Book excerpt: Excerpt from The Law of Pleading, Vol. 1: In Civil Actions and Defenses Under the Code Also Practice in Appeal and Error; With Numerous Forms and Precedents (With Special Reference to the Ohio Code) In introducing this work the writer has no apology to offer, except that members of the bar have frequently sug gested the need of a new book on pleading. The subject is one of the most important in the whole category of the law, and yet the actual preparation of pleadings is not always attended with that care and technical precision so essential. Book excerpt: Excerpt from The Law of Pleading and Evidence in Civil Actions, Arranged Alphabetically, Vol. 1: With Practical Forms; And the Pleadings and Evidence to Support Them IT is some years since the Editor commenced the preparation of this Second Edition. He found that the variou's and important changes in the Law which had taken place, and the large accumulation of reported cases since the publication of the First Edition, rendered the labour much greater, and increased the bulk of the work much more, than was anticipated. Hence the delay which has occurred in its publication. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from The Encyclopaedia of Pleading and Practice, Vol. 1: Under the Codes and Practice Acts, at Common Law, in Equity and in Criminal Cases The practicality of treating the whole body of substantive law in the form of an encyclopaedia has already been demon strated. It has been shown beyond doubt that there is great advantage and economy to be derived from having in one series of books practically all the law of general application. The present work is an attempt to do for pleading and practice what its prototype has done for substantive law. The difficulties of the work were recognized, but they have not proved insurmountable. Book excerpt: Excerpt from A Treatise on Pleading, and Parties to Actions, Vol. 1 of 3: With Second and Third Volumes, Containing Precedents of Pleadings, and an Appendix of Forms Adapted to the Recent Pleading and Other Rules, With Practical Notes The utility of a work of this description must depend on the mode in which the subject is arranged, the correctness of the positions supported by legal decisions, for selections of the best authorities, and the facility of access or means of a full and accurate Index. To these points, therefore, I have endeavored to pay attention, and, besides the Reports which I have consulted, the reader is frequently referred to the Digests and Elementary writers. Indeed, it was impracticable to write on the subject upon which the authors alluded to had touched, without occasionally finding some parts pre-occupied, and the matter so ably treated of as to leave it open to me to do little more than enlarge upon, and arrange such parts of the subject according to my own plan. When this has occurred, I have con ridered that it would be the most candid mode of acknowledging the assistance I have derived from these works, and at the same time most useful to the profession, if, in the notes, I referred to those eu thors, in addition to the reported decisions, sanctioning my own view of the subject by the weight of their authority. Book excerpt: Excerpt from Practice, Pleading and Forms in Actions Both Legal and Equitable, Vol. 1 of 3: Forms in Actions, in Special Proceedings, in Provisional Remedies, and of Affidavits, Notices, Etc., Especially Adapted to the Practice in the States of California, Oregon, Nevada and the Territories In the preparation of this work my object has been to present to the profession the chief requisites of good pleading, with forms adapted to the modern practice, accompanied by numerous authorities sustaining them. With this object in view, I have commenced at the first inquiry made by the practitioner, in bringing or defending an action, and have advanced with him step by step in the prosecution or defense of the same giv ing as far as possible within the scope of this work, the law relative to the pleadings and practice, with the forms necessary for use, to the final disposition of the cause. Although the forms given are specially adapted to the practice in California, Nevada, and Oregon, and the territories on the Pacific slope, yet, with rare exceptions, they are equally applicable in New York and nearly all of the other States of the Union.
