Book excerpt: Fiqh is a subject that to some extent is being neglected these days with more concerted efforts taking place in the realm of aqidah (creed), and although it is undoubtedly pertinent that one learn what is permissible and not in relation to their beliefs, it is similarly important that the Muslims know what is permissible or otherwise in terms of their actions. The term fiqh is commonly translated as jurisprudence, yet the meaning of jurisprudence has been somewhat allusive to most people. Linguistically, the word fiqh means 'understanding' whereas the technical meaning applied to fiqh is that it is knowledge of the practical legal rulings derived from the detailed evidences. Of course, to many people such a classification will seem like technical legal jargon but it simply means that fiqh is knowledge of what is halal and haram in accordance with the Islamic sources of authority. The Hanbali school of legal thought was the last of the four major schools of thought to formulate its principles, and built upon the scholarship of Imam Ahmad ibn Hanbal it has survived and been practised for over a millennium. There were many periods in history when the Hanbalis numbered a handful, although today the school of thought seems to be making a resurgence. From amongst the long line of Hanbali scholars Muwaffaq-al-Din Abdullah ibn Ahmad ibn Muhammad ibn Qudama Al Maqdisi is amongst the most famous with his scholastic contributions making an impact on schools other than his own, not only in fiqh but also in aqidah. Having grown up in a religious family devoted to learning, he along with relatives would travel to Baghdad to seek knowledge already having benefitted from the scholars of Damascus (his own city) having moved there from Palestine. A contemporary of Salahuddin, he, along with his relatives took part in the great battle against the Crusaders which saw the end of their barbaric control of Jerusalem.

Book excerpt: This volume unfolds the ebbs and flows of Muslim thought in different regions of the world, as well as the struggles between the different intellectual discourses that have surfaced against this backdrop. With a focus on Turkey, Egypt, Iran and the Indian subcontinent – regions that, in spite of their particular histories and forms of thought, are uniquely placed as a mosaic that illustrates the intertwined nature of the development of Muslim socio-political thought – it sheds light on the swing between right and left in different regions, the debates surrounding nationalism, the influence of socialism and liberalism, the rise of Islamism and the conflict between state bureaucracy and social movements. Exploring themes of civil society and democracy, it also considers current trends in Muslim thought and possible future directions. As such, it will appeal to scholars across the fields of sociology, anthropology, political science, history and political economy, as well as those with interests in the study of religion, the development of Muslim thought, and the transformation of Muslim societies in recent decades.

Book excerpt: This book sets out how contemporary Iranian scholars have approached the Qurʾān during recent decades. It particularly aims to explore the contributions of scholars that have emerged in the post 1979-revolution era, outlining their primary interpretive methods and foundational theories regarding the reading of the Qurʾān. Examining issues such as the status of women, democracy, freedom of religion and human rights, this book analyses the theoretical contributions of several Iranian scholars, some of which are new to the English-speaking academy. The hermeneutical approaches of figures such Abdolkarim Soroush, Muhammad Mojtahed Shabestari, Mohsen Kadivar, Hasan Yousefi-Eshkevari, Abolqasem Fanaie and Mostafa Malekian are presented and then analysed to demonstrate how a contextualist approach to the Qu’ran has been formed in response to the influence of Western Orientalism. The effect of this approach to the Qu’ran is then shown to have wide-ranging effects on Iranian society. This study reveals Qu’ranic thought that has been largely overlooked by the West. It will, therefore. Be of great use to academics in Religious, Islamic and Qurʾānic studies as well as those studying the culture of Iran and the Middle East more generally.

Book excerpt: This book discusses the common principles of morality and ethics derived from divinely endowed intuitive reason through the creation of al-fitr' a (nature) and human intellect (al-‘aql). Biomedical topics are presented and ethical issues related to topics such as genetic testing, assisted reproduction and organ transplantation are discussed. Whereas these natural sources are God’s special gifts to human beings, God’s revelation as given to the prophets is the supernatural source of divine guidance through which human communities have been guided at all times through history. The second part of the book concentrates on the objectives of Islamic religious practice – the maqa' sid – which include: Preservation of Faith, Preservation of Life, Preservation of Mind (intellect and reason), Preservation of Progeny (al-nasl) and Preservation of Property. Lastly, the third part of the book discusses selected topical issues, including abortion, assisted reproduction devices, genetics, organ transplantation, brain death and end-of-life aspects. For each topic, the current medical evidence is followed by a detailed discussion of the ethical issues involved.

Book excerpt: Compilation Series: The Principles of Shari’ah: Texts and Materials is a solid, application-oriented text for students taking law subjects focusing on the Shari’ah matters. Many new features make this edition a richer and stronger learning resource for students. Several factors motivated the authors to write this book. After having the experience in legal field and teaching for more than 20 years, it became clear that there was a definite need for more detail materials in this area. In addition, there was need for a book which would give full recognition to an easier method and the authors felt it was time for a text which would develop the ideas and methods with this in mind. This book covers a thorough discussion of the development of Islamic Law in Malaysia. A major audience for the book will be students studying the law subjects. The order of topics, however, provides a degree of flexibility, so that the book can be of interest to different readers through basic concepts until the advanced concepts (i.e. the discussion of the areas in a very comprehensive manner). The purpose of this book is to take the readers on an introduction to the principles of Shari’ah by which the meaning of such subject at basic level is better understood. Hopefully, this book can be benefited by the readers in their journey to success.

Available in PDF, EPUB and Kindle. Book excerpt: 'This book presents an invaluable contribution to the debate on the compatibility of Islam and modernity. It is full of arguments and examples showing how Islam can be understood in line with modern life, human rights, democracy, the rule of law, civil society and pluralism. The three authors come from different countries, represent different gender perspectives and have a Shia, a Sunni and a non-Muslim background respectively which makes the book a unique source of information and inspiration.' Irmgard Marboe, University of Vienna, Austria This well-informed book explains, reflects on and analyses Islamic law, not only in the classical legal tradition of Sharia, but also its modern, contemporary context. The book explores the role of Islamic law in secular Western nations and reflects on the legal system of Islam in its classical context as applied in its traditional homeland of the Middle East and also in South East Asia. Written by three leading scholars from three different backgrounds: a Muslim in the Sunni tradition, a Muslim in the Shia tradition, and a non-Muslim woman the book is not only unique, but also enriched by differing insights into Islamic law. Sir William Blair provides the foreword to a book which acknowledges that Islam continues to play a vital role not just in the Middle East but across the wider world, the discussion on which the authors embark is a crucial one. The book starts with an analysis of the nature of Islamic law, its concepts, meaning and sources, as well as its development in different stages of Islamic history. This is followed by accounts of how Islamic law is being practised today. Key modern institutions are discussed, such as the parliament, judiciary, dar al-ifta, political parties, and other important organizations. It continues by analysing some key concepts in our modern times: nation-state, citizenship, ummah, dhimmah (recognition of the status of certain non-Muslims in Islamic states), and the rule of law. The book investigates how in recent times, more and more fatwas are issued collectively rather than emanating from an individual scholar. The authors then evaluate how Islamic law deals with family matters, economics, crime, property and alternative dispute resolution. Lastly, the book revisits certain contemporary issues of debate in Islamic law such as the burqa, halal food, riba (interest) and apostasy. Modern Perspectives on Islamic Law will become a standard scholarly text on Islamic law. Its wide-ranging coverage will appeal to researchers and students of Islamic law, or Islamic studies in general. Legal practitioners will also be interested in the comparative aspects of Islamic law presented in this book.
