Book excerpt: While there have been many different studies on public inquiries, Royal Commissions and Public Inquiries in Australia provides the most comprehensive and up-to-date overview of public inquiries in Australia. It is based on rigorous and in-depth analysis spanning several decades, and has required patient and painstaking work in defining and identifying different federal public inquiries and monitoring their performance over the last 100 years. ROYAL COMMISSIONS AND PUBLIC INQUIRIES IN AUSTRALIA will be of interest to all who seek to better understand the particular role of public inquiries and what their continued appointment tells us about trends in Australian government generally.' From the Foreword by Professor John Wanna, The Sir John Bunting Professor of Public Administration, Australian National University. ROYAL COMMISSIONS AND PUBLIC INQUIRIES IN AUSTRALIA provides the first comprehensive overview of the extent, use and impact of Commonwealth public inquiries appointed since 1901. Specifically, this new book:* defines 'public inquiries,' and delineates them from other advisory bodies;* details trends in public inquiry numbers since Federation and compares these to overseas jurisdictions;* classifies the different types and forms of public inquiries;* explains public inquiry procedures, powers and associated legislation;* analyses why public inquiries are appointed and their roles in the political system;* assesses their impact on public policy; and,* explores the continuing and future roles of public inquiries. Covering public inquiries appointed by the Commonwealth government since Federation, particular attention is given to those public inquiries appointed during the last thirty years, when inquiry numbers increased markedly. References to numerous inquiries throughout the book are supplemented by detailed case studies of key public inquiries, including royal commissions and appointed by different governments. This authoritative book has been written by an expert in the field. Lecturer Dr Scott Prasser has worked in federal and state governments in senior policy and research advisory positions. ROYAL COMMISSIONS AND PUBLIC INQUIRIES IN AUSTRALIA will be a valuable reference for those interested in a widely used, but often neglected, advisory instrument of modern government that continues to influence many areas of public policy.

Book excerpt: "This timely and pertinent collection looks at the variety of questions involved in the operation of Commissions of Inquiry (CoIs). Traditionally existing as pure fact-finding bodies, in recent times the function of CoIs has arguably shifted and broadened so as to provide a form of legal adjudication. This shift in their application merits scrutiny and this edited collection of essays addresses institutional and procedural aspects of CoIs, as well as issues in regards to the application and interpretation of the substantative law applied to them. Essay topics include the relationship of CoIs with, and impact upon, traditional forms of adjudication, the influences of international law upon the work of CoIs, through to issues of procedural fairness. Drawing upon the expertise of scholars working within in the field, it offers an insightful and critical analysis of CoIs."--Résumé de l'éditeur.

Book excerpt: In Due Process and Fair Trial in EU Competition Law, Cristina Teleki addresses the complex relationship between Articles 101 and 102 of the Treaty on the Functioning of the European Union and Article 6 of the European Convention on Human Rights. The book is built around the idea that big business can threaten democracy. Due process and fair trial should be central to the process of addressing bigness through competition law, by safeguarding independent decision-making and judicial review and by preventing competition authorities from growing into administrative behemoths threatening democracy from inside. To show this, the book combines a comprehensive review of the case-law of the European Court of Human Rights with insight from economics, psychology and systems theory.

Book excerpt: Investigating Corruption and Misconduct in Public Office Second Edition provides accessible, authoritative and practical information about anti-corruption agencies. It discusses the substantive principles underpinning propriety and impropriety, public office and corruption. It complements this coverage with practical principles, techniques and strategies for investigating and preventing corruption. Upon its initial publication in 2004, this work quickly became a significant point of reference in relation to the laws, principles, jurisdictional structure and practical operation of anti-corruption legislation and agencies in Australia. This long-awaited Second Edition has been significantly restructured and updated. It reflects more than a decade of activity by commissions of inquiry and state-based crime commissions, and by governments legislating in relation to public integrity, public trust obligations, corruption offences, organized crime and other matters. Features include expert analysis of the common law, legislative schemes for public corruption investigation and prevention bodies (such as the ICAC), and detailed analysis of the powers, investigative processes, and methodologies of corruption investigation.

Book excerpt: The past two decades have witnessed the rapid proliferation of private military and security companies (PMSCs) in armed conflicts around the world, with PMSCs participating in, for example, offensive combat, prisoner interrogation and the provision of advice and training. The extensive outsourcing of military and security activities has challenged conventional conceptions of the state as the primary holder of coercive power and raised concerns about the reduction in state control over the use of violence. Hannah Tonkin critically analyses the international obligations on three key states - the hiring state, the home state and the host state of a PMSC - and identifies the circumstances in which PMSC misconduct may give rise to state responsibility. This analysis will facilitate the assessment of state responsibility in cases of PMSC misconduct and set standards to guide states in developing their domestic laws and policies on private security.

Available in PDF, EPUB and Kindle. Book excerpt: Human rights violations leave deep scars on people, societies, and nations. Since the early 1990s, international rights groups have argued that resolving the violence of the past through instruments of transitional justice such as truth commissions is a necessary condition for a peaceful future. But how can nations ensure that these tribunals are the best path to reconciliation? The Politics of Acknowledgement develops a theoretical framework of acknowledgement with which to evaluate truth commissions. Rather than applying this framework to successful tribunals, Joanna Quinn uses it to analyze the difficulties encountered and the ultimate failure of two poorly understood truth commissions in Uganda and Haiti. The failure of these commissions reveals that if reconciliation is to be achieved, acknowledgement of past violence and harm – by both victims and perpetrators – must come before goals such as forgiveness, social trust, civic engagement, and social cohesion.
