Book excerpt: Pre-trial publicity can result in juror bias, memory errors, and biased perceptions, leading to issues within trials and jury deliberation. It is nearly impossible to avoid due to media and that publicity having multiple outlets to share information. Multiple methods have been researched in their ability to reduce the effects of PTP, but only minimally. Past research has found that PTP increases the likelihood of a guilty verdict and exposure to it will decrease the chance of a fair trial with impartial jurors. This study examines how negative PTP regarding specific people affects the predicted length of deliberation, rate of guilty verdicts, and predicted confidence in final decisions. A total of 106 participants were recruited for this study, with an average of 26 participants in each of the four conditions. Participants were recruited through a campus-wide email blast. The survey consisted of demographic questions, article summaries pertaining to the defendant, victim, both, or crime in general, and an edited video of the NJ vs. Bias trial. Participants then completed a survey containing questions about the verdict they believed they would choose, the verdict they believed the jury would choose, their confidence in those decisions, whether they believed the PTP affected their decisions and would affect the jury's decision, and whether PTP should be limited or restricted before and during trials. There were no significant results for predicted deliberation times, predicted jury verdicts, individual decisions, or confidence ratings between any PTP exposure conditions. Results of this study do not indicate that PTP regarding different subjects has significant effects on juror decisions and predicted jury verdicts. However, changes to exposure time and retention intervals could potentially yield different results if a similar study is performed again in the future. Future research should focus on creating more real-world jury simulations in order to gain a greater understanding of PTP's effects and how to mitigate them.

Book excerpt: The present study examined the influence that a juror's first impressions of an expert witness might have on two outcomes: judgments of the witness' credibility, and verdict decisions in a criminal case involving a Not Guilty by Insanity (NGRI) defense. This was the first study to use "thin slice" methodology to manipulate time exposed to expert testimony and assess reliability of witness credibility ratings over time. This study also examined the degree to which these impressions influence the relationship between juror opinions and jury decision-making. A 2 (non-deliberating vs. deliberating jury) X 3 (observing 30 seconds, 5 minutes, or 10 minutes of expert witness testimony) between subjects design was implemented. Participants (N = 188, 30 mock juries) viewed a videotaped presentation of testimony from an actor portraying a forensic mental health professional called on by the defense. Mock juror characteristics, responses to a thought listing measure, and transcriptions from the videotaped jury deliberations were coded for exploratory analysis. Primary results, obtained via Hierarchical Linear Mixed Modeling to account for the random effect of group, were supported by jury-level analysis. Despite support for the accuracy of "thin slice" judgments in the literature, results found that jurors in the 30 second condition judged the expert as significantly less credible in this study. Results did not support the anticipated leniency shift in juries post-deliberation, and instead, yielded a significant two-way interaction on verdict for the 30 second group, such that non-deliberating jurors were more lenient than deliberating jurors. Implications for understanding how impressions of expert witness testimony translate from the juror to the deliberation room are discussed, with particular attention to cases with an increased likelihood of bias against the NGRI defense.

Book excerpt: The purpose of this study was to investigate the ways in which juror beliefs and attitudes about Deoxyribonucleic Acid (DNA) evidence impact juror decision making and verdicts. Accordingly, this study utilized a mock jury trial that included a deliberative phase to examine the impact of juror attitudes and beliefs about DNA evidence on juror pre- and post-deliberation verdicts. After reviewing a written trial summary, 91 male and female jury-qualified adults were selected to participate as research jurors on eight 12-person juries and deliberate a case via the Internet. Following deliberations via a private Internet chat room, jurors were then assessed for their beliefs about DNA evidence and the personality variable of authoritarianism. Limitations in data analysis from this initial study led to the decision to conduct a second study. Participants in Study 2 included 72 male and female jury-qualified adults who agreed to take part as research jurors on six 12-person juries and deliberate a criminal case on the Internet. Three regression analyses examined whether beliefs about DNA evidence, authoritarianism, gender, race/ethnicity, and pre-deliberation/no pre-deliberation were significant predictors of post-deliberation verdicts and change in post-deliberation verdicts. No significant predictors of post-deliberation verdict of change in post-deliberation verdict were found. However, additional findings from exploratory direct entry logistic regression analyses revealed that (a) non-Asian jurors who rendered pre-deliberation verdicts were more likely to vote guilty post-deliberation, and (b) married, Catholic, Republican jurors with positive beliefs about DNA evidence were more likely to change their verdict preference post-deliberation. Implications of the present study for forensic practice as well as for future research on the effect of jurors' beliefs about DNA evidence outcomes are discussed.

Book excerpt: Although expert psychological testimony it is not present in every trial, it has the potential to greatly influence the outcome of trials when it is used. As such, it is important to understand factors that influence how jurors receive psychological testimony. Yet before expert testimony is presented, an attorney must hire the expert. This process of selection requires further scrutiny, as it is possible that persuasive and qualified experts never make it before a jury. Gender is a factor that has the potential to bias both jurors and attorneys despite being unrelated to expert qualifications. This study examined whether expert sex impacts juror and lawyer perceptions of expert credibility, as well as whether this perceived credibility is impacted by the gendered nature of the crime in question. It was hypothesized that lawyers who found experts more credible, or believe the jury will perceive them as more credible, would be more likely to use them. It was further presumed that jurors who believe an expert to be more credible might be more persuaded by the expert's testimony. Results indicated that the most salient characteristic presented in the case vignettes was neither the expert sex nor the gender of the defendant, but rather the circumstances of the crime committed. There was some indication the gendered nature of the crime interacted with the gender of the defendant to influence expert credibility, but this effect was independent of the expert's sex.
