Identity theft is one such crime. It is the fastest growing type of fraud in the United States; in 2008 about 9.9 million Americans were reportedly victims of identity theft, an increase of 22% from the number of cases in 2007. In addition, the Federal Trade Commission (FTC) estimates that it costs consumers about $50 billion annually. Identity theft is often committed to facilitate other crimes such as credit card fraud, document fraud, or employment fraud, which in turn can affect not only the nation's economy but its security. Consequently, in securing the nation and its economic health, policymakers are also tasked with reducing identity theft and its impact. Congress continues to debate the federal government's role in (1) preventing identity theft and its related crimes, (2) mitigating the potential effects of identity theft after it occurs, and (3) providing the most effective tools to investigate and prosecute identity thieves. With respect to preventing identity theft, one issue concerning policymakers is the prevalence of personally identifiable information?and in particular, the prevalence of social security numbers (SSNs)-in both the private and public sectors. One policy option to reduce their prevalence may involve restricting the use of SSNs on government-issued documents such as Medicare identification cards. Another option could entail providing federal agencies with increased regulatory authority to curb the prevalence of SSN use in the private sector.

Recently, the World Privacy Forum issued a report on medical identity theft, noting that it was the least studied and the worst documented of all identity theft crimes. There has been much speculation as to why medical identity theft is considered a dangerous crime, even though it is the most unrecognizable of all identity theft crimes. Unfortunately, there are not as many laws and regulations addressing medical identity theft as financial identity theft. However, in 2012, the Ponemon Institute conducted a study on the number of individuals who experienced medical identity theft. The study was one of the first national studies that focused on medical identity theft in the United States. The purpose of the study was to get an understanding of how medical identity theft has affected the victims and how medical identity theft differs from identity theft. The primary goal of medical identity theft was to obtain medical goods or services through a combination of identity theft and health care fraud. In order for medical identity theft to occur, the victims must have both their financial and medical information compromised. Research shows that the elderly are the primary victims of medical identity theft. The reason is that they receive Medicare and Medicaid. The purpose of this research is to examine why a growing and serious crime such as medical identity theft has not received the same degree of national media coverage as financial identity theft and why there are few resources offered for its victims, particularly the elderly. In addition, this paper will explore how the government can resolve this issue with the current laws and regulations. Unfortunately, further research is needed to enable the government to take responsibility and to raise public awareness about medical identity theft. An evaluation was conducted on the current federal responses to this epidemic and included an assessment of the Health Insurance Portability and Accountability Act, Heath Information Technology for Economic and Clinical Health Act, and The Red Flag Rules. Research included statistics from multiple studies that were reviewed and compared with each other to determine the adequacy of each policy in reducing and preventing medical identity theft. The researcher specifically investigated the impact of breach notification laws within the policies, electronic health records, and the affect of medical identity theft on victims. Research revealed a majority of the public was unaware of medical identity theft and the laws that protect them. Additionally, the public does not know how to determine whether they have been a victim and steps to take to remedy the problem. Overall medical identity theft appears to be under-researched and under-documented. More education and training needs to be incorporated within future legislation. Further research is needed to determine how well current legislation reduces and prevents medical identity theft as the legislation is fairly new. Lastly, a better understanding regarding medical identity theft will lead to earlier detection and better risk management.
