legal framework, examine its practical operation, and offer important reflections upon the real extent and the foreseeable consequences of this sustainability revolution in international trade agreements.

Available in PDF, EPUB and Kindle. Book excerpt: This paper summarizes the Voluntary Sustainability Standards' (VSS) Academic Advisory Council Roundtables. The roundtables aimed to foster the debate on the possibilities and limitations of sustainability standards as tools to environmental, social and economic sustainability. They were jointly organized by the United Nations Forum on Sustainability Standards (UNFSS) and EVIDENSIA, in collaboration with the KU Leuven Center for Global Governance. This paper summarizes the discussions and outcomes of the three roundtable discussions. It brings different perspectives on VSS together which can inform and contribute to a comprehensive understanding of VSS effectiveness through GVCs. Through this paper, the "effectiveness" of VSS is defined along multiple dimensions, all of which are covered and assessed. A first dimension, goal-attainment effectiveness, focuses on the impact of VSS on a range of social, economic and environmental indicators. A second dimension, process effectiveness, analyses the degree to which VSS are adopted by economic operators and the drivers for adoption. A third dimension, constitutive effectiveness, focuses on the degree to which VSS change the overall approach of actors involved in the policy process towards sustainability, i.e., the degree to which their theories of change are used more widely. VSS role on international trade is also debated and discussed.

Book excerpt: Emerging to the forefront of sustainable production and consumption are a promising and rapidly evolving concept known as Voluntary Standard Systems (VSS). They encompass the three pillars of sustainability – social, environmental and economic aspects and consequently they can be considered as a tool, which makes sustainable development visible. Currently, they are becoming a significant element in international trade and in the promotion of sustainable development strategies, especially in the context of globalised markets and supply chains. This volume provides a comprehensive overview of the current VSS concepts: from their nature and functioning, to the future outlook for their development. It places VSS in the broader context of global development issues and challenges, including development policy and international sustainability commitments, progress towards achieving ‘green economy’ and meeting climate protection targets. The volume contains also a representative selection of case studies which demonstrate their wide range of application in different sectors of the economy.

Book excerpt: Presenting extensive new research, this ground-breaking study addresses the critical dimensions of participatory and democratic processes in the field of trade-sustainability relationships and sustainability assessments of trade rules. The specific issues in trade include social and environmental concerns for which there is a wide disparity of preferences and no economic benchmark. The contributors provide analytical responses to questions of how deliberative processes can adequately close the democratic gap in global governance and how institutional reforms can ensure better access to information, transparency, deliberation and more accountability. The book provides the necessary theoretical background as well as case studies to understand these issues and is suitable for students and academics in international law, international relations and economics.

Book excerpt: Voluntary Sustainability Standards (VSS) have the potential to generate distinct economic and social development opportunities and can help to mitigate economic, food, water, and environmental risks in developing countries. However, the research about the impacts of VSS focuses on a few standards, products and countries, usually in response to project evaluation needs. The most common methodology used is case studies, often conducted by the VSS themselves. While they provide rich qualitative information about the complexity of the impacts of VSS, they do not provide much empirical evidence based on comparative analyses and generally do not allow for the identification of correlation between the variables. There is also a focus on the production side of the value chain. Overall, a systematic evaluation of value chain impacts across VSS and products providing quantitative, statistically valid data is lacking. However, the research does provide some qualitatively rich findings, which are summarized in this paper according to four areas: 1. The impacts of VSS on global supply chains;2. The impacts of VSS on producers and exporters;3. The interplay of regulation and VSS;4. When do VSS work? These areas have been selected according to their relevance to policymakers in developing countries and their prevalence in research. The following provides a short outline of the research findings related to each of these areas.

Book excerpt: It is becoming increasingly clear that firms can contribute to their own wealth and to overall societal wealth by considering the effect they have on the world at large when making decisions and take operational actions to execute their strategies. All of this has led to growing interest in "corporate social responsibility," or "CSR," which has been described as the way that firms integrate social, environmental, and economic concerns into their values, culture, decision making, strategy, and operations in a transparent and accountable manner and thereby establish better practices within the firm, create wealth, and improve society. The commitments and activities associated with any CSR initiative should begin with compliance with laws and regulations promulgated by the governmental entities have jurisdiction over the firm's activities; however, CSR extends well "beyond the law" to include important subjects as to which the law has not been able to keep. As a result, voluntary corporate responsibility standards developed from a variety of sources have emerged to fill the gap. This book serves as an introduction to sustainability standards and instruments and includes chapters on initiatives of governmental and intergovernmental bodies, sectoral CSR commitments, CSR-related reporting and management standards, and securities exchanges and regulators.

Book excerpt: The current international economic scenario is characterized by the presence of an increasing number of multinational enterprises, the formation of global value chains and the creation of transnational regulatory networks. The aim of this book is to analyze to which extent private standards of sustainability imposed by supermarkets protect common values as the human life or health instead of constituting disguised restrictions to trade. The analysis and the case studies disclosed that the essence of the aforementioned standards can be determined through the limited scope of WTO treaties that regulate non-tariff barriers to trade and the search of coherence between supermarkets? sustainability policies and OECD rules.

Even though VSS are not mandatory (required by law), in practice they often are necessary for producers to participate in global value chains. This paper uses a new international database to shed light on specific institutional dimensions of VSS systems that directly impact on the costs of compliance borne by producers and identifies a number VSS-specific features that are associated with the "producer-friendliness" of different VSS systems. These include membership in meta-standard organizations and stakeholder engagement in VSS decision-making.
