Book excerpt: Excerpt from The Law and Practice Appertaining to Originating Summons: With Forms Having regard to the number and importance of the applications now made to the Chancery Division of the court by Originating Summons, it has been thought that a separate treatise on that branch of the law would be acceptable to the Profession. As the subject is essentially one in which the practitioner must often resort to the Rules of the Supreme Court bearing thereon, the method adopted in the present work is mainly that of annotation, though separate chapters on certain portions of the subject are also given. Part I. deals with Originating Summonses generally, including Order LV. Part II. comprises the statutory jurisdiction other than that referred to in Order LV., rule 2, and treats of Originating Summonses under the Vendor and Purchaser Act, 1874, the Conveyancing Act, 1881, the Settled Land Acts, the Married Women's Property Act, &c. Appendices I. and II. contain a few rules and forms which could not conveniently he inserted in the body of the book, and Appendix III. contains the authors' forms of Originating Summons, affidavits, statements of facts, &c.
