Book excerpt: Excerpt from The History of the Law of Prescription in England: Being the Yorke Prize Essay of the University of Cambridge for 1890 The Yorke Prize in the University of Cambridge is offered annually for the best essay upon some branch of the Law of Property in various countries. This was the successful essay for 1890. The essay as sent in comprised a history of Limitation, since that is included in Prescription in the wider sense in which it is used by some writers. But, as I have explained, I do not consider that it properly is Prescription. This view is shared by the examiners, and that part has with their assent been omitted. There is no book definitely upon Prescription in English Law; the information has to be collected from the various sources where it lies hid. The books I have found most useful have been Brooke's, Rolle's, Bacon's and Viner's Abridgments, Comyn's and Cruise's Digests, Coke upon Littleton and the Institutes, and the notes and references to the Year-books and reports therein contained. Two branches of the subject have been fully and ably dealt with by modern writers: that of Commons by Mr Joshua Williams, and that of Easements by Messrs Gale and Goddard in their well-known books. Accordingly, though it was necessary, for the sake of completeness, to say something about both Commons and Easements, I have treated both those subjects in a most cursory manner. But I have in both cases examined the original authorities for myself; and upon several points I have ventured to differ from Mr Goddard. The legal profession, its education, its functions, and its literature are examined, and the impact of printing upon legal learning and the role of case-law in comparison with law-school doctrine are addressed. The volume then considers the law itself. Criminal law was becoming more focused during this period as a result of doctrinal exposition in the inns of court and occasional reports of trials. After major conflicts with the Church, major adjustments were made to the benefit of clergy, and the privilege of sanctuary was all but abolished. The volume examines the law of persons in detail, addressing the impact of the abolition of monastic status, the virtual disappearance of villeinage, developments in the law of corporations, and some remarkable statements about the equality of women. The history of private law during this period is dominated by real property and particularly the Statutes of Uses and Wills (designed to protect the king's feudal income against the consequences of trusts) which are given a new interpretation. Leaseholders and copyholders came to be treated as full landowners with rights assimilated to those of freeholders. The land law of the time was highly sophisticated, and becoming more so, but it was only during this period that the beginnings of a law of chattels became discernible. There were also significant changes in the law of contract and tort, not least in the development of a satisfactory remedy for recovering debts.

As part of this plan, the FDA asked the National Academies of Sciences, Engineering, and Medicine to convene a committee to update the state of the science on pain research, care, and education and to identify actions the FDA and others can take to respond to the opioid epidemic, with a particular focus on informing FDA's development of a formal method for incorporating individual and societal considerations into its risk-benefit framework for opioid approval and monitoring.
