The MoD undertook reviews of these arrangements in 1998 in order to propose new schemes that ensure benefits are targeted effectively. However, the Committee's report finds that the review process has been dogged by delay and incompetence, and that the proposed schemes are at best inadequately thought-through and at worst fundamentally flawed.

The Commission focused on problems such as retirement, but also managed to deal with minor irritants such as lack of entitlements for junior enlisted men. It struck a careful balance between concerns for cost-effectiveness and concerns for the plight of the individual service member. Regarding retirement, the Commission distinguished between old age retirement and deferred compensation. The recommendation for the old age portion resembles the current Civil Service system. The deferred compensation portion is an innovative plan to establish a trust fund. Those separating from the military could withdraw their portion entirely. For those remaining, up to half could be withdrawn at any time while serving. This plan could reduce total retirement costs by 35-40 percent and encourage those serving 20 years to serve longer.

In a substantial portion of this analysis, alternative to the existing retirement system were developed and evaluated. An additional focus was placed on the consideration of how the retirement system assists in the transition of service members to the private sector upon retirement, and to extent to which it provides adequate compensation when they later reach old age. An extensive study of post-service earnings of all veterans (both retired and separated) was conducted especially for this effort. The volume contains a statement of the concepts and principles of Uniformed Services compensation, a detailed description of the computer modelling techniques employed, and a comprehensive discussion of the groups' findings and recommendations for change. The information in this volume is presented in such a manner that is understandable to the average reader yet technically correct and highly revealing to the econometrician.

Concerns about the compensation system, and the retirement system specifically, include the rising cost of military compensation and the need for greater efficiency in the provision of compensation, the greater need for flexibility to reshape the force as missions change in ways that challenge the current compensation system, and issues related to the equity of military retirement benefits of active versus reserve personnel, junior versus senior personnel, and military personnel versus their civilian counterparts. Active members can claim retirement benefits before reservists can; junior members who leave prior to completing 20 years of service do not qualify for retirement benefits, unlike their more senior counterparts; and the 20-year vesting rule is outside the civilian vesting norm of 5-7 years of service, under the Employee Retirement Income Security Act of 1974 (ERISA). The 10th Quadrennial Review of Military Compensation (QRMC), building on previous studies and commission reports, including the 2006 report of the Defense Advisory Committee on Military Compensation (DoD, 2006) and the 2000 report of the Defense Science Board Task Force on Human Resources Strategy, has proposed an alternative military retirement system that addresses concerns regarding the current system while still sustaining the force. The defined benefit (DB) and defined contribution (DC) plans are the foundation of the alternative system considered in this analysis. RAND was asked to develop a modeling capability to assess compensation alternatives, such as the QRMC proposal, in terms of their effects on military retention, retirement behavior, vesting, cost, reserve participation, and the value of compensation from the perspective of the member leaving active duty. This monograph presents the results of that study.

Book excerpt: UK military personnel as individuals are properly subject to UK and international law wherever they serve and there are processes to ensure scrutiny of their individual behaviour and legal compliance but, in the last ten years, legal judgments in the UK and elsewhere against the MoD have raised a number of legal, ethical and practical questions for the Armed Forces and their conduct of operations. The growing number of such challenges is leading to a feeling of disquiet amongst military personnel and informed commentators about the extent and scale of judicial involvement in military matters.There are two aspects of the use of human rights law in military operations that most concern the Committee: The extraterritorial application of the European Convention on Human Rights has allowed claims in the UK courts from foreign nationals. However, the requirement for full and detailed investigations of every death resulting from an armed conflict is putting a significant burden on the MoD and the Armed Forces. Secondly, there has been a failure of the accepted principle of combat immunity, most recently evidenced in the Supreme Court majority judgment in June 2013 allowing families and military personnel to bring negligence cases against the MoD for injury or death. This seems to us to risk the judicialisation of war and to be incompatible with the accepted contract entered into by Service personnel and the nature of soldiering.
