The practice of radical and militant involvement with NGOs and charitable organisations continues today, and an understanding of the linkages between radicalisation and the NGO community is necessary when considering development interventions.

One of the ways in which terrorist organizations raise and transfer funds is by using nonprofit organizations (NPOs); however NPOs are also an important way to deal with the conditions conducive to the spread of terrorism. In trying to address one problem---terrorism financing---it is important not to diminish the important work of NPOs. This paper discusses the threat and how to address it without tainting the entire NPO sector and concludes that it is inefficient and counterproductive to devise an entirely new regulatory framework. The ultimate objective is to enhance the transparency of the NPO sector---the people in charge of NPOs, NPO funding sources, and how funds are spent. The NPO sector has a stake in being clean and being regarded as such by others, thus NPOs are indispensible partners in drawing up regulatory policies, including self-regulatory policies. The present paper models a terrorist group's charities as a means to advertise its cause in order to raise popular support. The analysis explains how different types of organizations arise in equilibrium, depending on government policies. Then, the interaction between a purely terrorist group and an independent local NGO is examined. It is shown that a purely terrorist group always invests in more attacks than an integrated terrorist-charity organization. Furthermore, the latter may have more NGO activity than a separate local NGO.

Book excerpt: A decade after the bombing of Air India Flight 182 in June 1985, many Canadians were shocked to learn that the Babbar Khalsa Society - a militant organization dedicated to the establishment of an independent state in northern India, members of which are believed to have planned the Air India bombing - had been granted charitable status in Canada. Although the organization's charitable status was revoked in 1996, reports also suggested that funds collected to support Sikh temples in Canada may have been diverted to support Sikh militancy in India.This article examines the relationship between charities and terrorist financing in Canada, reviewing Canada's legal framework in order to evaluate its adequacy to limit the use or misuse of charitable organizations for terrorist financing. This evaluation is based on two important considerations. First, as experience with the Babbar Khalsa Society and Sikh temple funds sadly demonstrates, effective supervision and regulation of charitable organizations is essential to prevent their manipulation by individuals and groups who seek to exploit the legitimacy and fiscal benefits that these organizations enjoy in order to finance terrorism. Second, as many charities are small organizations with unpaid volunteers and very few have any connection with terrorist activities, charities should generally be viewed as allies in the struggle against terrorism rather than suspects. As a result, government supervision and regulation of the charitable sector should be proportionate and risk-based - emphasizing capacity-building and best practices to prevent the use or misuse of charitable organizations for terrorist financing, ensuring transparency and self-regulation to the greatest extent possible, scrutinizing transactions and organizations that pose the greatest risks for terrorist links, and limiting more serious regulatory sanctions to the rare instances where charities provide support to terrorist organizations.

Book excerpt: Many of the world’s 40,000 International NGOs (INGOs) work in places where terrorist financing, sanctions breaches, and diversion are key risks. Almost all of the top ten recipient countries of humanitarian aid alone in 2015 were high-risk jurisdictions, for example, receiving more than £7bn between them. When they feel safe to speak, sector workers share sobering stories about what might have happened to some of this money. As INGOs struggle to keep up with worsening humanitarian needs, diversion risks and their complexity remain daunting. The demands of internal stakeholders, donors, banks, and regulators are diverse and even contradictory. Public scrutiny has magnified, but is not always well-informed. Institutional donors transfer ever more risk to implementing partners, while some banks seek to avoid this business altogether, pushing some NGOs outside the global banking system. Looming over all of these converging pressures is a latticework of austere international sanctions and counter-terror regimes. It is no surprise that INGOs find themselves struggling to reconcile this complex set of expectations with their charitable missions. Yet the consequences of failing to do so can be severe; future funding is contingent on reputation, and serious offences litter the regulatory landscape. The implications of breaches can be existential for organisations and criminal for individuals.
