Book Synopsis The New Entrants Problem in International Fisheries Law by : Andrew Serdy
Download or read book The New Entrants Problem in International Fisheries Law written by Andrew Serdy and published by Cambridge University Press. This book was released on 2016-02-19 with total page 515 pages. Available in PDF, EPUB and Kindle. Book excerpt: Are international fisheries heading away from open access to a global commons towards a regime of property rights? The distributional implications of denying access to newcomers and re-entrants that used the resource in the past are fraught. Should the winners in this process compensate the losers and, if so, how? Regional fisheries management organisations, in whose gift participatory rights increasingly lie, are perceptibly shifting their attention to this approach, which has hitherto been little analysed; this book provides a review of the practice of these bodies and the States that are their members. The recently favoured response of governments, combating 'IUU' - illegal, unregulated and unreported - fishing, is shown to rest on a flawed concept, and the solution might lie less in law than in legal policy: compulsory dispute settlement to moderate their claims and an expansion of the possibilities of trading of quotas to make solving the global overcapacity issue easier.

Book Synopsis The State of World Highly Migratory, Straddling and Other High Seas Fishery Resources and Associated Species by : Jean-Jacques Maguire
Download or read book The State of World Highly Migratory, Straddling and Other High Seas Fishery Resources and Associated Species written by Jean-Jacques Maguire and published by Food & Agriculture Org.. This book was released on 2006 with total page 100 pages. Available in PDF, EPUB and Kindle. Book excerpt: Fisheries for highly migratory species are important in all oceans and semi-enclosed seas, except for polar regions. Fisheries for straddling fish stocks are much more localised, primarily occurring in a few regions where continental shelves extend beyond the 200 miles Exclusive Economic Zone (EEZ), while most fisheries for other high seas fishery resources are deep-water fisheries. This publication examines issues relating to the stocks of these resources, including information on their state of exploitation. Findings include that about 30 percent of the stocks of highly migratory tuna and tuna-like species, more than half of highly migratory oceanic sharks and nearly two-thirds of the straddling stocks and the stocks of other high seas fishery resources are overexploited or depleted. Although the stocks concerned represent only a small fraction of the world fishery resources, they are key indicators of the state of an overwhelming part of the ocean ecosystem which appears to be more overexploited than EEZs.

Book Synopsis The Action Plan for Australian Mammals 2012 by : Andrew Burbidge
Download or read book The Action Plan for Australian Mammals 2012 written by Andrew Burbidge and published by CSIRO PUBLISHING. This book was released on 2014-06-02 with total page 1053 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Action Plan for Australian Mammals 2012 is the first review to assess the conservation status of all Australian mammals. It complements The Action Plan for Australian Birds 2010 (Garnett et al. 2011, CSIRO Publishing), and although the number of Australian mammal taxa is marginally fewer than for birds, the proportion of endemic, extinct and threatened mammal taxa is far greater. These authoritative reviews represent an important foundation for understanding the current status, fate and future of the nature of Australia. This book considers all species and subspecies of Australian mammals, including those of external territories and territorial seas. For all the mammal taxa (about 300 species and subspecies) considered Extinct, Threatened, Near Threatened or Data Deficient, the size and trend of their population is presented along with information on geographic range and trend, and relevant biological and ecological data. The book also presents the current conservation status of each taxon under Australian legislation, what additional information is needed for managers, and the required management actions. Recovery plans, where they exist, are evaluated. The voluntary participation of more than 200 mammal experts has ensured that the conservation status and information are as accurate as possible, and allowed considerable unpublished data to be included. All accounts include maps based on the latest data from Australian state and territory agencies, from published scientific literature and other sources. The Action Plan concludes that 29 Australian mammal species have become extinct and 63 species are threatened and require urgent conservation action. However, it also shows that, where guided by sound knowledge, management capability and resourcing, and longer-term commitment, there have been some notable conservation success stories, and the conservation status of some species has greatly improved over the past few decades. The Action Plan for Australian Mammals 2012 makes a major contribution to the conservation of a wonderful legacy that is a significant part of Australia’s heritage. For such a legacy to endure, our society must be more aware of and empathetic with our distinctively Australian environment, and particularly its marvellous mammal fauna; relevant information must be readily accessible; environmental policy and law must be based on sound evidence; those with responsibility for environmental management must be aware of what priority actions they should take; the urgency for action (and consequences of inaction) must be clear; and the opportunity for hope and success must be recognised. It is in this spirit that this account is offered.
Book Synopsis Salt Water Neighbors by : Ted L. McDorman
Download or read book Salt Water Neighbors written by Ted L. McDorman and published by Oxford University Press. This book was released on 2009 with total page 415 pages. Available in PDF, EPUB and Kindle. Book excerpt: The United States and Canada are salt water neighbors on the Atlantic, Pacific and Arctic Oceans. Despite the general closeness of the political, economic and social relationship, the two States have approached their offshore areas from different perspectives. Canada has long supported expansion of exclusive national control over its adjacent offshore; whereas the United States has been concerned with the balance between national authority and international navigation rights. Canada has tended to view maritime disputes with the United States as local matters; whereas the United States has tended to see the disputes with Canada in global terms. Against this background, Salt Water Neighbor's examines both the international ocean law disagreements that exist between the United States and Canada respecting maritime boundaries, fisheries and navigation rights (e.g., the Northwest Passage) and the numerous cooperative bilateral arrangements that have prevented these disputes from being significant causes of friction between the neighbors. There has not been a comprehensive book-length study of United States-Canada international ocean relations since the early 1970s. Much has changed in the last 30 years. Most importantly, the law and the nature of the disputes between the two States have changed as a result of the adoption of 200 nautical mile zones in the late 1970s.

Book Synopsis Vessel-Source Pollution and Coastal State Jurisdiction by : Erik Franckx
Download or read book Vessel-Source Pollution and Coastal State Jurisdiction written by Erik Franckx and published by BRILL. This book was released on 2021-09-06 with total page 427 pages. Available in PDF, EPUB and Kindle. Book excerpt: After seven years of work, the Committee on Coastal State Jurisdiction Relating to Marine Pollution of the International Law Association concluded its work by submitting its final report for discussion at the occasion of the London conference, July 25-29, 2000. This book brings together the different official reports submitted by this Committee at the 1996 Helsinki, 1998 Taipei, and 2000 London conferences, as well as some preparatory documents necessary for the correct understanding of these just-mentioned reports. The Committee concentrated its work on vessel-source pollution and made it a central objective of its work to produce results which could facilitate the interpretation of the 1982 United Nations Convention on the Law of the Sea. During its work, it became moreover apparent that an accurate assessment of state practice proved more than once problematic either because of problems relating to interpretation or simply because the basic information was missing. For that reason, the present book contains a special section where different members of the Committee prepared detailed national reports, written according to a strict outline worked out for this purpose, in order to shed additional light on the specific issues dealt with by the Committee. Together with the conclusions arrived at by the Committee these additional national reports represent a valuable statement of the present-day status iuris questionis.
