There was need for a collation of authorities on the Law of Trade-Marks and kindred matters; and that need was felt, not only by owners of applied symbols of manufacture and commerce, but also by bench and bar alike. No comprehensive treatise on those matters could be found in any tongue. Judicial rulings of many countries had to be consulted, and general principles of world-wide interest to be deduced therefrom. Wonder not, therefore, that much of the matter was crude, and sometimes merely theoretical. It is probable that no other branch of legal science has had a more rapid growth during the twelve years since the first edition appeared. For that reason, this book had, for the greater part, to be rewritten. Within that time, nearly all civilized nations have shown a due appreciation of the importance of the subject. This is within the experience of every practitioner whose practice takes in a number of circuits. The Patent Office, following the courts, refuses to grant patents for small improvements. The objection that an alleged improvement is a "mere mechanical expedient not involving invention" is now often raised against devices which a few years ago would have been patented without objection. The manufacturer who knows that his wares are better than similar goods made by others believes there must be some reason for it. He thinks he is entitled to recognition for the improvement he has made. This recognition he finds it more and more difficult to get by means of the patent law, although the statute has not been changed in any important particular for more than thirty years. While the courts have been restricting patents, they have come to recognize more clearly the right of the honest producer to his business reputation, and the duty of the Government to protect the people from fraud. Hence trade-mark protection has grown more valuable, and there is a very evident disposition in the courts to protect this class of property. The writer, who has devoted more than twenty years to patent practice, as an examiner in the U. S. Patent Office, and as a practitioner before the Office and expert in the courts, has of late been constrained to advise many clients to devote less attention to patents for minor improvements, and more to maintaining their business reputation, as they may do under the trade-mark law. In England the value of trade-mark protection, under the "Statute of Monopolies," has long been recognized. More than five times as many marks are registered in England as in the United States. The importance of trade-mark protection is not yet fully realized in America. Most American manufacturers have some distinguishing mark by which their goods are known. Too often they are careless about the use of their marks, or about infringement. In adopting a now mark the manufacturer should be careful that it is original, appropriate, and not too nearly like that of a competitor. Sub sequently Great Britain, Tunis, the Dominican Repub lic, Norway, and Sweden signed the Convention and final Protocol. (the Republic of Salvador withdrew August 17 The United States of America, with the advice and consent of the Senate on March 27, 1887, adhered to the Convention and final Protocol of 1883. (austria-hungary joined the Union subject to parliamentary approbation.) It is necessary to explain why our Nation never heartily co - operated in the general plan intended to unite all countries as one family in commercial rela tions. Our patent system was the stumbling-block. It was found that it was imperilled by too much con cession, the same difficulty which caused Great Brit ain to virtually withdraw. There was a general desire to disentangle trade-marks from the objects of the International Union. Thereupon resulted the Arrangement of April 14, 1891, adopted by the Conference at Madrid, providing for International Registration of trade-marks. The sys tem for central registration was a promising step. It was to take account of the differences existing between the laws of the several countries, especially of the necessary facts preliminary to registration in the places of origin; of the unequal terms of protection granted in different countries; and the publication of regis tered marks in all countries where protection was to be afforded. Although nominally a member of the Union, our country never became so in the fullest sense. The proclamation of our President reads thus: And whereas the President of the United States of America. Book excerpt: Excerpt from Patents, Copyrights, and Trade Marks The Patent Laws of the United States are founded on Art. 1, 8 of the Constitution, which says: The Congress shall have power to promote the progress of science and useful arts by securing for limited times to authors and inventors the exclusive right to their respec tive writings and discoveries. In accordance with this delegation of power, Congress has enacted laws giving to authors and inventors the exclusive control of their writings and discoveries. This exclusive control is not given to them because an inventor has any moral right to prevent others from enjoying the fruits of his new ideas, but because it was recognized that, by giving him the exclusive control of his invention for a short period, the arts would be encouraged, the public would obtain the right to enjoy the invention after that period, and the prosperity of the country would be increased thereby. That these results have been accomplished is evident. Morse would probably not have struggled to produce the telegraph, nor Eli Whitney to produce the cotton gin, Goodyear would not have gone through years of abject poverty in order to accomplish the successful vulcanization of rubber, Edison would probably not have given to the world the incandescent electric light, nor Bell the tele phone, without the hope of a reward, - and these are only a few of the many inventions which have been the result of years of experiment and which have made this country the manufacturing center of the world. This reward is not, however, given to the inventor for his mere production of the new thing. The Govern ment enters into a contract with him, and gives him a patent in consideration of his disclosing the invention inhis patent in such full, clear, concise, and exact terms as to enable any person skilled in the art or science to which it appertains or with which it is most nearly connected, to make, construct, compound and use the same, to the end that the public may be able, at the expiration of the limited time, to reproduce and enjoy the invention. Book excerpt: Excerpt from The Law of Trade-Marks: The Trade-Marks Ordinance, 1909; The Merchandise Marks Ordinance 1890 of Hongkong In Japan, laws relating to the registration and protection of trade-marks have been expressly made; the most recent law on the subject having been passed on the 2nd April, 1909. By this law the fraudulent imitation of a registered trade-mark is made a criminal offence, punishable by penal servitude but it is provided that a foreigner who has not his domicile, or his place of business Within the Empire, may not enjoy trade-mark rights, or rights: connected therewith, except Where it is otherwise provided in treaties, or in conventions, agreements, exchange of notes, or other arrangements of a similar nature thereto. (art. XXII.) Thus, apparently, a trade-mark may be infringed with impunity in Japan if its owner has not his domicile, or place of business, in that country; and if no treaty, convention, or other arrangement, has been made with Japan which provides for his obtaining protection for his trade-mark there. Where such treaty, convention, or other arrangement, exists, the provisions apply of Art. XII of the Patent Law of Japan. Which is expressly incorporated in the Trade Marks Law, and whereby it is provided that a person who is not within the Empire cannot apply for a patent (or for registration of his trade-mark) or make any demands, or take any other steps, or assert his patent (or trade-mark) rights, or his rights in connection with a patent (or trade-mark), unless he does it through an agent who has his domicile or residence within the Empire. The provisions of Section 103 of the Act of 1883 with regard to international arrangements for protection of trade-marks, &c., were, by Order in Council, applied to Japan in 1899; but, as yet, no special arrangement has been made with Japan respecting trade-marks registered in Hongkong. It was, however, provided by Article XVII of the Treaty of 1894 between Great Britain and Japan as follows The subjects of each of the High Contracting Parties shall enjoy in the dominions and possessions of the other the same protection as native subjects in regard to patents, trade-marks and designs, upon fulfilment of the formali ties prescribed by law. And, by Article XIX, it was further provided that the stipulations of that Treaty should be applicable, so far as the laws permit, to all the British Colonies and possessions, except certain specified Colonies, amongst which exceptions Hongkong was not included. It gives far greater protection against unfair practices used in competition than is realized by the average business man. It is still in its infancy. Its possibilities of growth and effectiveness are almost unlimited. It started by regulating only one unfair practice, viz: substitution, or the act of offering or selling one brand of goods when the buyer has asked for another brand. To-day its principles are being applied to most commercial practices that are unfair, or, as the French law terms it, disloyal. The rules of Unfair Competition are not arbitrary pronounce ments of courts. The formulation of these rules has been an almost spontaneous process, growing out of the discussion and decision of cases where injustice and wrong have been suffered because of the use of oppressive and unfair methods of competi tion.
