Book excerpt: A year ago, President Obama installed three recess appointments to the board while Congress was meeting regularly in pro forma session. A U.S. federal appeals court ruled in Noel Canning v. NLRB that these so-called recess appointments are unconstitutional. The power of the National Labor Relations Board (NLRB) affects almost every private workplace. The board has recently taken steps to skew the balance of power even further toward union leaders. For example, the board is making it increasingly difficult for employers to investigate possible misconduct and employee complaints. In Banner Health and Piedmont Gardens, the board restricted the ability to keep internal investigations confidential while allowing unions to obtain sensitive statements provided by witnesses. The board has also begun chipping away at the right of workers not to fund union lobbying. In 1988, the U.S. Supreme Court held in Communications Workers v. Beck that workers forced to pay union dues do not have to finance a union's political activities. The rights of workers, as well as the opinion of the nation's highest court, are being eviscerated by an activist labor board. Today's NLRB will go to great lengths to undermine employers, marginalize workers, and empower Big Labor.

Book excerpt: This article begins by noting the typical fear of unions by nonunion employers, a fear that traditionally results in various efforts -- both legal and illegal -- to prevent employees from achieving union representation. It focuses upon two unusual products of those efforts, two federal appellate decisions which -- rather than directly discouraging employees from joining unions -- make it difficult for most of them to even learn about their statutory rights to engage or not to engage in union-related activity. Those decisions -- each differently and uniquely premised -- invalidated a substantive rule of the National Labor Relations Board that would have required employers to post a government-supplied notice that informs employees at their workplaces about those rights. It is the author's opinion that because both of those decisions are grossly contrary to established canons of administrative law and settled NLRB case law and unambiguous statutory text, which the article demonstrates, failure to seek certiorari-review was a serious mistake. Their presence leaves a wake of confusion that raises a disturbing combination of questions under both labor and administrative law regarding the future of the canonical Chevron doctrine, which has long-governed the authority of federal agencies to construe their enabling statutes when those statutes are silent or ambiguous regarding the matter in issue. The matter here in issue is whether the Labor Board had the right to require the posting of the same type of governmental notice that commonly exists in most American workplaces, a notice that clearly complied with the Act's never-amended policy of encouraging collective bargaining and union representation.The article reviews the past and present features of NLRB substantive rulemaking, both generally and with reference to the invalidated rule, which is followed by detailed analyses of the two Opinions, revealing their cross-purposes with existing law. And finally, it identifies and describes a different but potentially effective new measure which, notwithstand the aforesaid decisions, will allow employees, in their workplaces, to engage in posted communications about their NLRA rights and other related communications. That measure is a proposed new workplace rule, the legal authority and workable features of which the author offers as an effective backfire emanating from the aforesaid two ventures in judicial obstructionism.

Book excerpt: This book explores the puzzling phenomenon of new veiling practices among lower middle class women in Cairo, Egypt. Although these women are part of a modernizing middle class, they also voluntarily adopt a traditional symbol of female subordination. How can this paradox be explained? An explanation emerges which reconceptualizes what appears to be reactionary behavior as a new style of political struggle--as accommodating protest. These women, most of them clerical workers in the large government bureaucracy, are ambivalent about working outside the home, considering it a change which brings new burdens as well as some important benefits. At the same time they realize that leaving home and family is creating an intolerable situation of the erosion of their social status and the loss of their traditional identity. The new veiling expresses women's protest against this. MacLeod argues that the symbolism of the new veiling emerges from this tense subcultural dilemma, involving elements of both resistance and acquiescence.
