Available in PDF, EPUB and Kindle. Book excerpt: Originally published: Cambridge: Cambridge University Press, 1908. xxviii, 547 pp. Although Maitland never intended to publish these lectures, they have long been regarded as one of the best introductions to the English Constitution. Delivered in the winter of 1887 and spring of 1888, and edited and published in 1908 by one of Maitland's students, Herbert A.L. Fisher, they cover the period from 1066 to the end of the nineteenth century. Rather than a narrative historical format, they focus on describing the work of the constitution during five distinct moments in English history: 1307, 1509, 1625, 1702 and 1887. They provide an entry to some of the major concepts he later expounded in his seminal work written with Sir Frederick Pollock, The History of English Law. Widely considered the father of modern legal history, FREDERIC WILLIAM MAITLAND 1850-1906] was an English jurist and historian best known for The History of English Law Before the Time of Edward I (1895), written with Sir Frederick Pollock. He was educated at Eton and Cambridge and studied at Lincoln's Inn, London. Maitland was called to the bar in1876 and practiced until 1884, when he became a reader in English law (1884) and professor (1888) at Cambridge. He founded the Selden Society in 1887. Hailed for his original outlook on history, his works had a profound influence on legal scholarship and remain important today.

This book was released on 2018-01-13 with total page 316 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A History of the British Constitution The great nobles of the Norman and early Angevin times would, if they could, have reduced the king to the position of a feudal overlord, cut off from direct authority over the mass of the people by intervening grades of feudal order. That they failed to do so was due to the fact that the anglo-saxon period had taught the English freeman to regard the king as a national officer, and that William the Conqueror and Henry I. Had the sagacity to recognize and encourage this feeling. As a result, an informal alliance between the crown and the people grew up. When the chartered towns began to develop a local political life based not on land but on trade and industry, it was to the crown that they turned for support. But it was not through any wish of their own that the Com mons began to play a part in national affairs, but because the crown called them in to redress the balance of feudal oligarchy. Throughout the Middle Ages political representation was regarded as a burden rather than a privilege. It was Edward i.'s supreme title to greatness that he recognized that the feudal expression of the idea of govern ment by consent must give place to the national. In the writs Of summons to the Model Parliament of 1295, he re asserted the fundamental principle of the Old Teutonic assembly that common danger should be met by means devised in common. Book excerpt: Excerpt from Constitutional History of England Of the compendious general histories of the English con stitution, T. P. Taswell-langmead's is the most satisfactory on the whole for American use, but numerous revisions have affected practically only the most recent periods, and much Of the narrative depends too exclusively on the statutes. Its great advantage is that it presents a continuous chronol ogical account and that the detail is full. D. J. Medley's is more accurate in the earlier portions and has been kept abreast Of recent legislation, but it treats the subject top ically rather than in its chronological development. F. W. Maitland's is based on the lectures given by Professor Mait land at Cambridge in 1887 and 1888, and is full of sugges tion for the teacher. It presents the subject in cross sec tions at five important epochs. J. Hatschek's Englische Verfassungsgeschichte is valuable as giving the views of a foreign scholar and treats of many topics not usually cov ered elsewhere. It has full bibliographies. R. Gneist's History of the English Constitution, translated by P. A. Ashworth, is still useful, especially for facts not commonly given. J. A. R. Marriott's English Political Institutions, though concerned chiefly with present institutions, is helpful in tracing their historical antecedents. Book excerpt: Excerpt from Four Letters on the English Constitution: I, on Different Opinions Concerning the English Constitution, II, on Its Principles, III, on Its Defects, IV, on the Best Means of Promoting Its Fundamental Principles These Essays were first published in a Miscellany, as Letters: they were republished, because they needed some corrections; and because the writer thought, that, in some material points, they were susceptible of improvement. It was suggested, indeed, that the times were favourable to the publication; though he was not sanguine on that head. Temporary questions have a chance of becoming popular by local pleas, or by accidental circumstances. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from A Manual of Constitutional History: Founded on the Works of Hallam, Creasy, Man and Broom; Containing the Fundamental Principles and the Leading Cases in Constitutional Law There is scarcely any branch of learning which has received fuller elucidation at the hands of some of our ablest men than Constitutional History. Our libraries have been enriched by the stately periods of Henry Hallam, and the graceful eloquence of Sir Erskine May, and new light is being continually thrown upon the subject by the researches of Professors Stubbs and Freeman. Yet, in spite of the value of these works, the field of Constitutional History is a terra incognita to the great mass of the public, and the reason is not far to find. A very general feeling exists that Hallam is a very hard book, and it must be confessed that it is not the lightest possible reading; but if Hallam is hard Professor Stubbs is ten thousand times harder, and without a general acquaintance with the subject it is difficult to follow either author.
