Book excerpt: Professor Robert Rennie has been one of the most influential voices in Scots private law over the past thirty years. Highly respected as both an academic and a practitioner, his contribution to the development of property law and practice has been substantial and unique. This volume celebrates his retirement from the Chair of Conveyancing at the University of Glasgow in 2014 with a selection of essays written by his peers and colleagues from the judiciary, academia and legal practice. Each chapter covers a topic of particular interest to Professor Rennie during his career, from the historical development of property law rules through to the latest developments in conveyancing practice and the evolution of the rules of professional negligence. Although primarily Scottish in focus, the contributions will have much of interest to lawyers in any jurisdiction struggling with similar practical problems, particularly those with similar legal roots including the Netherlands and South Africa. As a whole, the collection is highly recommended to students, practitioners and academics.

Book excerpt: This is the first book to combine contemporary debates in ballad studies with the insights of modern textual scholarship. Just like canonical literature and music, the ballad should not be seen as a uniquely authentic item inextricably tied to a documented source, but rather as an unstable structure subject to the vagaries of production, reception, and editing. Among the matters addressed are topics central to the subject, including ballad origins, oral and printed transmission, sound and writing, agency and editing, and textual and melodic indeterminacy and instability. While drawing on the time-honoured materials of ballad studies, the book offers a theoretical framework for the discipline to complement the largely ethnographic approach that has dominated in recent decades. Primarily directed at the community of ballad and folk song scholars, the book will be of interest to researchers in several adjacent fields, including folklore, oral literature, ethnomusicology, and textual scholarship.

This book explores the scope to strengthen conservation by using different legal mechanisms such as biodiversity offsetting, payment for ecosystem services and conservation covenants, as well as tradable development rights and taxation. The authors discuss how such mechanisms introduce elemhents of a market approach as well as private sector initiative and resources. They show how examples already in operation serve to highlight the design challenges, legal, technical and ethical, that must be overcome if these mechanisms are to be effective and widely accepted.

Book excerpt: Drug overdose, driven largely by overdose related to the use of opioids, is now the leading cause of unintentional injury death in the United States. The ongoing opioid crisis lies at the intersection of two public health challenges: reducing the burden of suffering from pain and containing the rising toll of the harms that can arise from the use of opioid medications. Chronic pain and opioid use disorder both represent complex human conditions affecting millions of Americans and causing untold disability and loss of function. In the context of the growing opioid problem, the U.S. Food and Drug Administration (FDA) launched an Opioids Action Plan in early 2016. As part of this plan, the FDA asked the National Academies of Sciences, Engineering, and Medicine to convene a committee to update the state of the science on pain research, care, and education and to identify actions the FDA and others can take to respond to the opioid epidemic, with a particular focus on informing FDA's development of a formal method for incorporating individual and societal considerations into its risk-benefit framework for opioid approval and monitoring.

Available in PDF, EPUB and Kindle. Book excerpt: A Guide to The Immigration Act 2016 is produced in association with ILPA and provides a clear and straightforward explanation to the provisions of this legislation, with relevant commentary following each section of the Act. Those litigating will be able to identify all relevant sources and materials rapidly. Practitioners from other areas of law affected by the provisions in the context of housing, social welfare and employment law will be able rapidly to navigate these complex provisions and to understand them. The UK Government stated that its purpose in bringing forward this legislation was to tackle illegal immigration by making it harder to live and work in the United Kingdom without permission. The Immigration Act 2016 not only makes changes to immigration law and practice but also extends immigration control into other areas such as housing, social welfare and employment to create the 'hostile environment' envisaged. The approach is to summarise each provision of the Act and to set it within both its political and legal context, providing full legal references as well identifying relevant guidance, supporting materials and statements from parliamentary debates. The aim of the publication is to provide practitioners and academic and political commentators with a comprehensive guide to the Act, the bulk of the work being comments on the legal provisions interleaved with each section of the Act.

Available in PDF, EPUB and Kindle. Book excerpt: The Land Registration Act 2002 has been in force for almost fifteen years. When enacted, the legislation, which replaced the Land Registration Act 1925, was intended to offer a clear and lasting framework for the registration of title to land in England and Wales. However, perhaps confounding the hopes of its drafters, the legislation's interpretation and application has since generated many unanticipated problems which demand attention. In this book's twenty chapters, leading land law scholars, Law Commissioners past and present, judges, and Registry lawyers unpick key technical controversies, and expose underlying theoretical and policy concerns. Core issues addressed in these chapters include: the legitimate ambitions of registration regimes; the nature and security of title afforded by registration; the resolution of priority disputes affecting registered titles; the relationship between the general law and the registration regime; and new challenges presented by modern technological developments.

Available in PDF, EPUB and Kindle. Book excerpt: This is the first book to offer a systematic and analytical overview of the legal framework for residential construction. In doing so, the book addresses two fundamental questions: Prevention: What assurances can the law give buyers (and later owners and occupiers) of homes that construction work – from building of a complete home to adding an extension or replacing a shower unit – will comply with minimum standards of design, safety and build quality? Cure: What forms of redress - from whom, and by what route - can residents expect, when, often long after completion of construction, they discover defects? The resulting problems pose some big and difficult questions of principle and policy about standards, rights and remedies, which in turn concern justice more generally. This book addresses these key issues in a comparative context across the United Kingdom, Ireland, Australia and New Zealand. It is an accessible guide to the existing law for residents and construction professionals (and their legal advisers), but also charts a course to further, meaningful reforms of the legal landscape for residential construction around the world. The book's two co-authors, Philip Britton and Matthew Bell, have taught in the field in the UK, Australia and New Zealand; both have been active in legal practice, as have the book's two specialist contributors, Deirdre Ní Fhloinn and Kim Vernau.
