Book excerpt: During these interviews, staff discussed the changes 8 that had been made at the state level to comply with IDEA and NCLB regulations, the difficulties states had in making those changes, and whether or not a discernible improvement in the academic achievement of students with disabilities had occurred as a result of NCLB and IDEA. [...] As special education teachers retire, more attention needs to be paid to how to develop the profession and to maintain adequate numbers of teachers with the skills and knowledge to work with students with disabilities. [...] While NCLB was still a relatively new law and in the process of being implemented, it was clear that the goal of the law to close the achievement gap and help all students meet academic proficiency resonated with policymakers, parents, the public, and advocacy groups. [...] Many, perhaps, viewed the most dramatic and important changes to be the section of the law requiring schools, school districts, and states to report on the academic performance of student subgroups. Book excerpt: In 2004, the National Council on Disability (NCD) issued a report called "No Child Left Behind: Improving Educational Outcomes for Students with Disabilities," which examined the impact of No Child Left Behind (NCLB) and the Individuals with Disabilities Education Act (IDEA) on improving educational outcomes for students with disabilities. This report provides both a follow-up and a more detailed reporting of the trends and attitudes about NCLB and IDEA over the past several years. The authors spoke to dozens of researchers, practitioners, and state administrators from across the country about NCLB and IDEA. In addition, they conducted a study of 10 of the largest states in the nation, representing approximately half the U.S. general population. This report is divided into four sections. Part I provides a brief overview of trend data regarding students with disabilities. Part II describes conversations with state administrators and representatives about trends and issues related to NCLB and IDEA. Part III describes similar conversations with advocates, federal officials, and other stakeholders. Part IV provides recommendations based on the authors' findings. Book excerpt: The No Child Left Behind Act of 2001 (NCLB) required America's public schools to make every student proficient in reading, math and science by the year 2014. The 2004 amendments to the Individuals with Disabilities Education Act (“IDEA”) attempted to reconcile the IDEA with the NCLB. The IDEA gives parents the right to negotiate educational programs for their children with disabilities and creates procedures to protect the parents' role. The 2004 IDEA amendments unjustifiably reduced the power of parents of children with disabilities to negotiate appropriate educational programs for their children. The changes have the greatest impact on parents with limited financial means. The heart of the IDEA is its promise of a free appropriate public education in the most integrated setting possible. The IDEA's strategy for providing education in an integrated environment to students whose unique needs require specially tailored educational programs is to guarantee an individualized educational program (IEP) for each eligible child. The IDEA seeks to guarantee the appropriate content of individualized programs by giving the parents of each eligible child a significant role in determining the program. Parents not only have the right to participate in drafting the IEP, but they have the right to seek administrative and judicial review of the content and implementation of an IEP. The 2004 amendments to the IDEA and two subsequent U.S. Supreme Court cases have made it more difficult and more expensive for parents to obtain meaningful review of school actions. The IDEA needs to be amended to restore and strengthen the role of parents in the education of children with disabilities.

Patrick McGuinn, a political scientist with hands-on experience in secondary education, explains how this happened despite the country's long history of decentralized school governance and the longstanding opposition of both liberals and conservatives to an active, reform-oriented federal role in schools.
