Fishing Industry, Vol. 2: Present Condition and Future of Marine Fisheries The fishery laws, generally, could be improved with some reorganization, recodification, and clarification. First, Congress might consider reorganizing and recodifying most of the fishery laws under one title of the United States Code. While many of the laws are now in title 16, many others are scattered throughout other titles titles 15 and 46) of the Code. Either title 15 or title 16 would be a logical place for the fishery laws. Of course, there are laws that per tain to fisheries that also pertain to other matters and would be best left in place. Fisheries laws, when revised and recodified, should be separated from wildlife laws and from shipping laws. Fish conservation appears to be different from wildlife conservation and properly should be treated separately. Likewise, it might be helpful to separate fish - related laws from general shipping laws. In such areas as research and financial assistance to the fishing industry, consolidation of the laws would also be beneficial. Further, in recodifying the laws, the powers and the duties and responsibilities of the Secretary of Commerce could be clearly defined to reflect the transfer of functions under Reorganization Plan No. 4 of 1970. For example, 16 u.s.c. §742h, which lists a variety of Fish and Wildlife Reports to be made by the Secre tary of the Interior, has been changed by the Reorganization Plan. The statute does not reflect this change except for a note at the end of the provision that does not help define the functions transferred to the Secretary of Commerce without reference to the Reorganization Plan itself, and this does not, in all cases, completely clarify matters. A provision of law like section 742h could be divided into two separate statutes - one designating wild life reports required of the Secretary of the Interior and the other designating fish reports required of the Secretary of Com merce. The eat-vessel value (amount paid to fishermen) of the Pacific Coast landings represented about 21 percent of the total value of the United States catch in 1958. In recent years the fishing industry of the West Coast and other sections of the United States has been faced with unsatisfactory prices for may of its products. This situation has resulted from increased operating costs, expanded competition from imported fishery products, and competition from other food products. Overinvestment in boats and gear has added to the industry's difficulties. Problems of maintaining quality control have pyramided. Fishermen have ranged farther from port in order to reach better fishing grounds. They have remained at sea for longer periods of time so as to maximize catches while operating under restrictive fishing regulations. The growing need for research into the economic and other problems confronting the fishing industry resulted in the passage of the Saltonstall Kennedy Act of 1994. The Act makes funds available for marketing, consumption, and production research (including biological studies) for the industry. Re search funds are administered by the United States Fish and Wildlife Service of the Department of the Interior. The Service has contracted with various firms, institutions, and agencies to conduct certain phases of the research contemplated under the Act. This study was completed under contract between the Fish and Wild life Service and Oregon State College. Its purpose was to investigate the marketing and consumption of fresh, frozen and cured fishery products on the Pacific Coast. The West Coast was considered an appropriate area for study because of the relatively low per capita consumption of fish in that area. Estimates indicate the consumption there to be only slightly above the national average. In contrast, consumption in some coastal areas of the North Atlantic States is much greater than the national average. When Bulletins became a necessity for the record of important enquiries, it was intended to gather together a few of the earlier papers showing the origin of what was, at first, a mere investigation into the existing fishery industry of the Presidency started in view to obtain data for assisting the development of the indigenous industry. For various reasons, however, the issue of No. I was delayed while several contemporaneous Bulletins were issued with later numbers, and as the work of investigation developed No. I fell into oblivion. But since Government now desire its issue and since administrative and industrial changes are imminent, the belated Bulletin has been compiled, and advantage has been taken of the delay to make it, not a mere record of origin but, in a sense, a history of the development of the investigation into a Bureau or Department. Hence the Bulletin consists almost solely of original papers in whole or in extract, showing from 1905 to 1915 the changes and development of ideas, the proposals made from time to time, and the orders passed thereon.
