Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Process of Historical Proof There are some subjects that belong by equal right to different and independent departments of knowledge. The Christian Evidences are of this kind; for while they form an inseparable branch of theological study, they are manifestly included also in the province of general history. He, therefore, who devotes himself to the knowledge of whatever relates to the past condition of mankind, is free to examine these evidences - nay, he is bound to examine them - apart from their connection with religion. This is the ground on which I present the following pages to the reader. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from History of the Transmission of Ancient Books to Modern Times: Together With the Process of Historical Proof There is yet another reason that has induced me to retrench, in this Reprint, much that, thirty years ago, might seem proper to the treatment of the subject. In this course of time a great change has had place upon the field of argument touching Christianity and its origin Although disbelief may have spread widely of late, the argument concerning Christianity has been nar rowed on every side of it. Much that, a while ago, was thought to need the production of proof. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from History of the Transmission of Ancient Books to Modern Times: With the Process of Historical Proof Even in relation to those works of genius whose value consists in their intrinsic merits, and which would not be robbed of their beau ties though discovered to be spurious, an assurance of their genuineness is felt by every reader to conduce greatly to the pleasure they impart. But a much stronger feeling natu rally leads us to demand this assurance In the perusal of works which profess to have reality only for their matter. - Truth is the very subject' of History. - Satisfactory evi dence, therefore, of the integrity of its records may well be deemed an indispensable prelimi nary to a course of study in that department of knowledge. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Observations Upon the Natural History of Epidemic Diarrhoea The causative agencies from which springs the plentiful harvest of child mortality in large cities may be conceived as a felted mass of rootlets almost inextricably intertwined. Those of poverty, bad housing, bad feeding, and neglect, may be severally recognized, but the extent of their interrelations with actual respiratory and alimentary disease - those to which the greater part of the mortality is referred - can be traced only with difficulty. It is the object Of this work to aid ln the labour of cutting away the matrix and entangling fibres and to lay bare the hidden ramifications of at least one important causative agency - epidemic diarrhoea. This affection - if we accept provisionally the more novel and generally favoured conception. As to its nature - is revealed as something very like an ordinary infectious disease, and one which permeates all classes, while the excessive mortality it gathers round itself in urban centres must be regarded as something superadded, owing to the vicious circle it forms with those baneful conditions of slum life mentioned above. On the other hand, its peculiarly intimate association with the circum stances of domestic life, from the continual faecal pollution of the interior of the household by infants and others, tends to make it more so than other affections of the kind peculiarly a class disease, and an especial scourge of dirty neighbourhoods. Dirty towns may however be saved from excessive mortality by a high percentage of breast feeding. A notable point in the interesting comparison that can be drawn between diarrhoea and typhoid fever is that, in accordance with their peculiarly opposite age-incidence curves, the marked and habitual depositing of infectious excreta within the household in the former disease may make the question of water-closet versus conservancy pan a matter of far less importance than in the latter. It remains by means of Internal Criticism to decide the value of the evidence contained in the source, to interpret the latter, and by means of this evidence establish the historical facts of which we are in search. These facts are then grouped, gaps are filled in by construo tive reasoning, and the whole is presented in such a form as to render intelligible the process and facts of historical development. Book excerpt: Excerpt from The Secret of Progress Buckle1 regarded it as clear that militarism and high intellectual development were not compatible: till recently, many people were prepared to believe that warfare was alien to the interest of civilised peoples and could only occur among half civilised or backward races. But this war has shown that these hopes were vain, and that the last result of civilisation was not to render war impossible, but to give the means of carrying it out on a vastly extended scale. The increase of knowledge and of power over nature, and the sense of the benefits of intercourse and inter-communication have not sufficed to give us any immunity from war. Book excerpt: Excerpt from A Treatise on the Discovery of Evidence The origin of the jurisdiction of the Court of Chancery for discovery only was the refusal of the courts of common law to receive the evidence of the parties to an action, on the ground that, having an interest in the result, they might be tempted to commit perjury. Having obtained jurisdiction in this manner for discovery, the court proceeded to entertain the cause for relief, wherever fraud, accident, or mistake made the dispute one of equitable cognizance. It did this in order to prevent multiplicity of actions. Next, the court would not refuse to exercise its jurisdiction for discovery because power was given to other courts to compel it by their own process. The latter have, for the convenience of the reader, been arranged not only in separate columns according to their admissibility or the reverse, but, wherever. Po'ssible, in pairs, which present analogous facts but different decisions, the contrasted cases being placed side by side at the same height in the page. Book excerpt: Excerpt from Famous Cases of Circumstantial Evidence: With an Introduction on the Theory of Presumptive Proof Evidence and proof are often confounded, as implying the same idea; but they differ, as cause and effect. Proof is the legal credence which the law gives to any statement, by witnesses or writings; evidence is the legal process by which that proof is made. Hence, we say, that the law admits of no proof but such as is made agreeably to its own principles. The principles of evidence are founded on our observations on human conduct, on common life, and living manners: they are not just because they. Are rules of law; but they are rules of law because they are just and reasonable. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. This criticism applies with greater force to long cases. In the present volume the cases are short and confined to the points of Evidence involved.
