Book excerpt: The Trade Agreement between the EU and Peru and Colombia has been provisionally implemented since the middle of 2013. However, based on limited secondary data available to date on its effects, this report shows that trade profiles have not been substantially altered. EU exports to Latin America are dominated by pharmaceuticals, machinery and vehicles, and have experienced very slight increases. Colombian exports to the EU have benefitted more than Peruvian exports from improved access, but oil and minerals remain the top exports. Fruit, vegetables, flowers and above all sugar cane and confectionaries have been the greatest beneficiaries of the tariff eliminations and reductions. Despite this lack of substantial change, the institutional arrangements and sub-committees created by the Agreement have been implemented. Civil society has also been involved in meetings of the Trade and Sustainability sub-committee, but resource and capacity constraints preclude smaller organisations from full participation in the process. Sadly, reports of the human rights situation in Colombia, in particular the plight of trade unionists, continue to be negative. Although the Government has made progress in legislative terms, the full implementation of measures at the local level remains incomplete and challenging.

Book excerpt: This study provides a comprehensive assessment of the EU Colombia-Peru Trade Agreement to assist the European Parliament in its deliberations. EU efforts to negotiate a region-to region agreement with the Andean Community (CAN) were not successful due to issues within the CAN. The agreement is in line with EU FTA policy in terms of content. Taken together with other EU agreements with South and Central America the Agreement is also consistent with an EU policy of strengthening trade and investment with regions of potential growth. There are small welfare effects from the agreement and trade benefits for the EU go mostly to the classic EU export sectors of machinery, transport equipment and services. The access to Colombia and Peru matches that and in some areas exceeds that provided in the US and Canadian agreements. The gains for Colombia and Peru are in fruit (especially bananas) and vegetables, but more importantly the Agreement ensures continued duty free access to the EU for Colombian and Peruvian exports. Many of the civil society criticisms of the Agreement have been addressed in the final text. The provisions on sustainable development are equivalent to the current practice in trade agreements. On the issue of human rights the Parliament will need to judge whether its consent for the Agreement is seen as a means of ensuring continued progress towards better implementation in the partner countries, or as condoning existing practices.

Book excerpt: Since 2013, the European Union (EU) has a Trade Agreement with Colombia and Peru in place, which Ecuador joined in 2017. The European Commission has commissioned a consortium led by BKP Economic Advisors to undertake an evaluation of the Agreement's implementation and impact. The evaluation was undertaken over the period April 2020 to January 2022 and analyses the economic, social and environmental, and human rights (including labour rights) effects which the Agreement has had since its application in the various Parties. In terms of evaluation criteria, it reviews the effectiveness, impact, efficiency, coherence and relevance of the Agreement and its implementation. It also comprises a number of case studies to illustrate or add detail to broader findings. The evaluation concludes that overall the Agreement has had a positive impact on all the Parties, although the magnitude of the impact is limited. Implementation has generally been efficient and effective with room for improvement in some areas, including the implementation of the trade and sustainable development provisions, more efforts to facilitate trade in services, investment and e-commerce/digital trade; enhancements in these areas could also ensure continued relevance and coherence of the Agreement with the global changes and EU policy developments that have taken place since the negotiation of the Agreement.

Book excerpt: The EU Central America Association Agreement is an example of the successful completion of a region-to-region agreement and therefore in line with the EU{OCLCbr#D0}’s aim of promoting regional integration in other regions through trade and association agreements. For the EU, economic welfare gains and employment effects from the trade chapter of the Agreement are because of the relative small size of the Central American market expected to be negligible. However, EU exporters will benefit from lower tariffs on manufactured goods especially in automobiles. For the Central American countries (CA), there is the potential of significant gains, but these are not evenly spread. The fact that CA exporters already benefited from zero tariffs on almost all exports to the EU under the extended Generalised System of Preferences (GSP+) means that there are relatively few sectors that will have enhanced access with the exception of bananas, raw cane sugar and shrimps. Above all, the Agreement will provide legally secure access to the EU market. The Agreement also tackles cross border services and establishment, technical barriers to trade (TBT), sanitary and phytosanitary (SPS) issues as well as trade remedies in the shape of anti-dumping, countervailing duties or multilateral safeguards. The provisions on intellectual property rights include Geographic Indications (GIs). The trade chapter furthermore contains a human rights clause which stipulates that the parties must ensure that human rights are respected within their jurisdiction. Furthermore there are provisions on sustainable development.

Belgium, France, Germany, Italy, Luxemburg and the Netherlands put their heavy industries under a common management, with the Coal and Steel Treaty, so no one could build weapons or develop its war industry without the others knowing it. This experience led to the Treaty of Rome in 1957 and 50 years later the ideas of people, goods and service freedoms continue spreading around, and the European Union has become one of the best examples of economical, political and cultural integration, and a reference around the world to encourage other regions to group. Therefore, among others, the Latin America Free Trade Association (LAFTA) appeared in 1960, the Association of Southeast Asian Nations (ASEAN), in 1967; the North American Free Trade Area (NAFTA), in 1991; and the Common Market for Eastern and Southern Africa (COMESA) in 1993. In the case of South America , in spite of their good intentions, the huge asymmetries between LAFTA members caused the apparition of sub-regional blocs: the Andeans Community (CAN) founded in 1969, and now grouping Bolivia, Colombia, Ecuador, and Peru; and the Southern Common Market (MERCOSUR) founded in 1991, between Argentina, Brazil, Paraguay and Uruguay. Nowadays, after more than 40 years of integration processes, there are still strong problems inside both sub-regional blocs. CAN Member States have several diplomatic discussions regarding their political models; and Peru, Ecuador and Colombia have or are negotiating independent Free Trade Agreements with external blocs, including USA and the EU. In the other side, MERCOSUR's main players -Argentina and Brazil- have commercial disputes at the World Trade Organization, surrounding their own sub-regional bodies . Nevertheless, these two sub-regional associations were the basis for the South American Community of Nations (CSN on Spanish) in 2004, and from that point, the present attempt to unify South-America: the South American Union of Nations (UNASUR, 2008), with the participation of Argentina, Bolivia, Brazil, Chile, Colombia, Ecuador, Guyana, Paraguay, Peru, Surinam, Uruguay and Venezuela. This setting makes both the negotiations themselves and the definition of the EU’s positions more complicated, raising the question as to what ultimately determines the EU’s behaviour in such complex negotiations spanning multiple of the EU’s policy areas. Offering a generalizable analytical model to study such complex EU international negotiations, the book illuminates the preferences and interactions between individual parts of the EU’s foreign affairs bureaucracy, and those between the lead actors, the Directorate General for Trade, and the European External Action Service (EEAS), in particular. In doing so, it demonstrates the utility of adapting the concept of bureaucratic politics from Foreign Policy Analysis (FPA) to the EU’s foreign policy decision-making apparatus across different stages of EU international negotiations. It also discusses how the institutional changes of the Treaty of Lisbon have altered the institutional set-up of the EU’s foreign affairs bureaucracy and thereby changed the foundations of the EU’s bureaucratic politics. Finally, the book finds that the EU’s behaviour in these negotiations is ultimately shaped, on the one hand, by the presence of diverging positions between its institutional actors, and the difficulty to bridge them through policy coordination mechanisms, on the other. Empirically, it explores these dynamics by considering the EU’s Association Agreement negotiations on the Latin American continent over the last twenty years before demonstrating the analytical model’s utility in the context of the EU’s negotiations with Ukraine and Japan.
