Book excerpt: Rhode Island has a long history of constitutional governance. Beginning in 1636, Rhode Island's constitution has been shaped by revolution, nation-building, tumult, and further changes wrought by everything from neo-liberalism to gay rights. The result has been a living document reflecting conflicting and changing values, making the Rhode Island constitution an essential resource for understanding the cultural history of this state. In The Rhode Island State Constitution Patrick T. Conley and Robert J. Flanders provide an outstanding constitutional and historical account of the state's governing charter. In addition to an overview of Rhode Island's constitutional history, it provides an in-depth, section-by-section analysis of the entire constitution, detailing the many significant changes that have been made since its initial drafting. This treatment, along with a table of cases, index, and bibliography provides an unsurpassed reference guide for students, scholars, and practitioners of Rhode Island's constitution. Previously published by Greenwood, this title has been brought back in to circulation by Oxford University Press with new verve. Re-printed with standardization of content organization in order to facilitate research across the series, this title, as with all titles in the series, is set to join the dynamic revision cycle of The Oxford Commentaries on the State Constitutions of the United States. The Oxford Commentaries on the State Constitutions of the United States is an important series that reflects a renewed international interest in constitutional history and provides expert insight into each of the 50 state constitutions. Each volume in this innovative series contains a historical overview of the state's constitutional development, a section-by-section analysis of its current constitution, and a comprehensive guide to further research. Under the expert editorship of Professor G. Alan Tarr, Director of the Center on State Constitutional Studies at Rutgers University, this series provides essential reference tools for understanding state constitutional law. Books in the series can be purchased individually or as part of a complete set, giving readers unmatched access to these important political documents.

Available in PDF, EPUB and Kindle. Book excerpt: Rhode Island is the smallest state in the union, yet it is also one of the most densely populated. Its political culture has until recently resembled the old-style patronage politics of a city-state. The Ocean State's politics have been highly individualistic, contentious, and distinct from those of surrounding states since its founding by Roger Williams. The state's individualism is embodied in the statue?"The Independent Man"?that stands atop its statehouse.øRhode Island Politics and Government is an essential introduction to the history, structure, and characteristics of politics in Rhode Island. Explained in turn are such components and factors as the state's constitution, general assembly, executive branch, party system, interest groups, budgetary process, and relationship to the federal government. The authors also explore the nature of local government.

Available in PDF, EPUB and Kindle. Book excerpt: Since the US Constitution came into force in 1789, it has been amended just twenty-seven times, with ten of those amendments coming in the first two years following ratification. By contrast, state constitutions have been completely rewritten on a regular basis, and the current documents have been amended on average 150 times. This is because federal amendments are difficult, so politicians rarely focus on enacting them. Rather, they work to secure favorable congressional statutes or Supreme Court decisions. By contrast, the relative ease of state amendment processes makes them a realistic and regular vehicle for seeking change. With State Constitutional Politics, John Dinan looks at the various occasions in American history when state constitutional amendments have served as instruments of governance. Among other things, amendments have constrained state officials in the way they levy taxes and spend money; enacted policies unattainable through legislation on issues ranging from minimum wage to the regulation of marijuana; and updated understandings of rights, including religious liberty, equal protection, and the right to bear arms. In addition to comprehensively chronicling the ways amendments shape politics in the states, Dinan also assesses the consequences of undertaking changes in governance through amendments rather than legislation or litigation. For various reasons, including the greater stability and legitimacy of changes achieved through the amendment process, he argues that it might be a more desirable way of achieving change.

Available in PDF, EPUB and Kindle. Book excerpt: American Sovereigns: The People and America's Constitutional Tradition Before the Civil War challenges traditional American constitutional history, theory and jurisprudence that sees today's constitutionalism as linked by an unbroken chain to the 1787 Federal constitutional convention. American Sovereigns examines the idea that after the American Revolution, a collectivity - the people - would rule as the sovereign. Heated political controversies within the states and at the national level over what it meant that the people were the sovereign and how that collective sovereign could express its will were not resolved in 1776, in 1787, or prior to the Civil War. The idea of the people as the sovereign both unified and divided Americans in thinking about government and the basis of the Union. Today's constitutionalism is not a natural inheritance, but the product of choices Americans made between shifting understandings about themselves as a collective sovereign.
