Available in PDF, EPUB and Kindle. Book excerpt: Intertemporal Linguistics in International Law examines and offers an overdue solution to a specific problem central to the resolution of an ever increasing number of international legal disputes: how to interpret a treaty with terms that change in meaning over time. A wide-ranging review of the relevant international case law and scholarship reveals that no rule, principle or authority of international law – including even the oft-cited evolutionary interpretation doctrine – provides international adjudicators with the firm and practical guidance on this specific question that contemporary international litigants demand. Using an analytical approach inspired by the comparative method and drawing on specific concepts from external fields including private law, legal theory and, principally, modern-day linguistics, Intertemporal Linguistics in International Law restructures the most relevant international case law around a new conceptual framework that offers fresh insight into the process of treaty interpretation. It demonstrates that by distinguishing between resolving ambiguity and resolving vagueness, and by identifying the temporal sense-intention with which a treaty term is used, international adjudicators can avail themselves of a more predictable and appropriate method for solving this complex and practically important problem of international law.

Book Synopsis The Shapes of Knowledge from the Renaissance to the Enlightenment by : D.R. Kelley

This book was released on 2012-12-06 with total page 254 pages. Available in PDF, EPUB and Kindle. Book excerpt: The original idea for a conference on the "shapes of knowledge" dates back over ten years to conversations with the late Charles Schmitt of the Warburg Institute. What happened to the classifications of the sciences between the time of the medieval Studium and that of the French Encyclopedie is a complex and highly abstract question; but posing it is an effective way of mapping and evaluating long term intellectual changes, especially those arising from the impact of humanist scholarship, the new science of the seventeenth century, and attempts to evaluate, to apply, to reconcile, and to institutionalize these rival and interacting traditions. Yet such patterns and transformations cannot be well understood from the heights of the general history of ideas. Within the ~eneral framework of the organization of knowledge the map must be filled in by particular explorations and soundings, and our project called for a conference that would combine some encyclopedic (as well as interdisciplinary and inter national) breadth with scholarly and technical depth.
Book Synopsis English Literary Criticism by : J. W. H. Atkins
Download or read book English Literary Criticism written by J. W. H. Atkins and published by Routledge. This book was released on 2021-05-18 with total page 341 pages. Available in PDF, EPUB and Kindle. Book excerpt: Originally published in 1947, this volume reviews the critical achievement at the Renaissance. It discusses the ideas of literature then current in England, as revealed in contemporary theorizing and judgments. The period has sometimes been dismissed as lacking great critics, and the critical works themselves have been described as elementary and remote, but, as this work shows, viewed in the light of what came before and after, those texts will be found to be of considerable interest and possess intrinsic and historical value. This book charts the course of the movement and the main findings and their significance in critical history. There is an emphasis to show the part payed by the medieval tradition, with its inheritance of post-classical and patristic doctrine; the lead given by 15th Century Italian and other Humanists and the no less important attempts of independent native writers to work out new artistic and dramatic theory of their own.

Book Synopsis Transformative Change in Western Thought by : Ingo Gildenhard
Download or read book Transformative Change in Western Thought written by Ingo Gildenhard and published by Routledge. This book was released on 2017-07-05 with total page 688 pages. Available in PDF, EPUB and Kindle. Book excerpt: This groundbreaking volume maps the shifting place and function of marvelous transformations from antiquity to the present day. Shape-shifting, taking animal bodies, miracles, transubstantiation, alchemy, and mutation recur and echo throughout ancient and modern writing and thinking and continue in science fiction today as tales of gene-splicing and hybridisation. The idea of metamorphosis lies in uneasy coexistence with orderly world views and it is often cast out, or attributed to enemies. Augustine and the church fathers consider shape-shifting ungodly; Enlightenment thinkers suppress alchemy as unscientific; genetically-modified wheat and stem-cell research are stigmatised as unnatural. Yet the very possibility of radical transformation inspires hope just as it frightens. A provocative, theorising, trans-historical history, this book ranges across classics, literature, history, philosophy, theology and anthropology. From Homer and Ovid to Proust and H. P. Lovecraft and through figures from Proteus to Kafka's Fly and toSpiderman, four historical surveys are combined with nine case studies to show the malleable, yet persistent, presence of transformation throughout Western cultural history.
