Available in PDF, EPUB and Kindle. Book excerpt: To make employment and training or other community benefits key outcomes of a public expenditure programme, they need to be incorporated into the specification of what is being purchased or funded. The legislative and the policy frameworks for doing this are complex and there has been a lack of detailed guidance, especially in relation to UK policy and legislation, the European Treaty and EC Procurement Directives. In this report the understanding of procurement issues has been furthered by discussions with the Treasury and the Office of Government Commerce. It provides, for the first time, clear guidance on these matters. Specifically, it: - vbTab]details the relevant policy and legal frameworks;- vbTab]sets out procedures that can be used;- vbTab]suggests support that needs to be provided;- vbTab]gives examples of good practice.

Available in PDF, EPUB and Kindle. Book excerpt: This book discusses current theories and practices in the field of public procurement. Over the past few decades, public procurement has had to evolve conceptually and organizationally in the face of unrelenting budget constraints, government downsizing, public demand for increased transparency in public procurement, as well as greater concerns about efficiency, fairness and equity. Procurement professionals have also had to deal with a changeable climate produced by emerging technology, environmental concerns, and tension between complex regional trade agreements and national socioeconomic goals. This volume presents sixteen case studies focusing on the themes of public procurement as a policy tool and performance-based public procurement. The first section discusses public procurement as a policy tool and the challenges involved in balancing the competing interests of market forces, legal requirements, political pressures, and environmental concerns. The second section discusses performance-based public procurement, highlighting the frameworks used to assess procurement systems, the gaps between policy and practice, and strategies for bridging those gaps. The final section of the book discusses current issues in procurement, such as the Trans-Pacific Partnership, risk mitigation, and procurement as a profession. By combining theory and analysis with evidence from the real world, this book is of equal use to academics, policy makers, and procurement professionals.

Available in PDF, EPUB and Kindle. Book excerpt: In recent years, the search for innovative, locally relevant and engaging public service has become the new philosophers’ stone. Social procurement represents one approach to maximising public spending and social value through the purchase of goods and services. It has gained increasing attention in recent years as a way that governments and corporations can amplify the benefits of their purchasing power, and as a mechanism by which markets for social enterprise and other third sector organisations can be grown. Despite growing policy and practitioner interest in social procurement, there has been relatively little conceptual or empirical thinking published on the issue. Taking a critically informed approach, this innovative text examines emerging approaches to social procurement within the context of New Public Governance (NPG), and examines the practices of social procurement across Europe, North America, and Australia. Considering both the possibilities and limitations of social procurement, and the types of value it can generate, it also provides empirically-driven insights into the practicalities of ‘triple bottom line’ procurement, the related challenges of measuring social value and the management of both the strategic and operational dimensions of procurement processes. As such it will be invaluable reading for all those interested in social services, public governance and social enterprise.

Available in PDF, EPUB and Kindle. Book excerpt: Appropriate laws and regulations are essential tools to direct the action of procurers toward the public good and avoid corruption and misallocation of resources. Common laws and regulations across regions, nations and continents potentially allow for the further opening of markets and ventures to newcomers and new ideas to satisfy public demand. Law and Economics of Public Procurement Reforms collects the original contributions related to the new European Union Directives approved in 2014 by the EU Parliament. They are of both economists and lawyers, and have been presented in a manner that allows for exchanges of views and "real time" interaction. This book features, for each section, an introductory exchange between two experts of different disciplines, made up of a series of sequential interactions between an economist and a lawyer, which enriches the liveliness of the debate and improve the mutual understanding between the two professions. Four sections characterize this book: Supporting social considerations via public procurement; Green public procurement; Innovation through innovative partnerships; and Lots - The Economic and Legal Challenges of Centralized Procurement. These themes have current relevance of the new European Public Procurement Directives. Written by an impressive array of experts in their respected fields, this volume is of great importance to practitioners who work in the field of EU public procurement in the Member States of the EU, as well as academics and students who study public finance, public policy and regulation.

Available in PDF, EPUB and Kindle. Book excerpt: Successive UK governments have pursued ambitious programmes of private sector competition in public services that they promise will deliver cheaper, higher quality services, but not at the expense of public sector workers. The public procurement rules (most significantly Directive 2004/18/EC) often provide the legal framework within which the Government must deliver on its promises. This book goes behind the operation of these rules and explores their interaction with the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE); regulations that were intended to offer workers protection when their employer is restructuring his business. The practical effectiveness of both sources of regulation is critiqued from a social protection perspective by reference to empirical findings from a case study of the competitive tendering exercise for management of HMP Birmingham that was held by the National Offender Management Service (NOMS) between 2009 and 2011. Overall, the book challenges the Government's portrayal of competition policies as self-evident sources of improvement for public services. It highlights the damage that can be caused by competitive processes to social capital and the organisational, cultural and employment strengths of public services. Its main conclusions are that prison privatisation processes are driven by procedure rather than aims and outcomes and that the complexity of the public procurement rules, coupled with inadequate commissioning expertise and organisational planning, can result in the production of contracts that lack aspiration and are insufficiently focused upon improvement or social sustainability. In sum, the book casts doubt upon the desirability and suitability of using competition as a policy mechanism to improve public services.

Book excerpt: This multidisciplinary, international Research Handbook on Inequalities and Work examines disparities within contemporary working life and comes at a critical juncture of socio-historical change. As the world reels from the impact of economic insecurity, the pandemic, the Black Lives Matter and #MeToo movements, the trans liberation fight, the climate crisis and the rise of Artificial Intelligence, systemic inequalities and their impacts have been thrust into the limelight alongside the ceaseless struggle for social justice. Against this background, the Handbook provides cutting edge research studies that offers unique insight into the international nature of inequalities at work.
