Book excerpt: The Planning Act 2008 created a new system of development consent for certain types of nationally significant infrastructure, including major energy infrastructure, railways, ports, roads, airports, water and waste projects which were deemed to be of national significance. The regime is still fairly new, with only 12 applications having gone all of the way through the system to completion. However it is clear that the new regime is working as intended and is leading to quicker planning decisions. For example the approval of Hinkley Point C was approved within the one year statutory timeframe. A large part of the reason why that decision was taken more quickly is because the Energy National Policy Statements make it clear that the construction of new low carbon electricity generation infrastructure is of crucial national importance. The regime has not stood still since it was introduced. It has been amended by the Localism Act and the Growth and Infrastructure Act. The changes made by the Localism Act - the removal of the Infrastructure Planning Commission and the restoration of Ministers as the final decision makers - are seen as restoring democratic accountability to the regime. It is too early too judge the effectiveness of the changes introduced in the Growth and Infrastructure Act.

Book excerpt: This project, following a joint consultation in 2010, aims to modernise and clarify the safety regime governing level crossings in Great Britain. It aims to make it easier to close level crossings where necessary and preserve rights of way where appropriate. It recommends that safety should be regulated entirely by the Health and Safety at Work, etc Act 1974, and approved codes of practice and guidance under new powers given to the Office of Rail Regulation. Modern safety regulation should also take precedence over safety provisions in special Acts. It is also recommended that the Level Crossings Act 1983 be repealed. In place of level crossing orders under that Act, there should be regulations making provision for level crossing plans which may be entered into voluntarily in respect of public and private level crossings if the parties whish to create such an arrangement. Also recommended are creation of duties on railway operators and traffic authorities; clarification of boundaries between the enforcement responsibilities of the Office of Rail Regulation and those of the Health and Safety Executive; and disapplication of obsolete statutory provisions. Most of the recommendations for reform of the law are given effect in the draft Level Crossings Bill and draft Level Crossings Plans Regulations both of which are included in the report

Book excerpt: Hafren Power's proposal for an 18km fixed tidal barrage across the Severn estuary between Brean in England and Lavernock Point in Wales is likely to require a very high level of support over many years. It is not believed at this stage that the barrage would be competitive with other low-carbon technologies. Hafren Power have failed to answer the serious environmental concerns about a potential barrage adequately. The scale of mitigation measures and compensatory habitat required is unprecedented, and questions remain about how a barrage such as the one proposed would comply with EU legislation. Tidal energy is a vast resource which remains largely untapped. However, tidal and marine projects must demonstrate their economic, environmental and technological credentials and their ability to gain stakeholder support. The Government should consider whether a smaller tidal facility could develop expertise and provide evidence before a decision about scaling up is taken. Although construction of the barrage would be privately financed, Government support would be required for approximately thirty years through Contracts for Difference (CfD) or a similar mechanism. The long lifecycle of a tidal barrage, thought to operate for over 120 years, could lower the overall levelised cost of energy but is far too distant a prospect to overcome more immediate concerns. The strike price required by Hafren Power is unknown, but the ability of the project to compete with other low-carbon forms of energy is questionable. The likelihood of a high strike price over many years risks eating up an excessively large proportion of the funds available under the Levy Control Framework
