Book excerpt: In the early years of enforcement of antitrust and of State aid in Europe, given the integration objectives that the European Treaty pursues, fairness seemed the most natural standard to choose. In antitrust it took more than forty years to convince the Commission and the Courts of the soundness of the effect based approach. By enhancing the role of economic analysis, the objective of the 2005 State Aid Action Plan was to modernize State aid policy. Unfortunately the Commission did not go as far as suggesting that distortions of competition be noticeable before a State measure is declared incompatible. As a result, EU policy continues to be over extensive addressing cases where the distortions of competition are minimal. This is particularly the case for restructuring aid, where the effects of the aid on competition are hardly analyzed in the Commission decisions. In these cases the restoration of the healthiness of the firm is the final objective of the aid. However the Commission, while often authorizing the aid, tries to overcome moral hazard by attaching a number of very intrusive conditions to its authorization decisions (prohibition of reducing prices before a competitor does, introduction of capacity or sales caps, etc). These conditions reduce, not increase, the possibility of these companies to successfully restructure. Moral hazard can only be eliminated by not allowing the aid, not by constraining the company from competing. Finally when the anticompetitive effect of the aid is only indirect, restitution of the aid requires a very difficult calculation of the added value of the aid on the market equilibrium. A very complex calculation to be performed and hardly capable of being established by a Court. A new and different criterion should be devised for sanctioning indirect aid.

Book excerpt: This research aims to analyse the prohibition of State aid and compatibility assessments in the EU from the perspective of the 'more economic approach' (MEA). The hypothesis enunciated in the thesis is that the MEA in State aid is applied in an instrumental manner, which goes beyond the paradigm of control justified by the coordination of national policies and the reduction of distortions of competition. Hence, the shift takes place with regard to: (i) the definition of the aims of public intervention; and (ii) the methods of aid assessment. Firstly, by means of the MEA the Commission pursues a horizontal industrial policy, which presupposes a more pro-active approach and verification of the positive effects of aid, to the detriment of its negative effects. Secondly, the use of the MEA is policy driven - the Commission chooses the MEA to better regulate positive criteria for compatibility of aid, while avoiding applying refined economic analysis: (i) to the definition of aid; and (ii) to assess the magnitude of the negative effects of aid. The research conducted here is oriented around four horizontal lines: (i) conflict and complementarities between competition and industrial policy, based on the analysis of State aid rules; (ii) shift from negative to positive integration, which implies a transformation of State aid control and coordination into a State aid policy and has consequences for the aims and substantive criteria of the legal framework; (iii) a 'better regulation' of State aid by means of the MEA; (iv) the competence of the Member States versus the competence of the Commission in the State aid legal framework.

Given its novelty, the ex post evaluation seeks to provide evidence on how effective state aid has been, on whether state aid distorted competition, and on the implications for state aid design and implementation. These aspects are fundamental to improving the efficiency of public spending and minimizing market distortions. The ex post evaluation focuses on three state aid schemes to assess whether and to what extent the aid objectives have been fulfilled, and it measures their spillover effects as well as the effects on competition outcomes. Selected based on the their importance in supporting key policy objectives, their design and complexity, and the instruments used, the three schemes include de minimis aid implemented by the Romanian Counter-Guarantee Fund and designed to incentivize access to finance for micro, small, and medium enterprises (MSMEs); state aid granted by the Ministry of Public Finance to support regional development and job creation; and state aid provided by the Ministry of European Funds to support the upgrade and modernization of research, development, and innovation. The analysis finds evidence that the state aid schemes met their objectives without distorting competition significantly. The results for the de minimis scheme to incentivize access to finance for micro, small, and medium enterprises showed that the scheme increased employment and turnover of beneficiary firms and reduced the probability of aided firms closing. The state aid scheme to support regional development and job creation fulfilled its main objectives, with robust evidence of a positive direct effect on employment creation and, to some extent, on investment. Regarding the state aid scheme to support the upgrade and modernization of research, development, and innovation, the analysis found evidence that the scheme helped promote research and development efforts.
