Book excerpt: This is the third revised edition of what was described by the English Court of Appeal in C v D as the “standard work” on Bermuda Form excess insurance policies. The Form, first used in the 1980s, covers liabilities for catastrophes such as serious explosions or mass tort litigation and is now widely used by insurance companies. It is unusual in that it includes a clause requiring disputes to be arbitrated under English procedural rules in London but subject to New York substantive law. This calls for a rare mix of knowledge and experience on the part of the lawyers involved, each of whom is required to confront the many differences between English and US law and legal culture. In addition, since the awards of arbitrators are confidential and are not subject to the scrutiny of the courts, the book helps professionals understand the Form's lengthy and complex provisions. The book, first published in 2004, was the first comprehensive analysis of the Bermuda Form. It is frequently cited in Bermuda Form arbitrations and was the joint winner in 2012 of British Insurance Law Association Book Prize for the most notable contribution to literature in the field of law as it affects insurance. It offers a detailed commentary on how the Form is to be construed, its coverage, the substantive law to be applied, the limits of liability, exceptions, and, of course, the procedures to be followed during arbitration proceedings in London. The book will prove invaluable to lawyers, risk managers, and executives of companies which purchase insurance on the Bermuda Form, and to clients, lawyers or arbitrators involved in disputes arising therefrom.

Applying a wider lens to the concept of political transition and employing a variety of theoretical and methodological approaches, the contributions gathered here explore residual political cultural practices that hinder democratic consolidation in Southern Africa. Presenting various case studies, the book tackles themes such as the military-political nexus, leadership renewal, constitutionalism, electoral politics, election violence, marginalization of women, civil society and political transition, media framing and transitional justice. Written from a multidisciplinary perspective and drawing on empirical data from multiple sources, this edited volume challenges orthodox conceptualizations of political transition. The book will be of interest to students and scholars of political science, African studies, and related fields, as well as policy-makers and professionals interested in the latest political developments in Southern Africa.

Available in PDF, EPUB and Kindle. Book excerpt: Historically, at English common law, the death penalty was mandatory for the crime of murder and other violent felonies. Over the last three decades, however, many former British colonies have reformed their capital punishment regimes to permit judicial sentencing discretion, including consideration of mitigating factors. Applying a comparative analysis to the law of capital punishment, Novak examines the constitutional jurisprudence and resulting legislative reform in the Caribbean, Sub-Saharan Africa, and South and Southeast Asia, focusing on the rapid retreat of the mandatory death penalty in the Commonwealth over the last thirty years. The coordinated mandatory death penalty challenges - which have had the consequence of greatly reducing the world’s death row population - represent a case study of how a small group of lawyers can sponsor human rights litigation that incorporates international human rights law into domestic constitutional jurisprudence, ultimately harmonizing criminal justice regimes across borders. This book is essential reading for anyone interested in the study and development of human rights and capital punishment, as well as those exploring the contours of comparative criminal justice.

Book excerpt: This volume brings together the most important articles, lectures, and essays of Van Vechten (Johnny) Veeder, a towering figure in the worlds of international commercial arbitration and arbitration between States and foreign investors. As noted by Judge Stephen Schwebel in his introduction to the volume, Johnny Veeder was unsurpassed as an arbitrator, tribunal chairman, expositor, analyst, and historian of international arbitration. The writings in this collection address a wide range of topics in the field, including the historical context of international arbitration and its influence on the modern-day practice, the role and responsibilities of the arbitrator, and the principles upholding international arbitration. The included works span the length of Johnny's career, drawing on his extensive learning and practical engagement. They analyse the past and present while asking prescient questions about arbitration's future in a changing global context. The reader of Johnny's essays and other contributions will profit by his extraordinary legal insight, and by the breadth and depth of his devotion to the arbitral process. The volume also gives a sense of his humanity, of his warmth and wit. Loved by his colleagues, his students, and indeed all those who came to know him, this volume is in celebration of the extraordinary achievements of this remarkable jurist, teacher, and human being.

Book excerpt: This paper considers the multi-faceted lessons of the Lesotho Highlands Water Project and how the project can serve as a model of mutually beneficial development, though demonstrating the benefits of a bilateral governmental cooperative approach in the development of an international river. These benefits include exceeding the impact of individual national approaches and strengthening political cooperation among all participants. This model is particularly relevant since approximately 40 percent of the world s population lives in transboundary river basins and more than 90 percent of the world s population lives within countries that share these basins.
