Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Practice of the Scottish Poor Law As a result of many conversations with Inspectors of Poor, Parish Councillors, and Parish officials generally, I have come to think that there is a real need for a little manual of Poor Law practice. Since the publication of Mr. Guthrie Smith's classic book some forty years ago, nothing of this kind has been attempted. It is true that Mr. Graham, in a most valuable work on Poor Law, has collected all the Acts and decisions, and linked them together with lucid notes. But Mr. Graham necessarily dwells on the strictly legal side of his subject. To one engaged in active Poor Law work, the practice appeals more strongly than the law, and accordingly the present book is more a manual of practice than any of its predecessors. In dealing with the law of Settlement and Recourse, I have endeavoured, as far as possible, to express the law in the form of general propositions, and have avoided argument upon debatable points. I have not set for myself any high aim, as I know that many Inspectors of Poor, from long experience, and from native shrewdness, have acquired such a mastery of the law of Settlement that one must not expose the weak places in his armour to the shafts of their criticism. But I am hopeful that Assistant Inspectors, Inspectors of the smaller parishes who may not have all the authorities at command, and especially new Inspectors, may find my notes useful. An attempt has also been made to render the book more useful to students, and more interesting to intelligent readers of all classes, by indicating with greater fulness than had been done in the former edition, the sources from which the law of Scotland has derived those characteristics in which it differs from that of England. The historical account of the office of Sheri ', the article on the Court of the Lord Lyon, that on Litigation by the Poor, and other portions of the work as it now stands, are entirely new. Book excerpt: Excerpt from Practice of the Criminal Law of Scotland I have now the satisfaction of laying before the Public the Second and concluding Part of ray undertaking, which embraces all that is treated of in the last Volume of Mr Hume's Commentaries, with the great additions made to those branches of the Criminal Law, by the numerous statutes which have been passed, and the extended practice which has taken place since the first publication of that valuable Work. Many subjects there discussed at length, have, from the change of the times, now in a great degree gone into desuetude; while other branches have swelled out, from the multiplication of decisions, to a very considerable extent. It will be found, accordingly, that nearly one half of the present Volume is occupied with the subjects of Indictment and Parole Proof; the two branches of Criminal Law which are most frequently the subject of practice. But notwithstanding this great increase of these subjects, I hope that the other Chapters contain every thing that is of utility in business, in the present state of our Criminal Jurisprudence. Book excerpt: Excerpt from Observations on the Management of the Poor in Scotland: And Its Effects on the Health of the Great Towns If these assertions were to be held as established, it might very fairly be maintained, that in this manner our duty to our poor brethren would be both most efficiently, and (what is, no doubt, with many the chief recommendation of the system) most cheaply performed. But it is quite Obvious, that, in order to release the people of this or any other Christian country from the obligation so precisely and emphatically laid down in Scripture, of clothing the naked and feeding the hungry, it is necessary that those assertions should not only be made, but be distinctly proved, in the only way in which such an assertion can be proved, viz. By experience; and that the burden of proof rests on those who contend for this interpretation (certainly different from the direct and literal meaning) Of those memorable words of Scripture. Book excerpt: Excerpt from A Handbook of Prescription According to the Law of Scotland This little volume is based throughout upon the late Mr. Napier's copious and exhaustive Commentaries on the Law of Prescription, a work which must always be valuable as a repository of profound learning and ingenious argument, but which would, perhaps, have possessed greater practical utility had it been somewhat less diffuse. Many cases bearing upon the subject of Prescription have been decided during the forty years that have elapsed since Mr. N apier's book was published; and to most of these it is hoped that reference will be found in the following pages.
