Yet despite its founders' ambitions, it did not become the regulator of the legal profession in Nova Scotia for nearly seventy-five years. In this institutional history of the Nova Scotia Barristers' Society from its inception to the Legal Profession Act of 2005, Barry Cahill provides a chronological exploration of the profession's regulation in Nova Scotia and the critical role of the society. Based on extensive research conducted on internal documents, legislative records, and legal and general-interest periodicals and newspapers, Professional Autonomy and the Public Interest demonstrates that the inauguration of the Nova Scotia Barristers' Society was the first giant step on the long road to self-regulation. Highlighting the inherent tensions between protection of professional self-interest and protection of the larger public interest, Cahill explains that while this radical innovation was opposed by both lawyers and judges, it was ultimately imposed by the Liberal government in 1899. In light of emerging models of regulation in the twenty-first century, Professional Autonomy and the Public Interest is a timely look back at the origins of professional regulatory bodies and the evolution of law affecting the legal profession in Atlantic Canada.

Book excerpt: This volume, the fifth of the Ontario Series of the Champlain Society, tells the history of the town of York (Toronto) from the arrival of John Graves Simcoe in 1793 through the war of 1812 until news of the peace reached the town in the spring of 1815. The selection of contemporary documents attempts to show why York was chosen for a settlement in the first place, the kind of community that developed, and the effect of the War on that community. Apart from the normal problems connected with the establishment of any settlement, the officials of the town of York were faced with the necessity of creating a worthy capital city for Upper Canada at a time when Kingston because of its pre-eminence as the military and naval centre of the province and its commercial prosperity overshadowed all other settlements. The book also illustrates the gradual integration into a corporate body of many diverse elements—senior government officials, discharged soldiers, tradesmen, labourers—so that by 1815 the characteristics of modern Toronto were beginning to be evident in York. Book excerpt: For the Encouragement of Learning addresses the contested history of copyright law in Canada, where the economic and reputational interests of authors and the commercial interests of publishers often conflict with the public interest in access to knowledge. It chronicles Canada’s earliest copyright law to explain how pre-Confederation policy-makers understood copyright’s normative purpose. Using government and private archives and copyright registration records, Myra Tawfik demonstrates that the nineteenth-century originators of copyright law intended to promote the advancement of learning in schools by encouraging the mass production of educational material. The book reveals that copyright laws were integral features of British North American education policy and highlights the important roles played by teachers, education reformers, and politicians in the emergence and development of the laws. It also explains how policy-makers began to consider the relationship between copyright and cultural identity formation once British interference into domestic copyright affairs increased, and as Canadian Confederation neared. Using methodologies at the intersection of legal history and book history, For the Encouragement of Learning embeds the copyright legal framework within the history of Canada’s book and print culture.
