Available in PDF, EPUB and Kindle. Book excerpt: This book examines the development of the English patent system and its relationship with technical change during the period between 1660 and 1800, when the patent system evolved from an instrument of royal patronage into one of commercial competition among the inventors and manufacturers of the Industrial Revolution. It analyses the legal and political framework within which patenting took place and gives an account of the motivations and fortunes of patentees, who obtained patents for a variety of purposes beyond the simple protection of an invention. It includes the first in-depth attempt to gauge the reliability of the patent statistics as a measure of inventive activity and technical change in the early part of the Industrial Revolution, and suggests that the distribution of patents is a better guide to the advance of capitalism than to the centres of inventive activity. It also queries the common assumption that the chief goal of inventors was to save labour, and examines contemporary criticism of the patent system in the light of the changing conceptualisation of invention among natural scientists and political economists.

Book excerpt: The British Patent System during the Industrial Revolution 1700–1852 presents a fundamental reassessment of the contribution of patenting to British industrialisation during the eighteenth and nineteenth centuries. It shows that despite the absence of legislative reform, the British patent system was continually evolving and responding to the needs of an industrialising economy. Inventors were able to obtain and enforce patent rights with relative ease. This placed Britain in an exceptional position. Until other countries began to enact patent laws in the 1790s, it was the only country where inventors were frequently able to appropriate returns from obtaining intellectual property rights, thus encouraging them to develop the new technology industrialisation required.

Book excerpt: Excerpt from The Temple Primers: The English Patent System In the first place, and before treating in detail the present day law, a brief history of patents from the Middle Ages to the dawn of the twentieth century will be given. As the natural sequence, exposition of modern policy in relation to patents can follow. The jurisprudential side of patents and the rights conferred thereby can next claim attention, after which a few legal considerations that bear upon the commercial value of patents may be touched upon. Available in PDF, EPUB and Kindle. Book excerpt: In recent years, business leaders, policymakers, and inventors have complained to the media and to Congress that today's patent system stifles innovation instead of fostering it. But like the infamous patent on the peanut butter and jelly sandwich, much of the cited evidence about the patent system is pure anecdote--making realistic policy formation difficult. Is the patent system fundamentally broken, or can it be fixed with a few modest reforms? Moving beyond rhetoric, Patent Failure provides the first authoritative and comprehensive look at the economic performance of patents in forty years. James Bessen and Michael Meurer ask whether patents work well as property rights, and, if not, what institutional and legal reforms are necessary to make the patent system more effective. Patent Failure presents a wide range of empirical evidence from history, law, and economics. The book's findings are stark and conclusive. While patents do provide incentives to invest in research, development, and commercialization, for most businesses today, patents fail to provide predictable property rights. Instead, they produce costly disputes and excessive litigation that outweigh positive incentives. Only in some sectors, such as the pharmaceutical industry, do patents act as advertised, with their benefits outweighing the related costs. By showing how the patent system has fallen short in providing predictable legal boundaries, Patent Failure serves as a call for change in institutions and laws. There are no simple solutions, but Bessen and Meurer's reform proposals need to be heard. The health and competitiveness of the nation's economy depend on it.

Book excerpt: This is a comprehensive reference book which describes the development of the United Kingdom patent system from its beginnings, over 400 years ago, to the present day. British patent law is a comparatively little known subject but one of great fascination, being concerned with inventions, with history, and with the use of language. It is also of great importace because the granting of patents has proved to be the most realistic way of encouraging people to make inventions and exploit them commercially. This book provides a reliable account of the main features of British patent law and practice, tracing their evolution one by one. Many details of patent procedure, including fees, are tabulated and a full list of patents acts, rules and other publications is included.

Book excerpt: Excerpt from The Industrial and Commercial Influence of the English Patent System While many works deal fully with patents in their legal aspect, and to a less extent with their history, there is none, so far as the writer is aware, in which they have been treated with equal fulness on the economic side. At the same time the references to patents in treatises on Economics are of the scantiest. This little book is offered as a contribution towards making good the deficiency. Since the higher claims of the inventor are not referable solely to economic considerations, it is unavoidable that in a purely economic discussion of patents the interests of the inventor should appear to some extent to be subordinated to those of the manufacturer.
