At the same time, a goal of this study was to examine whether state and district policies hinder or support the academic achievement of English Language Learners in classrooms. Latinos comprise the majority of California's school age population. At the same time, they have the lowest graduation rate and highest dropout rate for students in high schools. The education of Latino English Language Learners (ELLs) must be a priority for educators and lawmakers. The Common Core State Standards require students to use academic language while actively participating in classroom discussions and take the same standardized assessments as their English speaking peers. On the other hand, The English Learner Master Plan requires students with the same English proficiency level to be placed in classrooms together all day for the entire school year. Based on the findings of this study, it is recommended that English speaking role models are needed in order for ELLs to gain English language skills and academic vocabulary. Therefore, keeping low-level ELD students in classrooms with peers of the same English proficiency level does not increase academic achievement. The Structured English Immersion (SEI) classrooms do not support the academic language and vocabulary of ELLs. The ELL students need other English speaking role models such as ELD 5s, Reclassified Fluent English Proficient (RFEP), Initially Fluent English Proficient (IFEP), and English Only (EO) students to demonstrate the correct grammar and academic English.

It then focuses on the efforts of Florida, California, Texas, and New York--the four states with the largest population of ELLs in schools--to use their state-level accountability systems and the No Child Left Behind (NCLB) mandate to implement and refine policies designed to support ELLs at the high school level. Book excerpt: As the United States continues to be a nation of immigrants and their children, the nation's school systems face increased enrollments of students whose primary language is not English. With the 2001 reauthorization of the Elementary and Secondary Education Act (ESEA) in the No Child Left Behind Act (NCLB), the allocation of federal funds for programs to assist these students to be proficient in English became formula-based: 80 percent on the basis of the population of children with limited English proficiency1 and 20 percent on the basis of the population of recently immigrated children and youth. Title III of NCLB directs the U.S. Department of Education to allocate funds on the basis of the more accurate of two allowable data sources: the number of students reported to the federal government by each state education agency or data from the American Community Survey (ACS). The department determined that the ACS estimates are more accurate, and since 2005, those data have been basis for the federal distribution of Title III funds. Subsequently, analyses of the two data sources have raised concerns about that decision, especially because the two allowable data sources would allocate quite different amounts to the states. In addition, while shortcomings were noted in the data provided by the states, the ACS estimates were shown to fluctuate between years, causing concern among the states about the unpredictability and unevenness of program funding. In this context, the U.S. Department of Education commissioned the National Research Council to address the accuracy of the estimates from the two data sources and the factors that influence the estimates. The resulting book also considers means of increasing the accuracy of the data sources or alternative data sources that could be used for allocation purposes.

The methods for educating English learners have proven to be complex. The key issues concerning the education of English learners include language policy and how it impacts instructional pedagogy, student outcomes and school accountability (Espinoza & Ochoa, 1992; Gádara et al., 2003; Gay, 2000; Hakuta, 1995, Nieto, 2001, 2002, 2003; Rumberger & Gádara, 2004; Sleeter, 2005). The research question addressed in this dissertation asks: How is language policy used by California public schools to address the spirit of state and federal language mandates while providing educational access to English learners? Federal court cases Lau vs. Nichols (1974) and Castañeda vs. Pickard (1981), California state Proposition 227 (1997), and the federal education policy that mandates accountability based performance measure, No Child Left Behind (2001), inform the policy aspect of this research. This study examined how California public schools have provided educational access to English learners in relation to pedagogy, student outcomes, and school accountability. The pedagogical elements examined included the teacher's value for students, curriculum, and instruction, along with students' language and achievement outcomes. A case study approach (Yin, 2003) of five California schools was implemented to examine how schools provide educational access to English learners. The selected schools in this study implemented distinct instructional language and had varying school achievement levels. Classroom observations, focus groups, interviews, and trend data analysis were used to conduct a comparative analysis of the case studies results. Triangulated approaches were used to verify and support the patterns and trends in the findings. This study found that (1) NCLB influenced the enactment of subtractive biliteracy language policy, (2) rigorous primary language instruction did not prevent students from reaching English proficiency, and (3) schools with high English learners' English achievement levels created classroom conditions for critical student engagement. The significance of this study was to contribute to the understanding of effective language policies and educational pedagogy to further improve the conditions and practices that positively impact educational access for English learners.

The book features analyses of: the legal context and parameters of SEI; research history on SEI; SEI language policy and policy implementation according to situated context; and the educational priorities and legal rights of ELs. The book examines the history of SEI in the educational research literature and as it has been interpreted in the context of the legal requirement for schools to take “appropriate action” to meet the needs of ELs following the historic Lau v. Nichols (1974) court decision.
