Beginning in the late nineteenth century, it discusses how the idea of using referendums to resolve major political disputes first came onto the agenda, and why. It considers who advocated it, and in what circumstances. The book describes how referendums eventually came into use from the 1970s onwards, and the different patterns in their deployment in the decades that have followed. Major political figures, from Herbert Henry Asquith and Winston Churchill to Clement Attlee, Harold Wilson and Margaret Thatcher; to Tony Blair, David Cameron, and Boris Johnson form part of the story. Governments have come to power and fallen in the context of demands for referendums or the results they produced. The authors provide detailed accounts of each of the 13 major referendums that have taken place. Referendums took place at UK and sub-UK level. They were held on the position of Northern Ireland (1973) and Scotland (2014) within the UK; on devolution to Wales (1979; 1997; 2011) and Scotland (1979; 1979); on the Belfast/Good Friday Agreement (1998); on devolution to London (1998) and North East England (2004); on the parliamentary voting system (2011); and on UK participation in European integration (1975; 1975). The book provides a constitutional and international perspective, and ask how far the original ideas lying behind the referendum were fulfilled in practice.

The resulting fear and uncertainty produced a momentary return to "Keynesian" policies. But as soon as emergency stimuli – and bank bail-outs – appeared to stabilise the situation, there was a sharp reversal; and successive British governments and the financial sector have since attempted to return to business as usual. Historically, much smaller shocks have been able to produce dramatic change, with the 1978 "Winter of Discontent" providing a catalyst for the election of Margaret Thatcher, the ultimate abandonment of the post-war Keynesian consensus, and the ushering-in of neoliberalism. Nor is apparent success a guarantee against change, with Winston Churchill being swept from office by the first majority Labour government in 1945 – at a point which should have marked his greatest triumph. Deliberate mischaracterisation of political opponents and their policies has always been a part of politics; however, lying, dishonesty, and distortion of the facts remain morally wrong and have the potential to obstruct important political interests. For example, a false or misleading claim publicised about an election candidate may lead someone to lose an election that they might otherwise have won. So, does-and should-the law seek to provide protection from the risk of this happening, by directly prohibiting the making of false or misleading political claims, or by obliging internet platforms to censor such content? In attempting to answer this question, Jeremy Horder draws a key distinction between what is called 'political viewpoint' fraud and 'electoral participation' fraud. In the interests of protecting freedom of speech, false or misleading claims (disinformation) involving political viewpoint content should be tolerated, not only by the criminal law but also by the internet platforms which host political content. By contrast, in the interests of preserving the integrity of democratic electoral processes, disinformation involving electoral participation information should be prohibited by the criminal law and censored by internet platforms. This book explains how the criminal law in various jurisdictions frequently prohibits false or misleading political claims falling into both categories of disinformation, instead of concentrating on electoral participation fraud. By contract, the right response to political viewpoint disinformation is the provision of more information that challenges people to question their beliefs and prejudices.
