Book excerpt: Decentralization in Indonesia allowed forest-dependent communities to legally trade in their customary forest rights for a share in timber rents. Despite uncertain property rights, communities engaged in negotiations with firms for logging agreements. The benefits that flowed to communities from these agreements varied significantly. Research was undertaken, first, to compare the impacts of mechanized logging on communities before and after decentralization. The second aim was to analyze the potential factors underlying the variation in post-decentralization outcomes. A conceptual framework and a game-theoretic model of community-firm interactions are developed, which allow for the derivation of hypotheses on determining factors and the expected directions of effects. To test these empirically, fieldwork was undertaken in East Kalimantan. The results showed that communities benefited financially and perceived no significant differences in some logging impacts after decentralization compared to before. Post-decentralization community-firm conflict, inter-community conflict and intra-community conflict were all common occurrences. Nevertheless, there is no evidence of a trade-off between environmental and financial contractual provisions. Given weak property rights, the community's ability to self-enforce its rights over the forest are shown to be crucial for claiming a significant share of logging rent. The theoretical hypotheses are generally supported by econometric analysis using survey data.

Forestry policies implemented in the district before and after the introduction of legislation granting regional autonomy and the emergence of small-scale timber concessions are described. Qualitative research methodologies, i.e. semi-structured interviews, field observations and workshops, were used. The results show that the decentralization of forest management had not proceeded smoothly because of the lack of regulations governing implementation, and that the decentralized forest policies had had both positive and negative impacts. Focusing on 100-ha forest product harvest concessions (HPHH), the study examined opportunities for local communities and other stakeholders to participate in the management of forest resources, the contributions of the small-scale forest concessions to district development and local community livelihoods, and social conflicts arising from a complex combination of factors.

How this ongoing struggle over authority in the forestry sector will ultimately play out is of considerable significance due to the important role that Indonesias forests play in supporting rural livelihoods, generating economic revenues, and providing environmental services. This book examines the process of forestry sector decentralization that has occurred in post-Soeharto Indonesia, and assesses the implications of more recent efforts by the national government to recentralize administrative authority over forest resources. It aims to describe the dynamics of decentralization in the forestry sector, to document major changes that occurred as district governments assumed a greater role in administering forest resources, and to assess what the ongoing struggle among Indonesias national, provincial, and district governments is likely to mean for forest sustainability, economic development at multiple levels, and rural livelihoods. Drawing from primary research conducted by numerous scientists both at CIFOR and its many Indonesian and international partner institutions since 2000, this book sketches the sectoral context for current governmental reforms by tracing forestry development and the changing structure of forest administration from Indonesias independence in 1945 to the fall of Soehartos New Order regime in 1998. The authors further examine the origins and scope of Indonesias decentralization laws in order to describe the legal-regulatory framework within which decentralization has been implemented both at the macro-level and specifically within the forestry sector. At the local level, support and capacity building are needed to strengthen intermediary institutions in order to improve governance and increase legitimacy when deciding how to share benefits.Nonmonetary benefits such as land tenure, capacity building, infrastructure and access to natural resources have been especially important. However, in some cases there are nonmonetary burdens associated with intended benefits.The legitimacy of benefit-sharing arrangements is determined more by the actors involved than the type of land-use change associated with them. Conservation initiatives, REDD+ projects and oil palm initiatives all exhibited both high and low levels of legitimacy in their benefit-sharing arrangements.The legitimacy of benefit-sharing arrangements can be compromised by the lack of broad consultation with local actors including customary authorities, lack of community control over access to land snd limited livelihoods options for communities.

Book excerpt: This working paper presents the status of forest tenure in contemporary Indonesia; it explores how forest tenure reforms emerge and the options for formal approaches to securing customary rights in Indonesia. It also presents an overview and analysis of Indonesia's legal and institutional framework for tenure reform. Forest tenure reforms in Indonesia have evolved through dynamic, interactive, collaborative processes that have involved both State and non-State institutions. Both the processes and the products (such as policies and programs) of forest tenure reforms in Indonesia, such as the 1999 reforms that resulted in social forestry schemes, have not been effectively implemented in Indonesia due to the: onerous process of obtaining a permit; lack of direction and motivation of staff within implementing agencies in supporting social forestry; limited capacity and resources among both communities and implementing agencies to comply with the technical requirements to process the permit; and macro-level economic prioritization of extractive activities that concentrate benefits in the corporate sector. Moreover, women and marginal members of indigenous peoples and local communities have been largely left out. However, recent developments such as Constitutional Court Ruling No. 35/2012 defined land and forests within customary territories as private entities, and not State land and forests. Furthermore, recent government initiatives for recognizing existing agroforestry practices within kawasan hutan by granting land title or bringing them under social forestry schemes are important developments that can help to resolve conflicts. Finally, the government's ambitious target of bringing 12.7 million ha of State forest area under community management, deregulation of some of the steps for obtaining a social forestry permit and the involvement of non-State actors in tenure reform processes have the potential to further strengthen local people's rights and security over land and forests, if properly supported and implemented.

Proponents highlight the potential for job creation and poverty alleviation, but scholars are more cautious, noting that social impacts of oil palm are not well understood. This report draws upon primary research in West Kalimantan to explore the gendered dynamics of oil palm among smallholders and plantation workers. It concludes that the social and economic benefits of oil palm are real, but restricted to particular social groups. Among smallholders in the research area, couples who were able to sustain diverse farming systems and add oil palm to their repertoire benefited more than transmigrants, who had to survive on limited incomes from a 2-ha plot.
