Book excerpt: This volume examines the underlying foundations on which the European Union's counter-terrorism and police co-operation policies have been built since the inception of the Treaty on European Union, questioning both the effectiveness and legitimacy of the EU's efforts in these two critically important security areas. Given the importance of such developments to the wider credibility of the EU as a security actor, this volume adopts a more structured analysis of key stages of the implementation process. These include the establishment of objectives, both at the wider level of internal security co-operation and in terms of both counter-terrorism and policing, particularly in relation to the European Police Office, the nature of information exchange and the 'value added' by legislative and operational developments at the European level. It also offers a more accurate appraisal of the official characterisation of the terrorist threat within the EU as a 'matter of common concern'. In doing so, not only does it raise important questions about the utility of the European level for organising internal security co-operation, but it also provides a more comprehensive assessment of the EU's activities throughout the lifetime of the Third Pillar, placing in a wider and more realistic context the EU's reaction to the events of 11 September 2001 and the greater prominence of Islamist terrorism.

Exploring the current practices of European Union (EU) counter-terrorism policing, developed after 9/11, it highlights the current significant challenges to democratic legitimacy and seeks to present tools and solutions which ensure 'democratic' counter-terrorism actions and the protection of human rights. Counter-terrorism policing is now a global concern, with co-operation between security authorities of different countries a crucial feature in the fight to prevent terrorism and extremism. Yet, given the emphasis on pre-emption, this type of policing tends to interfere to a far greater extent with the rights of the individual than traditional policing. This book scrutinises the current focus of enhanced communication between counter-terrorist associates at member-state and EU levels within Europe, alongside analysis of just how far the traditional, protective mechanisms of accountability and oversight are managing to keep up with this development. It proposes that current forms of counter-terrorism policing within the EU should be understood as networks - sets of expert institutional nodes or individual agents, from at least two countries - that are interconnected in order to authorize and provide security with regard to counter-terrorism, using the European Police Office (Europol) as a key example.

European governments have also taken measures to enhance co-operation among themselves. Most notable are European Union efforts to enhance cross-border sharing of intelligence and police information, extend the reach of warrants, and strengthen external border controls. Also, immediately following the attacks, there was an unprecedented European co-operation with the US in fighting terrorism. However, by early 2002 the emphasis placed by the Bush Administration on military action beyond Afghanistan, and on strong support for the Sharon government in Israel in its conflict with Palestine, began to raise doubts among some Europeans about the overall US approach to counter-terrorism. Discussed in this book are the efforts that the different European countries are making in response to the new threat of terrorism, as well as the concern that by supporting the Unites States' approach to terrorism, they will inevitably be helping the US pursue broader and more controversial foreign policy goals.

This historical analysis covers both EU-internal and international counterterrorism policies and features an in-depth account of the EU’s reaction to the terrorist incidents in New York, Madrid and London. In the first few weeks after these incidents, the EU mobilised a complex but also incoherent set of policy measures, which significantly influenced the course of European security over the years. From a theoretical perspective, this volume argues that context-specific factors dominated over functionalist considerations in the EU’s fight against terrorism. Building on frameworks from public policy analysis, the author demonstrates that EU institutions played a critical role as policy entrepreneurs, while the many security measures were chosen on the basis of timing rather than significance. Such short-term political dynamics also explain the implementation deficits and persistent imbalances in the EU’s counterterrorism policy; limitations which still hinder its fight against international terrorism. This volume offers a critical analysis of the measures the European Union has taken to combat terrorism and how, in a number of key areas, EU counterterrorism policy is more of a paper tiger than an effective counterterrorism device. Several legal EU counterterrorism instruments have not been properly implemented at the national level and questions have been raised regarding their effectiveness, appropriateness, and proportionality. The capabilities of EU agencies in the area of counterterrorism remain rather weak and the EU Counterterrorism Coordinator does not have any real powers apart from persuasion. However, this does not mean that EU level action cannot offer any value-added in the fight against terrorism. There are several areas where the EU can provide genuine value-added in the fight against terrorism due to the transnational nature of the contemporary terrorist threat and the nature of a borderless Europe.

Book excerpt: This book celebrates the tenth anniversary of the Area of Freedom, Security and Justice (AFSJ) by bringing together the views of key practitioners and policy-makers who have played an outstanding role in thinking about and shaping EU policies on freedom, security and justice. Ten years ago, the member states transferred competences to the EU for law and policy-making in the fields of immigration, asylum and border controls, and began the transfer process for criminal justice and policing. This decade of European cooperation on AFSJ policies has experienced very dynamic convergence, the enactment of a large body of European law and the setting-up of numerous EU agencies working in these domains. Such dynamism in policy-making has not been without challenges and vulnerabilities, however. As this collective volume shows, the main dilemmas that lie ahead relate to an effective (while more plural) institutional framework under the Treaty of Lisbon, stronger judicial scrutiny through a greater role for national courts and the Court of Justice in Luxembourg, better mechanisms for evaluating and monitoring the implementation of EU AFSJ law and a more solid fundamental rights strategy. The contributions in this volume address the progress achieved so far in these policy areas, identify the challenges for future European cooperation in the AFSJ and put forward possible paths for making more progress in the next generation of the EU's AFSJ.
