Book excerpt: January 2001 Trade liberalization and the breakup of private carrier agreements could reduce average liner transport prices by a third and cut costs on goods carried to the United States alone by up to $3 billion. Maritime transport costs significantly impede international trade. Fink, Mattoo, and Neagu examine why these costs are so high in some countries and quantify the importance of two explanations: restrictive trade policies and private anti-competitive practices. Both matter, they find, but private anti-competitive practices have the greater impact. Trade liberalization and the breakup of private carrier agreements would lead to a reduction in average liner transport prices of a third and cost savings of up to $3 billion on goods carried to the United States alone. The policy implications are clear: not only should government policy be further liberalized, but there should be stronger international disciplines on restrictive business practices. Fink, Mattoo, and Neagu propose developing such disciplines in the current round of services negotiations at the World Trade Organization. This paper--a product of Trade, Development Research Group--is part of a larger effort in the group to assess the implications of liberalizing trade in services. Studies show that two of the main determinants of transport costs are regulatory frameworks in transport sectors and transport infrastructure. The productivity and competitiveness of goods and services firms depends largely on access to low-cost and high-quality transport services, and those services have a powerful influence on economic growth. Countries commit themselves to increasing the efficiency of transport services, which can largely be achieved through increased competition and hence through liberalization of transport sectors. Since barriers to trade in transport services are typically regulatory in nature, this book provides a thorough discussion of international, regional, and country specific rules and regulations in those sectors. Concentrating on the EU, and Turkey in particular, it considers rules and regulations in transport sectors. It shows that economic liberalization pursued unilaterally, multilaterally, or regionally has beneficial effects for Turkey, and that the benefits from such liberalization are substantial. Furthermore, the volume shows that transport infrastructure is an important determinant of exports, and hence GDP and GDP growth.

Yet this area of law and international trade regulations have developed as two distinct areas with little interface with each other. As the GATT/WTO emerged in parallel to the LOS Convention since the 1970s, both bodies have made extensive efforts in international treaty making. However, the relationship between trade regulations and the law of the sea has hardly been explored. The author examines some key aspects of this relationship, in particular port entry, access to cargo in coastal shipping (cabotage) and access to cargo in international shipping. The inclusion of services in WTO law will render this relationship of great importance in the future as the agreement extensively covers maritime transport. It is just a matter of time until the current exclusion of maritime transport under special exemptions will be reviewed in future negotiations.
