This paper asks attention to some matters pertaining to the history of the Law School of Harvard College, which must necessarily partake somewhat of that character. I am impelled to this course by two publications, appearing near the same time in the month of October, - the first a short article in the American Law Review, relating to the School, and the other a report of the Committee of the Overseers to the Board, upon the same subject. I have not inquired who was the author of the article in the Review. The responsible parties are the editors of that periodical, which, in its Summary of Events, speaks in this wise: - "Harvard University. Law School. - For a long time the condition of the Harvard Law School has been almost a disgrace to the Commonwealth of Massachusetts. We say 'almost a disgrace, ' because, undoubtedly, some of its courses of lectures have been good, and no law school of which this can be said is hopelessly bad. Years immediately preceding or following, the lists being so marked as to distinguish the men of whom enough was already known from those in regard to whom information was sought. These lists were accompanied by a circular, explaining the lists, indicating the amount and kind of information wanted, and requesting a return of the lists, with such of the desired information as the recipient was able to give. This process was gone through with as to every man who left the School prior to 1873, and whose address had been obtained. More over, as often as a new address was obtained in this way of a man who left the School prior to 1873, a circular and lists were imme diately sent to him. Book excerpt: A history of Harvard Law School in the twentieth century, focusing on the school’s precipitous decline prior to 1945 and its dramatic postwar resurgence amid national crises and internal discord. By the late nineteenth century, Harvard Law School had transformed legal education and become the preeminent professional school in the nation. But in the early 1900s, HLS came to the brink of financial failure and lagged its peers in scholarly innovation. It also honed an aggressive intellectual culture famously described by Learned Hand: “In the universe of truth, they lived by the sword. They asked no quarter of absolutes, and they gave none.” After World War II, however, HLS roared back. In this magisterial study, Bruce Kimball and Daniel Coquillette chronicle the school’s near collapse and dramatic resurgence across the twentieth century. The school’s struggles resulted in part from a debilitating cycle of tuition dependence, which deepened through the 1940s, as well as the suicides of two deans and the dalliance of another with the Nazi regime. HLS stubbornly resisted the admission of women, Jews, and African Americans, and fell behind the trend toward legal realism. But in the postwar years, under Dean Erwin Griswold, the school’s resurgence began, and Harvard Law would produce such major political and legal figures as Chief Justice John Roberts, Justice Elena Kagan, and President Barack Obama. Even so, the school faced severe crises arising from the civil rights movement, the Vietnam War, Critical Legal Studies, and its failure to enroll and retain people of color and women, including Justice Ruth Bader Ginsburg.
