Canon Law, which is the code of rules elaborated by the collective wisdom of the past under the guidance of the Holy Ghost, endeavours to show within the range of cases which come under its cogni sance, how truth may be elicited from the observed facts, and how justice may be combined with mercy, so that what is right and equal may be done between each indi vidual member and the whole Body of the Church. Available in PDF, EPUB and Kindle. Book excerpt: WE all do err at times, and by God's grace may be raised up again and restored to newness of life. Yet is the Body of Christ Holy, and the aim of all its institutions is that its members may be sanctified through the truth. Thus even that machinery, which at first sight seems to have least to do with personal holiness, is found to be really most designed to promote that holiness. For as it is ever difficult in this world to fathom the heart and to gauge the moral guilt of sin in each particular case, so to do this generally (so far as that is possible) from a public or Church point of view is the hardest task of all. And this is the business of Canon Law, which not only seeks to regulate the organisation and the several duties of office within the Church, but also aims at controlling the administration thereof by distinguishing what is due to the individual and what is due to the Body as a whole. For as "we being many members are one Body and everyone members one of another, H so "if one member suffer, all the members suffer together," and if one member wilfully indulge in sin the type of holiness is lowered for all Moreover, sin is sometimes the outcome of general weakness in face of strong temptation, and requires the kindly help of others to be successfully overcome; whilst in other cases sin is wilful, and to tolerate it is to do harm to all the rest. Canon Law, which is the code of rules elaborated by the collective wisdom of the past under the guidance of the Holy Ghost, endeavours to show within the range of cases which come under its cognisance how truth may be elicited from the observed facts, and how justice may be combined with mercy, so that what is right and equal may be done between each individual member and the whole Body of the Church This work was written prior to the codification of Canon Law in 1917. It is valuable to the student of Canon Law, because Canon Law was not changed in 1917, but codified and brought into an organic whole. The interpretation and understanding of law relies on the traditional understanding throughout history.

Book excerpt: Excerpt from The New Canon Law: A Commentary and Summary of the New Code of Canon Law For several months past the articles by Father Stanislaus Woywod in the Ecclesiastical Review have informed the clergy of the most important features of the new Code of Canon Law. The same author now gives to the public a Summary and Commentary of the whole Code. As the present volume is published mainly with a view of the needs of the clergy engaged in the care of souls, the bulk of the book has been kept as compact as possible; wherefore in such places only where explanation and comment seemed necessary they have been given, and in as brief a form as possible. Chapters which are not needed by every priest have been mentioned only with few words and en passant, as it were. The fourth and the fifth Book have been summed up very briefly, giving the most important points of legislation contained therein. A very complete Index will make it easy to find any desired point of law. We heartily congratulate Father Woywod on the good work and trust that the clergy of the United States will be pleased to find in this volume a welcome means of acquiring the necessary knowledge of the new legislation of the Church. It contains all that the average priest should know, more than our Sisterhoods need to know, and much that will interest the laity on the laws of the Church. On most subjects the points of the law are scattered through the Code. By gathering these points under their respective heads and arranging them in alphabetical order, with reference to canon, paragraph, and number in the Code, this manual aims to be a clear, intelligent counsellor in the ordinary affairs of Catholic life, and a ready index to the Code for questions that require a knowledge of the niceties of ecclesiastical law. Book excerpt: Excerpt from Marriage Legislation in the New Code of Canon Law It comes, too, at an opportune moment. Tragic events of today, the bitter fruit of four centuries of lax thinking among non-catholic schoolmen and proportionately lax living among their disciples, have shown that the ethical order must be refashioned in the ancient Christian pattern if the race of men is to sustain itself even physically, the more so if there is to be real moral advancement. The world will not come back to Christ, nor be made subject to His reign by any influence the world itself may initiate; the impulse must be from without - the force must come from above. The Church of Christ, which is not of this world, must bring from on high the heavenly grace that will heal the nations. Her mis sion is to teach, her remedy for the world's distemper is primarily the imparting of the form of sound words. It is evident that we are in the midst of a general movement for the broader introduction of purely ecclesiastical elements into the civil law, creating not indeed a civil establishment of religion, but more and more of a legal establishment of church.
