Book excerpt: The Thesis constitutes a case study that explored the child-centred education policy incorporated within the Right of Children to Free and Compulsory Education Act (RTE), which was which enacted in India in August 2009 and came into force in April 2010. RTE provides for "free and compulsory education" for all children aged six to fourteen at primary and upper primary levels in state schools in India. The Legislation spearheads the provision of "free and compulsory education" through India"s programme to universalise elementary education, Sarva Shiksha Abhiyan, which translates as "Education for All Movement" and has been operational since 2000. The research investigated how child-centred education is conceptualised within RTE and how the policy is functioning through documentary analysis and semi-structured interviews with Indian teachers working at schools in Delhi, Uttar Pradesh and Punjab. The documentary analysis showed that child-centred education is conceptualised as a means of accomplishing the policy objectives of achieving the universalisation of elementary education and of strengthening democracy in India. The findings from the interviews with the teachers indicated that the functioning of seven of the eight child-centred provisions of RTE was problematic, as was the functioning of the new ascribed role of the Indian teacher as a "facilitator" within the child-centred schema. Through its findings the Thesis makes an original contribution to the emerging literature on the implementation of one of the child-centred education provisions of RTE, that of "Continuous and Comprehensive Evaluation". It also extends this literature by addressing the entire child-centred education policy. The research also addresses a gap in the literature on the policy aspect of the provision for child-centred education through its in-depth exploration of how child-centred education is conceptualised in the policy.

While on the one hand there is an increased push for free and universal access with assumed State responsibility, reports on the mushrooming of private schools targeting socially and economically disadvantaged groups in a range of developing countries, particularly across Africa and Asia, have emerged over the last decade. Low-fee private schooling has, thus, become a provocative and illuminating area of research and policy interest on the impacts of privatisation and its different forms in developing countries. This edited volume aims to add to the growing literature on low-fee private schooling by presenting seven studies in five countries (Ghana, India, Kenya, Nigeria and Pakistan), and is bookended by chapters analysing some of the evidence and debates on the topic thus far. The book presents research findings from studies across three levels of analysis that have proven relevant in the study of low-fee private schooling: the household, school and state. Chapters address household schooling choice behaviours regarding low-fee private and competing sectors; the management, operation and relative quality of low-fee private schools; and changes to the regulatory frameworks governing low-fee private schools, and the impact of low-fee private schools on those frameworks. The book does not seek to provide definitive answers since, as an emerging and evolving area of study, this would be premature. Instead, it aims to call attention to the need for further systematic research on low-fee private schooling, and to open up the debate by presenting studies that use a range of methods and, owing to the context specificity of the issue, draw different conclusions. The hope is that these studies may serve as springboards to further research. Finally, the book does not aim to snuff out the political and vociferous debate surrounding low-fee private schooling and private provision more broadly, or to erase the complications that abound in conducting research in this area, but to engage with them. The right to education can be best characterized as an empowerment right as it promotes the realization of other social and economic rights. However, education is something more than mere schooling. As defined by the World Conference on Education on all, “basic education” is an action designed to meet the “basic learning needs” of every person-child, youth and adult. The scope of “basic education” has been widely understood to include among other things, “early childhood car and initial education,” bringing the issue of a child's right to primary or 'elemental' education to the forefront. Internationally, the importance of free, quality and compulsory primary education has been emphasized at several levels. The United Nations General Assembly Special Session on Children in 2002 through its outcome document titled- State of the World's Children came up with a “4 A Scheme” in this direction. Similarly, education as a right of each child has been stressed within the framework of international standards, beginning with those in the UDHR and continuing with subsequent human rights treaties, and the activities of international bodies combining to establish the right to education as a universal norm. The state obligation of providing basic education for all as part of its international obligations under the international law is contained in the International Covenant on Economic, Social and Cultural Rights; Convention on the Rights of the Child; World Declaration on Education for All and World Education Forum Dakar Framework for Action, EFA (2000). However, the absence of a monitoring or a quasi-monitoring system that would directly oblige states parties to the implementation is a serious defect of international legal protection of children. In conformity to their international obligations, states across the world have attempted to give effect to the right of primary education through constitutional provisions as well as legislative enactments. In India, the right to free and compulsory education was first incorporated in the Directive Principles of the State Policy through Article 45 of the Constitution. In 1993, this right was upheld by the Supreme Court as a fundamental right enforceable by the citizens. Through the Constitution (Eighty-sixth Amendment) Act, 2002, the right was incorporated as a separate fundamental right under Article 21-A and a duty was imposed on parents and guardians to provide opportunities to children for education under Article 51-k. As a follow up legislation in terms of Article 21-A of the Constitution of India, the Indian Parliament enacted Right of Children to Free and Compulsory Education Act, 2009 ('RTE') which came into force on 1st April, 2010. RTE is the first Central Act in education and hence, an uncharted territory for everyone. It introduces many changes that are revolutionary and if implemented properly, will vastly improve the system of imparting education in India. However, some of the provisions of the Act may have unintended consequences that might counter the advantages of the new system. The objective of this paper is to critically examine the Right to Education Act, 2009, identify the loopholes and impediments to the effective implementation of the Act and propose recommendations accordingly. The best practices from legal systems across the world have been taken as a reference point to suggest an all-encompassing model for the enforcement of a child's right to primary education.

This volume explores emerging forms of the private through case studies from Africa, South Asia and South East Asia and makes three related observations.
