Particularly after the Treaty of Lisbon’s entry into force, research on multilevel governance can no longer remain confined to the analysis of political dynamics or of soft law arrangements. Multilevel governance emerges as a constitutional principle in the European constitutional space, envisaging a method of governance based on the strong involvement of sub-national authorities in the creation and implementation of EU law and policy. Its foundation is in the mosaic resulting from the constitutional systems of the Union and its Member States. Multilevel governance arrangements play a fundamental part in achieving key Treaty objectives (such as subsidiarity, respect for the national identities of the Member States including regional and local self-government, openness, and closeness to the citizen). These arrangements lend legitimacy to EU decision-making, while also promoting constitutionalism and democracy in the EU.

Book excerpt: This book explores the role and status of local and regional authorities (also referred to as 'subnational authorities' or 'SNAs') in European Union law, and reveals the existence of two parallel yet opposed constitutional imaginations of the supranational legal order. Through a survey of various areas of EU law, including primary and secondary legislation, case law as well as various soft law instruments, Finck introduces two narratives. These are the 'outsider narrative' and the 'insider narrative' that frame these constitutional imaginations. According to the outsider narrative, the structure of the legal order is bi-centric, composed of the member states and the EU only. This narrative envisages SNAs as outsiders of EU law, whose interactions with Union law are merely of an indirect nature. However, in addition to this well-known account of EU law, a parallel yet distinct narrative can be identified according to which SNAs are insiders that entertain direct relations with the European Union and contribute to the substantive development of EU law. It is illustrated that the coexistence of both narratives has wider implications as it points towards a shift in the structure of the European legal order itself, which is transitioning from bi-centricity to polycentricity.

Book excerpt: This book is the result of a research project carried out for the Committee of the Regions and analyses the 'state of play' of democratic practice at the subnational level in all of the European Member states. Its initial hypothesis was that liberal democracy is closely associated with the rise of the nation state in the 19th century. The nation state, however, has been significantly changing under the impact of various forces including globalization and regionalization, internal reforms of the public administration system such as privatization and deregulation, and the emergence of regions and local authorities as actors in their own rights. these changes pose challenges for the practice of democracy and, in particular, for its expression at the regional and local level. The book deals with the theoretical implications of these changes in terms of the changing nature of the state and new regionalism. However, one of the key findings is that there is no one uniform meaning of democracy across member states and there are variations even within a single state depending on whether the national or subnational levels are considered. Each country chapter gives the historical and philosophical background to the concept of democracy in each country. There is also an exposition of the institutional expression of democracy at the different levels. With regard to the practice of democracy at the subnational level, the role of pressure groups and policy networks is examined as well as the role of political parties. There is a survey of critiques of subnational democracy. Finally, there is a survey of innovative approaches to improving regional and local democracy through a variety of mechanisms and reforms as ways of responding to the challenge and opportunities facing it today

In every EU country, many citizens are unhappy with the perceived intrusion of 'Europe' in their way-of-life. Any idea of a genuine pan-European identity seems to be in retreat. This book provides an unprecedented insight into the multiple ways through which citizens of 16 countries connect their own national identity to European identity. The book's theoretical claim is that European identity, as well as national identity, should be empirically assessed taking into account its multi-dimensionality. The volume's contributors suggest that European identity was always unlikely to be a source of political integration and political legitimacy in the way national identities have been in the past and are today. Europeans' primary identity is national rather than supranational. Mutual trust between European peoples exists, but is somewhat fragile. Yet, European identity is intertwined with national identities in manifold ways. The 'imagined communities' at the national and European level show strong similarities - criteria for being a European are strongly associated with the criteria used to define who national belonging. These complex links also manifest themselves in citizen's feelings of interdependence between the nations in the European Union - which, the volume suggests, support the EU in the face of severe crises. The IntUne series is edited by Maurizio Cotta (University of Siena) and Pierangelo Isernia (University of Siena). The INTUNE Project - Integrated and United: A Quest for Citizenship in an Ever Closer Europe - is one of the most recent and ambitious research attempts to empirically study how citizenship is changing in Europe. The book series is organized around the two main axes of the project, to report how the issues of identity, representation and standards of good governance are constructed and reconstructed at the elite and citizen levels, and how mass-elite interactions affect the ability of elites to shape identity, representation and the scope of governance. A first set of four books examines how identity, scope of governance and representation have been changing over time respectively at elites, media and public level. The next two books present cross-level analysis of European and national identity on the one hand and problems of national and European representation and scope of governance on the other, in doing so comparing data at both the mass and elite level. The EU is a community based on law which adheres to and promotes a set of common values between the Member States. The preservation of these values (such as legality, legal certainty, prohibition of arbitrariness, respect for fundamental rights) is pivotal to the success of European integration and the well-being of the individuals within it. Yet, the EU rule of law suffers from an imposter syndrome and has been the subject of criticism: ie that it is only part of the EU agenda in order to legitimise sweeping new powers and policies, and that it plays little or no role in promoting a culture of compliance for either deviant EU Institutions or for Member States. This book will examine whether the EU rule of law deserves those criticisms. It will offer an analytical guide to the EU rule of law by conceptualising it and locating it within the sources of EU law. It will then ask whether the EU is based on the rule of law - a question which is answered in the affirmative, but one which has to be considered in the context of compliance and the overall effectiveness of the EU enforcement acquis. It is argued that while the EU means well in its aim to preserve unity in an increasingly diversified Europe, the extent to which it can pave the way to a better world (based on a transnational rule of law concept akin to good governance and improvement of citizens' lives) is dependent on the commitment of all European integration stakeholders to the EU project.
