The concept of R2P has found broad approval in international law doctrine as well as in practice after it was first introduced by the Report of the International Commission on Intervention and State Sovereignty (ICISS) in 2001, and after its affirmation by the UN World Summit in 2005. It is fair to say that international law has been profoundly influenced by this new approach. Nonetheless, many questions in this regard are still open. In this volume international lawyers discuss a series of fundamental aspects of R2P: the historical dimension, the relationship between R2P and general international law and the dynamics surrounding this concept. Since the humanitarian tragedies in Rwanda, Burundi, Bosnia, Kosovo and elsewhere, states have begun advocating a right to undertake interventions to stop mass violations of human rights from occurring. A consolidated norm in international society is defined here as a regularised pattern of behaviour that is widely accepted as appropriate within a given social context. The analysis is based on the assumption that the R2P could be regarded as a consolidated norm if it were applied consistently when genocide and other mass atrocities occur; and if international responses routinely conformed to the core principles inherent in the R2P: seeking government consent, multilateralism, prevention and regionalism. This book employs Finnemore and Sikkink’s norm lifecycle model to determine the putative norm’s degree of consolidation, with in-depth case studies of the international responses to crises in Darfur and Kenya serving to illuminate the findings. It advances the argument that, whilst the R2P had fully emerged as a prospective norm by 2005, it has not yet fully consolidated as an international norm. The R2P has been remarkably successful at pervading the international discourse but has been somewhat less successful at consistency in implementation in terms of adherence to its core principles as outlined above (the qualitative dimension of the R2P). Furthermore, it has been least successful, to date, in terms of consistency across cases in terms of resolve and tenacity. The volume concludes with a reflection on the norm's progress so far, and its prospects for further consolidation, assuming the R2P continues on its current trajectory. This interrogation includes a particular focus on the impact of R2P on prevailing attitudes and discourses concerning humanitarian military intervention as well as the (under)provision of same. The study seeks to bridge the proverbial gap between theory and policy, specifically concerning our collective understanding of contemporary dynamics of humanitarian intervention and crisis. This objective is accomplished through the application and critical reformulation of the norm life cycle model and its three component stages (emergence, cascade, and internalization) relative to the presumed norm of R2P. The book advances the argument that R2P has only partially cascaded - stagnating rather than fully diffusing after reaching the 'tipping point', and in the process leaving the life cycle of the R2P norm in a state of dynamic equilibrium (e.g., a 'steady state'). Consequently, the chief implication of the dynamic of stagnation within international society which the book seeks to advance and support is the non-attainment of norm internalization. Through close examination of the genesis and evolution of R2P, the work contends that R2P actually poses a significant if not fundamental challenge to the animating logic of the norm life cycle model. Having reached the requisite tipping point through formal endorsement by the UN over a decade ago, R2P has failed to manifest itself in humanitarian intervention behavior. The key to understanding why resides in deficiencies of the norm life cycle model itself. By failing to provide a sufficient account of the dynamics of norm pre-emergence (whereby ideas are transformed into proto-norms) or to acknowledge the possibility norm stagnation (whereby a norm fails to diffuse and become internalized), the norm life-cycle model provides an underspecified mechanism for understanding how and why an idea may in fact cross the threshold of the 'tipping point'--attaining the status of a norm in international society in the process--but fail to penetrate and influence policy discourses and processes. The study seeks to bridge the proverbial gap between theory and policy, specifically concerning our collective understanding of contemporary dynamics of humanitarian intervention and crisis. Responsibility to Protect (R2P) was coined in 2001 as an evolution to the doctrine of Humanitarian Intervention (HI) with the aim to set precautions and conditions to govern the way the international community responds to humanitarian crises. The absence of defined rules or regulations to govern the international community's response to humanitarian crises has rendered the doctrine of humanitarian intervention perceived as a tool that can be used selectively by major powers to intervene in other countries according to their interests. The case of Kosovo (1999) when NATO forces launched military attacks against the Former Yugoslavian Republic (FYR) without a mandate from the UN Security Council, made it clear that the time was ripe by then for the adoption of a principled framework for humanitarian intervention. This framework was then proposed and coined later by the International Commission on Intervention and State Sovereignty (ICISS) and named the Responsibility to Protect (R2P). However, after the launch of R2P (2001) and the adoption of R2P at the UN World Summit (2005), the developments in Libya (2011) and Syria (2011-?) revealed that R2P has not provided substantive change to the pattern of the state reactions to humanitarian crises, political interests remained the dominant factors deciding intervention in case of humanitarian crises before and after R2P The thesis views that the launch of R2P constituted a historical opportunity to promote parameters and conditions for the international community to respond to humanitarian crisis in an automatic way away from any other considerations that could stem from particular interests or rivalry among major powers. However, the pattern of the international intervention in humanitarian crises after the R2P remained problematic. The main hypothesis of the thesis is throughout ages political interests were the dominant motive behind the decision of international intervention in humanitarian crises. Despite the great aspirations that accompanied the adoption of R2P, the pattern of international intervention under humanitarian reasons remained under the effect of the dominance of the political interests as it used to be before the adoption of R2P. The thesis will study different patterns of intervention in different eras before and after the adoption of R2P in order to demonstrate that political interests remained the dominant motive behind the decision of international intervention in humanitarian crises before and after R2P.
