Book excerpt: The year 2020 marks the 75th anniversary of the United Nations Organisation, and the 50th anniversary of the United Nations Friendly Relations Declaration, which states the fundamental principles of the international legal order. In commemoration, some of the world's most prominent international law scholars from all continents have come together to offer a comprehensive study of the fundamental principles of international law. Each chapter in this volume reflects decades of experience, work and reflection by the most authoritative voices of the field. At the same time, the book is an invitation to end narrow specialisation and re-engage with the wider body of rules and processes that lie at the foundations of the international legal order.

Book excerpt: Classic Books Library presents this brand new edition of “The Federalist Papers”, a collection of separate essays and articles compiled in 1788 by Alexander Hamilton. Following the United States Declaration of Independence in 1776, the governing doctrines and policies of the States lacked cohesion. “The Federalist”, as it was previously known, was constructed by American statesman Alexander Hamilton, and was intended to catalyse the ratification of the United States Constitution. Hamilton recruited fellow statesmen James Madison Jr., and John Jay to write papers for the compendium, and the three are known as some of the Founding Fathers of the United States. Alexander Hamilton (c. 1755–1804) was an American lawyer, journalist and highly influential government official. He also served as a Senior Officer in the Army between 1799-1800 and founded the Federalist Party, the system that governed the nation’s finances. His contributions to the Constitution and leadership made a significant and lasting impact on the early development of the nation of the United States.

Available in PDF, EPUB and Kindle. Book excerpt: Though Ireland is a relatively small island on the northeastern fringe of the Atlantic, 70 million people worldwide--including some 45 million in the United States--claim it as their ancestral home. In this wide-ranging, ambitious book, Cian T. McMahon explores the nineteenth-century roots of this transnational identity. Between 1840 and 1880, 4.5 million people left Ireland to start new lives abroad. Using primary sources from Ireland, Australia, and the United States, McMahon demonstrates how this exodus shaped a distinctive sense of nationalism. By doggedly remaining loyal to both their old and new homes, he argues, the Irish helped broaden the modern parameters of citizenship and identity. From insurrection in Ireland to exile in Australia to military service during the American Civil War, McMahon's narrative revolves around a group of rebels known as Young Ireland. They and their fellow Irish used weekly newspapers to construct and express an international identity tailored to the fluctuating world in which they found themselves. Understanding their experience sheds light on our contemporary debates over immigration, race, and globalization.

Available in PDF, EPUB and Kindle. Book excerpt: The U.S. has been involved in military operations in Iraq since March of 2003. Congress has several tools by which to exercise oversight regarding negotiation, form, conclusion, and implementation of agreements by the U.S. The agreements with Iraq were negotiated and concluded as executive agreements and entered into force on Jan. 1, 2009, and yet there remain many unanswered questions about the specific terms within the Status of Forces Agreements (SOFA). This report discusses the historical legal framework governing U.S. military operations in Iraq and then provides a general background as to the content of agreements traditionally considered SOFAs. Also discusses specific aspects of the SOFA.

Available in PDF, EPUB and Kindle. Book excerpt: Co-published by Oxford University Press and the International Law Institute, and prepared by the Office of the Legal Adviser at the Department of State, the Digest of United States Practice in International Law presents an annual compilation of documents and commentary highlighting significant developments in public and private international law, and is an invaluable resource for practitioners and scholars in the field. Each year's volume compiles excerpts from documents such as treaties, diplomatic notes and correspondence, legal opinion letters, judicial decisions, Senate committee reports and press releases. Each document is selected by members of the Legal Adviser's Office of the U.S. Department of State, based on their judgments about the significance of the issues, their potential relevance to future situations, and their likely interest to scholars and practitioners. In almost every case, the commentary to each excerpt is accompanied by a citation to the full text. Featured in the 2008 Digest are excerpts from and discussion of numerous documents relating to issues of current interest, including the following: * Department of Justice position on trial and conviction within the U.S. of the son of former Liberian president Charles Taylor, for torture (Chapter 3, "International Criminal Law"). * The U.S.-Libya Claims Settlement Agreement, including the Libyan Claims Resolution Act (enacted August 4, 2008) (Chapter 8, "International Claims and State Responsibility"). * Recognition of Kosovo as a sovereign state and establishment of diplomatic relations with Kosovo (Chapter 9, "Diplomatic Relations, Succession, and Continuity of States"). * Decisions in arbitration regarding the softwood lumber dispute with Canada (Chapter 11, "Trade, Commercial Relations, Investment, and Transportation"). * Statements and speeches of U.S. officials on climate change made at international climate change conferences (Chapter 13, "Environment and Other Transnational Scientific Issues"). * Executive Orders imposing sanctions on Burma, Syria, and Zimbabwe (Chapter 16, "Sanctions"). * U.S. positions on the Israeli-Palestinian conflict as well as peace efforts in Lebanon, Somalia, and Sudan (Chapter 17, "International Conflict Resolution and Avoidance"). * U.S. statements on the Russia-Georgia conflict and other instances of international armed conflict (Chapter 18, "Use of Force, Arms Control and Disarmament, and Nonproliferation"). * U.S. positions on discussions of a possible Protocol to the Convention on Conventional Weapons relating to cluster munitions, and U.S. opposition to a separate Convention on Cluster Munitions (Chapter 18, "Use of Force, Arms Control and Disarmament, and Nonproliferation"). * U.S. federal court decisions on current and former Guantanamo detainees (Boumediene v. Book excerpt: Pauline Maier shows us the Declaration as both the defining statement of our national identity and the moral standard by which we live as a nation. It is truly "American Scripture," and Maier tells us how it came to be -- from the Declaration's birth in the hard and tortuous struggle by which Americans arrived at Independence to the ways in which, in the nineteenth century, the document itself became sanctified. Maier describes the transformation of the Second Continental Congress into a national government, unlike anything that preceded or followed it, and with more authority than the colonists would ever have conceded to the British Parliament; the great difficulty in making the decision for Independence; the influence of Paine's []Common Sense[], which shifted the terms of debate; and the political maneuvers that allowed Congress to make the momentous decision. In Maier's hands, the Declaration of Independence is brought close to us. She lets us hear the voice of the people as revealed in the other "declarations" of 1776: the local resolutions -- most of which have gone unnoticed over the past two centuries -- that explained, advocated, and justified Independence and undergirded Congress's work. Detective-like, she discloses the origins of key ideas and phrases in the Declaration and unravels the complex story of its drafting and of the group-editing job which angered Thomas Jefferson. Maier also reveals what happened to the Declaration after the signing and celebration: how it was largely forgotten and then revived to buttress political arguments of the nineteenth century; and, most important, how Abraham Lincoln ensured its persistence as a living force in American society. Finally, she shows how by the very act of venerating the Declaration as we do -- by holding it as sacrosanct, akin to holy writ -- we may actually be betraying its purpose and its power.

Book excerpt: This Handbook provides a cutting edge study of the fast developing field of international law on the protection of cultural heritage by taking stock of the recent developments and of the core concepts and current challenges. The legal protection of cultural heritage has come under renewed focus from the international community and states since the 1990s. This is evidenced by the adoption of a range of international instruments. Countries are also enacting cultural heritage legislation or overhauling existing laws within their own national territory. Contributions address the protection of immovable and movable, tangible and intangible cultural heritage in peacetime and in the event of armed conflict as well as the interaction between specific regimes of cultural heritage protection with other fields of international law, including international criminal law, human rights and humanitarian law, environmental law, international trade, investments, and intellectual property. The last part of the Handbook covers diverse regional systems of heritage protection.
