Book excerpt: The Criminal Justice Review Group was set up in June 1998, under the Belfast Agreement, to undertake a wide-ranging review of the criminal justice system (excluding aspects relating to policing and emergency legislation). Its report in March 2000 made 294 recommendations for change. The purpose of this Bill is to implement a number of these recommendations, in the light of consultation on the draft proposals. The main provisions of the Bill relate to: changes to the judiciary and courts in Northern Ireland; the appointment of the Attorney General for Northern Ireland after devolution, and to establish a public prosecution service; to establish a Chief Inspector of Criminal Justice, and a Northern Ireland Law Commission; proposals for the youth justice system, including extending its application to 17 year olds; disclosure of information about release of offenders to victims of crime; and measures in relation to community safety. It also makes some minor changes to legal aid and civil legal procedures.

These reforms are in light of the Government's commitment to repeal Part VII of the Terrorism Act 2000 (which supported the Diplock system where certain terrorist offences were tried without a jury) by July 2007. The Bill also includes provisions to extend the powers of the Northern Ireland Human Rights Commission; to give additional powers to the police and military in relation to powers of entry, search and seizure; and to establish a permanent system for regulation of the private security industry in Northern Ireland.

Book excerpt: In safeguarding national security the Government produces and receives sensitive information. This information must be protected appropriately, as failure to do so may compromise investigations, endanger lives and ultimately lessen its ability to keep the country safe. The increased security and intelligence activity of recent years has led to greater scrutiny including in the civil courts, which have heard a growing numbers of cases challenging Government decisions and actions in the national security sphere. Such cases involve information that under current rules cannot be disclosed in a courtroom. The UK justice system is then either unable to pass judgment and cases collapse or are settled without a judge reaching any conclusions. This green paper aims to respond to the challenges of how sensitive information is treated in the full range of civil proceedings. It looks for solutions that improve the current arrangements while upholding the Government's commitment to the rule of law. It also addresses the need for public reassurance that the national security work is robustly scrutinised, and that the scrutinising bodies are credible and effective. The proposals in this consultation are in three broad areas: enhancing procedural fairness, safeguarding material and reform of intelligence oversight.
