Book Synopsis Equality and Public Policy by : Paul Chaney
Download or read book Equality and Public Policy written by Paul Chaney and published by University of Wales Press. This book was released on 2011-01-31 with total page 235 pages. Available in PDF, EPUB and Kindle. Book excerpt: Equality of opportunity is a contested concept. It evokes strong emotions from proponents and opponents alike. Enduring issues of inequality and discrimination mean that it remains at the forefront of political priorities in the twenty-first century. Traditional analyses tend to focus on developments at the level of the unitary state or European Union. In contrast, this book underlines the salience of multi-level governance and offers the first detailed comparative analysis of contemporary efforts to promote equality of opportunity in the wake of constitutional reform in the UK. It presents a summary of social theory on equalities in relation to gender, and a full range of social groups and identities - such as disability, ethnicity, sexual orientation and age. It outlines the contemporary evidence base relating to patterns and processes of inequality in the 'devolved' nations. A 'governance perspective' is also advanced; one that details how constitutional law establishing the devolved legislatures contains equality clauses that enable and empower government to promote equality in public policy and law. Analysis reveals the development of distinctive regulatory structures and equalities policy lobbies in each territory. Overall, this volume charts the development of divergent legal rights and public policy on the promotion of equality in the wake of constitutional reform in the UK. Notwithstanding ongoing challenges, it is argued that the move to quasi-federalism is significant for it marks a shift from the predominant, centralised administration of social policy witnessed throughout the twentieth century, to divergent approaches designed to address contrasting socio-economic patterns and processes in Wales, Scotland and Northern Ireland.

Book Synopsis Tribal Constitutionalism by : Kirsty Gover
Download or read book Tribal Constitutionalism written by Kirsty Gover and published by OUP Oxford. This book was released on 2010 with total page 300 pages. Available in PDF, EPUB and Kindle. Book excerpt: Recognized tribes are increasingly prominent players in settler state governance, but in the wide-ranging debates about tribal self-governance, little has been said about tribal self-constitution. Who are the members of tribes, and how are they chosen? Tribes in Canada, Australia, New Zealand and the United States are now obliged to adopt written constitutions as a condition of recognition, and to specify the criteria used to select members. Tribal Constitutionalism presents findings from a comparative study of nearly eight hundred current and historic tribal constitutions, most of which are not in the public domain. Kirsty Gover examines the strategies adopted by tribes and states to deal with the new legal distinction between indigenous people (defined by settler governments) and tribal members (defined by tribal governments). She highlights the important fact that the two categories are imperfectly aligned. Many indigenous persons are not tribal members, and some tribal members are not legally indigenous. Should legal indigenous status be limited to persons enrolled in recognized tribes? What is to be done about the large and growing proportion of indigenous peoples who are not enrolled in a tribe, and do not live near their tribal territories? This book approaches these complex questions head-on. Using tribal membership criteria as a starting point, this book provides a critical analysis of current political and sociolegal theories of tribalism and indigeneity, and draws on legal doctrine, policy, demographic data and tribal practice to provide a comparative evaluation of tribal membership governance in the western settler states.

Book Synopsis Grandparents and the Law by : Samantha M Davey
Download or read book Grandparents and the Law written by Samantha M Davey and published by Bloomsbury Publishing. This book was released on 2023-05-18 with total page 253 pages. Available in PDF, EPUB and Kindle. Book excerpt: Should grandparents have rights in relation to their grandchildren? If so, what should the content of those rights be, both procedurally and substantively? And what is the appropriate role of the law in providing solutions to problems arising in the context of grandparents' rights? This book considers these questions from both a public and a private law perspective, and analyses the human rights implications for parties such as children, parents and grandparents. It also explores the topic of grandparents' rights in the context of the European Convention on Human Rights and the United Nations Convention on the Rights of the Child, as well as in other jurisdictions, such as Iran, France and Nepal. The book argues that grandparents' rights have so far received insufficient acknowledgement and, consequently, that relationships between grandparents and grandchildren have received insufficient protection. However, it is crucial that the protection of grandparents' rights is balanced with the rights of parents and the rights and welfare of children; the book considers how best to achieve this, for example in disputes on child arrangements (i.e. residence and contact), child protection matters and in adoption cases. The book is of particular interest to all academics seeking a clear framework for the protection of grandparents' rights in private and public law proceedings.
