Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from International Law and the Great War My aim in the present work is to give a systematic account, from the point of view of international law, of most of the questions and incidents that have so far arisen in the Great War. Since the beginning of last August international law has been subjected to severe trials. I have endeavoured to ascertain to what extent it has emerged from its ordeals inviolate, to what extent homage has been honourably paid to it, in what respects it has suffered hurt and its behests have been disregarded. The number of violations that we have to examine is large. Indeed, so many have been committed, that it seems as though the whole fabric of international law has been demolished, and the sacred law of humanity - to which it is indissolubly joined - rejected and spurned. But, happily, not all the belligerents have contributed to bring about this deplorable result. For we shall find that nearly all the infractions of law are to be laid to the account of Germany. It is obvious, therefore, that in an undertaking of this kind I must necessarily pay considerable attention to the theories of the law of war and of international law in general advanced by German writers, to the views held in German military circles, and, especially, to the practices of the German forces in this unparalleled conflict. Book excerpt: Excerpt from The Development of International Law After the World War In accordance with its original character, this book offers only a survey of the future problems of international law. In this work I have given merely some directing outlines. I have been obliged to forgo entering upon the individual problems here, since this would have claimed materially more space and also more time. But I also believe that m the present hour it 18 above all necessary to call to mind once more the fundamental tendencies in the development of international law. The problems to be solved for international law in the future are neither simple nor small in number. We may rejoice if, upon the conclusion of peace, we succeed in obtaining an agreement on the basic principles. The future work will, however, take decades. Book excerpt: Excerpt from Elements of the International Law and Laws of War This abridgment has been prepared at the suggestion of a number of professors and instructors in our colleges and higher institutions of learning. The experience of our officers, both volunteers and regulars, in the great civil war which has just terminated, has proved that this subject has been too much neglected, not only in our colleges, but also in our two great national schools - the Military and Naval Academies. An attempt is here made to supply a suitable text-book for such instruction. The plan of the larger work has been closely followed, the chapters are the same, and only a few of the paragraphs have been changed. Therefore, the instructor or student who may desire to further investi gate any particular question, has only to turn to the corresponding chap ter and paragraph of the larger edition, and to refer to the authorities there quoted. It should be remembered that these authorities are not quoted in support of the author's opinions, but are often in con ict both with those Opinions and with each other. Many basic principles and rules that governed and still govern relations between states were introduced and elaborated in the great peace treaties from the Renaissance onwards. Nevertheless, until recently few scholars have studied these primary sources of the law of nations from a juridical perspective. In this edited collection, specialists from all over Europe, including legal and diplomatic historians, international lawyers and an International Relations theorist, analyse peace treaty practice from the late fifteenth century to the Peace of Versailles of 1919. Important emphasis is given to the doctrinal debate about peace treaties and the influence of older, Roman and medieval concepts on modern practices. This book goes back further in time beyond the epochal Peace of Treaties of Westphalia of 1648 and this broader perspective allows for a reassessment of the role of the sovereign state in the modern international legal order.

Available in PDF, EPUB and Kindle. Book excerpt: This book deals with the history and future of the concept of ‘world peace through law’ (WPTL), which advocates replacing the use of international force with the global rule of law. WPTL calls for replacing war with the global rule of law by arms reductions, including the abolition of nuclear weapons, global alternative dispute resolution mechanisms, and various enforcement mechanisms. This book sets forth a three-part proposal: 1) arms reductions – primarily the abolition of nuclear weapons, with necessarily concomitant reductions in conventional forces; 2) a four-stage system of global alternative dispute resolution (ADR), utilizing both law and equity; 3) adequate enforcement mechanisms, including a UN Peace Force. The core of this proposal is alternative dispute resolution mechanisms—international ADR. International ADR would consist of a four-stage process of compulsory negotiation, compulsory mediation, compulsory arbitration., and compulsory adjudication by the World Court. The fundamental proposition of this book is that the use of alternatives to war, global ADR, is the ultimate solution to the problem of peace. The full implementation of WPTL will entail a vast array of progressive initiatives on many fronts, including abolition of nuclear weapons, with the global rule of law being the capstone to all of these developments. This book will be of great interest to students of peace studies, arms control, international law, and world politics.

Book excerpt: Through a careful examination of religious and philosophical literature, the contributors to the volume analyze, compare and assess diverse Western, Islamic, Hindu and East Asian perspectives concerning the appropriate criteria that should govern the decision to resort to the use of armed force and, once that decision is made, what constraints should govern the actual conduct of military operations. In doing so, the volume promotes a better understanding of the various ways in which diverse peoples and societies within the global community approach the question of what constitutes the legitimate use of military force as an instrument of policy in the resolution of conflicts.

Book excerpt: Customary International Humanitarian Law, Volume I: Rules is a comprehensive analysis of the customary rules of international humanitarian law applicable in international and non-international armed conflicts. In the absence of ratifications of important treaties in this area, this is clearly a publication of major importance, carried out at the express request of the international community. In so doing, this study identifies the common core of international humanitarian law binding on all parties to all armed conflicts. Comment Don:RWI.

Available in PDF, EPUB and Kindle. Book excerpt: Though largely invisible in histories of the First World War, over??550,000 men in the ranks of the Indian army were non-combatants. From the porters, stevedores and construction workers in the Coolie Corps to those who maintained supply lines and removed the wounded from the battlefield, Radhika Singha recovers the story of this unacknowledged service. The labor regimes built on the backs of these 'coolies' sustained the military infrastructure of empire; their deployment in interregional arenas bent to the demands of global war. Viewed as racially subordinate and subject to 'non-martial' caste designations, they fought back against their status, using the warring powers' need for manpower as leverage to challenge traditional service hierarchies and wage differentials. The Coolie's Great War views that global conflict through the lens of Indian labor, constructing a distinct geography of the war--from tribal settlements and colonial jails, beyond India's frontiers, to the battlefronts of France and Mesopotamia.
