Download or read book Paths to Justice written by Hazel Genn and published by Hart Publishing. This book was released on 1999-11 with total page 399 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Effective policy-making in the administration of justice requires a solid understanding of public behaviour. This book presents the results of the most wide-ranging survey ever conducted by an independent body or government agency into the experiences of ordinary citizens as they grapple with the kinds of problems that could ultimately end in the civil courts. Funded by the Nuffield Foundation, the survey identifies how often people experience problems for which there might be a legal solution and how they set about solving them. Revealing crucial differences in the approach taken to different kinds of potential legal problems, the study describes the factors that influence decisions about whether and where to seek advice about problems, and whether and when to go to law. In addition to exploring experiences of courts, tribunals and ADR processes, the study also provides important insights into public confidence in the courts and the judiciary. For the first time the study reveals the public's perspective on access to civil justice and makes a significant contribution to debate about how far civil justice reforms coincide with public experience and expectations about resolving justiciable problems."--Back cover.

Available in PDF, EPUB and Kindle. Book excerpt: The British philosopher Stephan Toulmin, in his The Uses of Argument, made the provocative claim that "logic is generalized jurisprudence". For Toulmin, logic is the study of nonns for practical argumentation and decision making. In his view, mathematical logicians were preoccupied with fonnalizing the concepts of logical necessity, consequence and contradiction, at the expense of other equally important issues, such as how to allocate the burden of proof and make rational decisions given limited resources. He also considered it a mistake to look primarily to psychology, linguistics or the cognitive sciences for answers to these fundamentally nonnative questions. Toulmin's concerns about logic, writing in the 1950's, are equally applicable to the field of Artificial Intelligence today. The mainstream of Artificial Intelligence has focused on the analytical and empirical aspects of intelligence, without giving adequate attention to the nonnative, regulative functions of knowledge representation, problem solving and decision-making. Nonnative issues should now be of even greater interest, with the shift in perspective of AI from individual to collective intelligence, in areas such as multi-agent systems, cooperative design, distributed artificial intelligence, and computer-supported cooperative work. Networked "virtual societies" of humans and software agents would also require "virtual legal systems" to fairly balance interests, resolve conflicts, and promote security.

Book excerpt: Excerpt from An Analysis of the Principles of Equity Pleading: Containing a Compendium of the High Court of Chancery, and the Foundation of Its Rules, Together With an Illustration of the Analogy Between Pleadings at Common Law and in Equity; With American Supplement, Containing Equity Rules and Forms I'r has long been a subject of reproach that the study of the law has degenerated from a liberal and scientific pursuit into a mere mechanical process of acquiring forms by dint of manual labor at the desk. How far this general censure on the profession may be just, we will not new step to inquire; but thus much we may be permitted to observe, that they who would confine the education of a lawyer to mere books, without afi'ording the student the advantages to be derived from the practice of an ofiice; and those who, on the other hand, recommend to have the pupil immersed in all the details of business, without a previous competent knowledge of the theory, would equally pursue a system erroneous and unprofitable.
