Available in PDF, EPUB and Kindle. Book excerpt: David Long traces the cause of the 1975 constitutional crisis to the influence of English legal positivism, a theory which isolates the meaning from the political scheme the text was framed to support. He shows the fundamental premise of a Constitution, framed in Convention, ratified by the people that cannot be altered without their consent, the consent of the governed. Legal positivism was adopted by the High Court in 1920 when it abolished the federal scheme and therewith the sovereign States. The responsible judge had opposed federalism at the 1897 Convention. Long examines two juristic opinions that excused the Governor-General’s 1975 unprecedented dismissal of a government with the confidence of the House of Representatives. He identifies their reliance on legal positivist constitutional interpretations that are expressly rejected by the Founders. Long provides a theoretical defence of the Founders original understanding as the object of constitutional construction.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines the royal prerogative in terms of its theory, history and application today. The work explores the development of the royal prerogative through the evolution of imperial government, and more recent structural changes in the United Kingdom and elsewhere in the Commonwealth. While examining specific prerogative powers, the development of justiciability of the prerogative, and the exercise of the prerogative, it lays bare the heart of constitutionality in the Westminster system of government. There is said to be a black hole of unaccountable authority at the heart of the constitution and it is this which this book examines. The focus is upon the constitutional development of the United Kingdom and the old dominions of Canada, Australia and New Zealand. This approach is comparative and historical, using specific case studies of such events as the dissolution of Parliament and the appointment and dismissal of Prime Ministers. The book will be of interest to academics and researchers working in the areas of Constitutional Law and Politics.

Book excerpt: In this unusual biography of one of Canada's most well-known public figures, author Frank Milligan traces the intellectual foundations on which Eugene Forsey's world-view was constructed. By studying Forsey's beliefs--both religious and political--Milligan unearths the philosophical underpinnings of many of Canada's early twentieth-century political, economic, religious, and social reform movements.

Available in PDF, EPUB and Kindle. Book excerpt: Stephen Harper's Conservative government has reversed the trend of its predecessors by giving the Crown a higher profile through royal tours, publications, and symbolic initiatives. Based on papers given at a Diamond Jubilee conference on the Crown held in Regina in 2012, Canada and the Crown assesses the historical and contemporary importance of constitutional monarchy in Canada. Established and emerging scholars consider the Canadian Crown from a variety of viewpoints, including the ways in which the monarch relates to Quebec, First Nations, the media, education, Parliament, the constitution, and the military. They also consider a republican option for Canada. Editors D. Michael Jackson and Philippe Lagassé provide context for the essays, summarize and expand on the issues discussed by the contributors, and offer a perspective on further study of the Crown in Canada. Contributors include Richard Berthelsen, Lieutenant-Colonel Alexander Bolt (Office of the Judge Advocate General), James W.J. Bowden, Stephanie Danyluk (Whitecap-Dakota First Nation), Linda Cardinal (University of Ottawa), Phillip Crawley (CEO, The Globe and Mail), John Fraser (Massey College), Carolyn Harris (University of Toronto), Robert E. Book excerpt: What is the future of the monarchy in Canada? A strong republican movement in Canada stresses that the monarchy is archaic and anti-democratic, an embarrassing vestige of our colonial past. An equally vibrant monarchist movement, however, defends its loyalty to royalty, asserting that the Queen is a living link to a political and constitutional tradition dating back over a thousand years. But is the monarchy worth keeping? Battle Royal answers this question and many more: What does the Queen really do? What are the powers of the governor general? Has the Crown strengthened or weakened Canadian democracy? If we abolish the monarchy, what do we replace it with? And will we have to re-open the constitution? Charles will soon become King of Canada, but a Canada highly ambivalent to his reign. This presents the representatives of the Crown with the opportunity to build a better monarchy in both Britain and Canada, one relevant to the twenty-first century.
