Focusing on factors other than competition, I find that the two may not collaborate either because the firm finds in-house development cheaper, or because of a disagreement about the potential product's profitability. In both cases, university patents can encourage collaboration by increasing the invention's diffusion time, and therefore play a role even in the absence of any competition. The model also suggests instances in which we can expect to see a greater impact of university patents on collaboration. Even when patents increase collaboration, they do not necessarily increase welfare. The findings are relevant for the debates on the Bayh-Dole Act, which gave universities a blanket right to patent and license inventions resulting from federally funded research.

Book excerpt: Thirty years ago federal policy underwent a major change through the Bayh-Dole Act of 1980, which fostered greater uniformity in the way research agencies treat inventions arising from the work they sponsor. Before the Act, if government agencies funded university research, the funding agency retained ownership of the knowledge and technologies that resulted. However, very little federally funded research was actually commercialized. As a result of the Act's passage, patenting and licensing activity from such research has accelerated. Although the system created by the Act has remained stable, it has generated debate about whether it might impede other forms of knowledge transfer. Concerns have also arisen that universities might prioritize commercialization at the expense of their traditional mission to pursue fundamental knowledge-for example, by steering research away from curiosity-driven topics toward applications that could yield financial returns. To address these concerns, the National Research Council convened a committee of experts from universities, industry, foundations, and similar organizations, as well as scholars of the subject, to review experience and evidence of the technology transfer system's effects and to recommend improvements. The present volume summarizes the committee's principal findings and recommendations.

Recent decades have seen a great expansion in the amount and importance of research in the life sciences and their applied counterparts, biotechnology and pharmaceuticals. Coinciding with this expansion is an expansion of the role of the Federal Government in producing and regulating these areas of research and technology. This expansion has seen both PTO and the Federal Courts develop regulations and standards within the patent system that are focused on the particularities of biotechnology and the development of patent-like awards outside of the patent system. This expansion has also seen the Federal Government become the largest funder of research in the life sciences at the same time as it relinquishes ownership of the resulting intellectual property. More recently, antitrust authorities have begun to impose demands that intellectual property rights in biotechnology be divested in certain mergers. Through all of these policies, the Federal Government has involved regulatory agencies beyond the traditional PTO to further the traditional goal of PTO, to encourage innovation in science, and in biotechnology in particular. Book excerpt: The Bayh-Dole Act of 1980 expressly gave colleges, universities, and other nonprofit entities the right, which had previously been presumptively held by the federal government itself, to patent inventions resulting from federally funded research and development (R & D) activities they conduct. In the nearly three decades since the Bayh-Dole Act changed the nation's patent laws, some academic institutions have been much more prolific than others at patenting technologies and other inventions discovered in their laboratories. There is substantial interest in better understanding the link between federal funding and innovation among U.S. colleges and universities. This report contributes to such improved understanding in two ways. First, it provides data, heretofore unavailable, that contain complete information laboriously extracted from official federal data systems on the amount of federal R & D funding that was actually provided to U.S. colleges and universities by fiscal year (FY) and by federal agency. These data will be of use to researchers interested in examining a number of issues related to federal funding of R & D at universities and colleges. Secondly, the report uses these data to provide an exploratory analysis of federal R & D funding and the patenting activities at universities and colleges using funding data from FY 2005 to describe the characteristics of academic institutions that have shown a greater propensity to patent since the Bayh-Dole Act was passed.
